    On May 30th, a week before closing on the sale of our home, our video security system showed a pending buyer came alone to our home and went to our selling agent's lock-box on the front door and proceeded to let himself into our home without anyone else being present after the access code was provided to him by phone by CB Sales & Rentals.
    A buyer's agent supplying a pending buyer with access codes to enter our home by himself is a clear violation of the Realtor code of ethics. Additionally, our property is clearly marked “No Trespassing”. Anyone without my authorization, or my selling agent's authorization on my behalf, is trespassing under Virginia law. Entering the homes is, additionally, Unauthorized Entry under Virginia code. Our security system clearly shows ONLY the pending buyer on the property and entering the home with the lock-box code.
    Then, when the buyer left the home, the pending buyer took the keys to our home with him! The pending buyer should never have had access to the keys for my home until the closing is complete and they are handed over to him. This is a major liability and security risk to us and our home.
    This violates the **** ** ****** *** ********* ** ******** ** *** ******** *********** ** ******** ******** ** ***** ******** ** ******** **** *** ******** ** ******** **** ** **** ******** ******** **** ** *** ********** ******* ***** ********* ********* ********* *** *******.
    On April 17th, CB Sales & Rentals showed the same home to potential buyers, and when they all left the property all the lights in the home were left on and the front door was left wide open. Again, a huge security risk leaving my home unsecured. (This too is clearly seen and recorded on our video security system.)
    This kind of behavior and lack of competence puts all sellers' and their homes at risk for strangers to enter the home without warning or knowledge of the homeowner.

    At the time, we were scheduled to close on the following business day (we did end up with a 2 day delay due to the lender not having the paperwork to the closing agent but this was unknown on May 30th when the closing was scheduled). There were some back and forth conversations the week of May 30th between myself and the listing agent- some by text and some verbal, about the details of our upcoming closing and we had agreed that the keys could be accessed by the coded lockbox for the walk through and used for having at the closing. The listing agent had told me that she was going to pick up the box on the day of the scheduled closing and since I did not know what the time was on the 30th, I thought it prudent to take them to the settlement company for the closing on the next business day.
    As I was headed to meet the buyer for the scheduled walk through, I had a flat tire and ended up at ******* in ******* for a new tire. This delay stalled me being at the home on time. I talked to the buyer who had to be at work shortly after our scheduled meeting, so I suggested he have me on the phone as he did the walk through and I gave him the code to the box to do this. I was on the phone with him the entire time he did the walk through and he had no problems with accepting the current condition of the home. This process took less than 3-4 minutes. I thought about having him put the keys back but to assure there was no security breach, I had him meet me with the keys in short order. I was in possession of the keys and decided to take those to the settlement firm the following business day.
    I am truly sorry about this and realize I should have called the agent for express permission for this specific purpose, but felt I had this permission from our phone call earlier. I realize now that this perception may have been incorrect and truly apologize for any problems this caused. There was never any ill intent, simply a misunderstanding of the permissions I thought we had been given by the seller's agent.
