Refund and Exchange Policy

A 50% deposit is due upon the execution of this Agreement and prior to set date of the final measurement. The
remaining balance is due at installation. At the substantial completion of the job, the balance is due and shall
be paid at the job site less a 10% serving as a retainer of the remaining balance, due to any minor work that
is still pending. This retainer will be paid to Sky Marble and Granite; after all minor work is completed if any
existed or reported. Nonpayment of the balance of the sales price at installation will be a breach of contract
and a 2.0% late fee of the total bill will be imposed unless other arrangements have been made with Sky
Marble and Granite, Inc. Any order less than $1,000.00 100% is due upon signing of the proposal. Customer
shall pay a late fee of 2.0% per month on any unpaid amount. Customer agrees to pay Sky Marble and
Granite, Inc.’s costs of collecting the amounts owed, including court costs and reasonable attorney fees, even
if a lawsuit is not filed, and such costs will be added to and become a part of the amount due. Customer’s
failure to pay any amount when due is a material breach of this Contract which will entitle Sky Marble and
Granite, Inc. to do any or all of the following: (1) terminate this contract, in which event the unpaid balance on
this contract shall immediately become due and owing whether the products and services have been
furnished or not; (2) permit Sky Marble and Granite, Inc. to repossess the goods conveyed or installed; (3)
withhold delivery of goods and services; (4) withhold future deliveries of goods and services; (5) file all
necessary liens and commence foreclosure/civil actions against the property, persons or entities holding title
to the property. Customer acknowledges that Sky Marble and Granite, Inc. is a volume seller entitled to lost
sale damages. Customer agrees to pay Sky Marble and Granite, Inc. for any additional costs incurred by Sky
Marble and Granite, Inc. in the performance of this contract resulting from the failure of the customer to notify
Sky Marble and Granite, Inc. of changes or acts of the customer, which result in additional cost to Sky Marble
and Granite, Inc. Change orders will be issued upon any changes to the job description written above and
must be made in writing and signed before the work can proceed.
