The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On June 19, 2018, in the United States District Court for the Eastern District of Washington, the United States of America filed a 31 count Indictment versus James Stein-Sheridan Shelby DDS and Timothy James Flech, hereinafter “Defendants” for Conspiracy to Distribute Controlled Substances, Distribution of Hydrocodone, Distribution of Tramadol and Forfeiture Allegations.
It is alleged from in and around October of 2014 and continuing through and about November 28, 2017, Defendant Shelby did knowingly and intentionally combine, conspire, confederate and agree together and with others known and unknown, to commit offenses against the United States, that is, to distribute and cause to be distributed a mixture and substance containing a detectable amount of Hydrocodone, and Tramadol without a legitimate medical purpose and outside the usual course of professional practice. Under the Controlled Substances Act, a prescription for a controlled substance is not legal or effective unless it is issued for a legitimate medical purpose by a physician acting in the usual course of professional practice.
According to the indictment, Shelby wrote 221 prescriptions to someone identified only as “M.B.” Those prescriptions totaled 12,406 tablets of hydrocodone, which is sold under the names Vicodin and Norco. He also prescribed the same person 63 prescriptions that contained 5,252 tablets of Tramadol, a synthetic opioid drug, which is commonly sold under the name Ultram.
