    I gave MODA $11,060 as deposit to remodel my kitchen. Their workers walked off the job during demo and did not return. Sim and *****, the owners, initially agreed to return some of the deposit. I agreed that they should be compensated for some of the work that they accomplished. But we disagreed on the amount. They have since stopped returning my emails and they kept the entire amount. I would like to have $7,500 of the deposit returned.

    Customer claims to give them entire amount of money. We have done a lot of work there, in the middle of the project, they racially discriminated our workers, who is ************* Veteran of ************* Mr *************************** wife said she wants white people only to work at her job. And than excuses did not work, she started complaining on the tiles she selected, she accused us we produced tiles in our back yard and painted them brought there, really? Than we order new pallet of tiles, she selected again, from another company. She again complained on those, and accused us of that she did not chose those tiles.

    Yet, she also said that workers are not allowed to use the restroom in her house, because she says " white people never allow workers use the toilet" what that mean?

    We had had enough off racial discrimination, harassment, and being accused of nonsenses. This is the very first time happened to us, we had to stop the work, I told *********************** that we will pay you nothing, because we did a lot there, and I told him final I can mail him $3000, final, he said no.

     

    He keep pushing for $7500, he thinks all we did there cost $3500?! I paid my guys labor only $5,000, and material cost was over $2,000, however; tiles which we ordered first, we had to pay restocking fee, and second order was not able to return, plus on top of that we had insults and accusations, and my guys being discriminated.

    We did reply to him multiple times, talk to him on the phone. The reason I did not reply his last email, because i have already told him $7500, no way.

    My guys who was working with me still under influence that if the come back to work in VA they will have the same issues, they do not wanna work in the area, now they are only working on our MD and DC projects.

    Your 10 deadline went over 2 weekends including the Easter weekend.  That is unreasonable to expect me to respond that quickly.  Please do not close this action or I will be forced to seek other remedies.

    Here is my response:

    I cant believe that MODA claims this issue is racially related.  I am Hispanic, the workers are Hispanic,and my wife is married to a Hispanic. This issue has nothing to do with race. This was directly related to how the workers treated our bathroom. We allowed them to use our restroom for convenience since our house was vacant under assumption that they would treat it respectfully. We were outraged to find that they left the restroom in a complete mess. I wont describe the details except to say that the room looked like a gas station restroom.  Used toilet paper is intended to be flushed down the toilet not left on the floor.  After we brought up the issue with MODA the workers walked off the job and never returned except to pick up their tools one week later. There were other issues related to their work habits, such as always being on their cells phones when we went by on surprise visits.  Regardless of MODAs reasoning, they do not have any right to keep the entire deposit.  Request some of the deposit be returned.
