Government Action: BBB reports on known government actions involving business’ marketplace conduct:
The Washington State Attorney General's Office vs Fallen Hero Bracelets; The Benjamin Foundation dba The Roberts Ridge Foundation; Michael Alexander Friedmann; and Jane Doe Friedmann

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

On July 18, 2019, the Washington State Attorney General's Office filed an injunctive relief under the Consumer Protection Act and The Charitable Solicitations Act against the defendants Fallen Hero Bracelets; The Benjamin Foundation dba The Roberts Ridge Foundation; Michael Alexander Friedmann; and Jane Doe Friedmann.

It is alleged the defendant Michael Alexander Friedmann controls and operates both corporate defendants, Fallen Hero Bracelets and The Benjamin Foundation. Fallen Hero Bracelets was formed for charitable purposes. The website claims that sales of bracelets support numerous organizations and foundations and funds. As of June 14, 2018, Fallen Hero Bracelets had not donated any money to those organizations. Also, the website allegedly makes dubious advertising claims.

It is alleged defendants have made false, misleading and deceptive statements in charitable solicitations to induce consumers to donate to or purchase merchandise from Fallen Hero Bracelets.

It is alleged in 2015 through July 18, 2018, defendants solicited charitable contributions from the public in the state of Washington without being properly registered as a charitable organization with the Secretary of State. Fallen Hero Bracelets did file an Optional Registration form with the Secretary of State on September 14, 2017, but it represented that no one involved with Fallen Hero Bracelets is paid for their work, however the State alleges it is false that no one is compensated for their work.

The Washington State Attorney General's Office is ordering that the court assess civil penalties of up to $2,000 per violation against the defendants for each and every violation of the Washington State Consumer Protection Act.
