According to the company's website, "Hummingbird Funds, LLC d/b/a “Blue Trust Loans” is the tribal lending agency of Lac Courte Oreilles Financial Services, LLC, an arm and entity of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians of Wisconsin, a federally-recognized sovereign nation located within the United States of America, and is operating within the Tribe’s Reservation." And, "The Tribe is a federally-recognized American Indian Tribe and enjoys governmental sovereign immunity. Because we and the Tribe are entitled to sovereign immunity, you will be limited as to what claims, if any, you may be able to assert against the Tribe and us. To encourage resolution of consumer complaints, any complaint may be submitted by you or on your behalf as described in the" Terms and Conditions on its website. "Your right to file suit against us for any claim or dispute arising from or relating to this Agreement is limited by the WAIVER OF JURY TRIAL AND THE TRIBAL DISPUTE RESOLUTION PROCEDURE provisions that you acknowledged and agreed to in the Loan Agreement."

- You may rescind this Agreement without cost orfurther obligation if you do so by 5:00 PM CST on the next business dayfollowing the Disbursement Date (the "Rescission Deadline"). Torescind the Agreement, you must inform us in writing, by the RescissionDeadline, by either faxing notice to 1-855-630-9579 or e-mailing to [email protected] that you want to rescind this Agreement. In theevent that we timely receive your written notice of rescission on or before theRescission Deadline but before the loan proceeds have been credited to yourBank Account, we will not affect a debit entry to your Bank Account and bothour and your obligations under this Agreement will be rescinded. In the eventthat we timely receive your written notice of rescission on or before the RescissionDeadline but after the loan proceeds have been credited to your Bank Account,we will effect a debit to your Bank Account for the principal amount of yourloan. If we receive payment of the principal amount via the debit, ours andyour obligations under this Agreement will be rescinded. If we do not receivepayment of the principal amount via the debit, then the Agreement will remainin full force and effect until all sums due and owing under this Agreement,including finance charges and/or fees, are repaid in full.
