    I received a notice that I have a collection from SPRING OAKS CAPITAL LLC on my credit report. It says it was opened on Mar 24, 2022, for $ ***** with account number starting in XXXX that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the **** *** *****.

    I would like for this collection to be removed asap or I will file a **** *** *** report.

    is focused on consumer treatment and compliance with all state and federal laws
    and regulations.  We respectfully disagree with the assertion contained
    within your complaint related to our handling of your account. On March 24,
    2022, we purchased your account that originated with ** **** ***** **** **** ******** mailed our initial letter to you on April 1, 2022, at the same
    address listed on your complaint. This letter advised you of your rights to
    dispute the account under the Fair Debt Collection Practices Act (FDCPA) and
    that a negative report reflecting your credit record may be submitted to a
    credit reporting agency if you fail to fulfill the terms of your credit
    obligations. Please note that we
    report the purchase date of your account (March 2022) as the open date in
    accordance Consumer Data Industry Association (CDIA) guidelines for credit
    reporting.

    We received your *** complaint and opened a dispute in response. We
    investigated your dispute and have determined that our reporting of your
    account is accurate. Our records reflect that your account was opened on June 24,
    2021, and your last payment prior to charge off was made on October 1, 2021, in
    the amount of *******. Your account later charged off on February 21, 2022, and
    the charge off balance was ********. A payment of ****** was made to our office
    on September 23, 2022, and the current balance owed is ********** We are
    sending you our response along with copies of your loan agreement and
    promissory note, borrower agreement, terms of use, E-sign Act Consent, credit
    profile authorization, Truth in Lending Disclosure statement, ACH
    authorization, and transaction ledger, bill of sale reflecting the sale of the account from *** *********s, LLC to
    Spring Oaks Capital, LLC, and subsequent transfer to Spring Oaks Capital SPV,
    LLC.

    Additionally,
    our records also reflect that on December 5, 2022, you spoke with one of our
    representatives and agreed to resolve your account in one payment of ********* on December 28, 2022, but called back on December 19, 2022, to inform us that
    you would not be able to keep the arrangement and requested a call back the
    next day. If you would like to establish an arrangement to resolve your

    The issue Started at the end of October I have called to change the date of my payments, from weekly to bi-weekly. The agent I spoke with didn't pay attention and used my husband's account not mine so payments were messed up we received over-draft charges. So I called again and spoke with another supervisor and supposedly this call wasn't recorded and notes put in, but I called on Nov 4th because payment had been taken and caused an overdraft few when there shouldn't have been a payment taken. I was told that auto-pay was taken off and a promise was put in my file to say I would be mailing in my payments due to the issues of the payments being messed up. This morning 11/21/22 at 7 am I called my bank because they pulled 2 more payments out of my account and the autopay should not have been on. So I called again and talked to S***** ***** who stated she was the Facilities Operations Manager and she claims to have finally taken off the auto pay. Since this has all started they took a total of 5 unauthorized payments because the autopay should have been off causing us $** *n NSF fees it would have been more but I had to cancel my auto and renters insurance payments because they took those two payments out of my account without permission. I informed my bank if they try to take any more payments out that it is fraud and theft. I also let Ms. ***** know this as well and she would not give me any kind of confirmation that my banking information with them had been deleted. I have severe anxiety and have an ESA animal. This situation has increased my anxiety through the roof. I am thinking of seeking legal counsel because of it. I am waiting to see if they return my payments and NFS fee. I doubt if they will as I was told once before it would be done but was not done. They are stealing from people hoping the people don't catch that they are still taking payments when they shouldn't be.

    I am not aware of this account. I have reached out to TransUnion Credit Bureau, and with SPRING OAKS CAPITAL LLC to have this account removed from my file and they are always saying the same excuse, which is no longer acceptable. I have filed this as an outcome of Identity Theft. Regardless of all actions done on my end, there was no action from TransUnion Credit Bureau. Thus, I am reaching out to seek assistance to have SPRING OAKS CAPITAL LLC confirm that I have no account with them and that the TransUnion Credit Bureau can simply remove it from my credit report.
