    On 8/9/23
I hired snowbird roofing and siding LLC to remodel the exterior of my home. (See attached estimate)

    On 8/10/23
I paid snowbird roofing and siding LLC $19,150 as a deposit for the project. (See attached check). We did I detailed walk thru to make sure everything was in order. John was given a 3D drawing showing the different materials to be used. We discussed the need to get a building permit or not. John said that he usually didn’t need to get a building permit for this type of work, but he would get one if needed.

    On 8/22/23
I returned from vacation to find my house un-finished and noticed numerous quality and safety issues. I brought my concerns to John’s attention, and he became very agitated and hostile. He told me that he was having difficulties getting his crew to do the job properly. So, he fired them. This happened a total of 4 times with 4 crews.

    On 9/5/23
Very frustrated with the quality and incompetency I called the manufacturers Representative to ask if he could explain to John how James Hardy Board was to be properly installed. John started yelling at me and the James Hardy Manufacturers Rep. and the Rep told me he was unwilling
to help John! Then, John started yelling at me and DEMANDED that I pay him a $10,000.00 Progress Payment. I called Sandy City building inspection department to schedule an inspection.

    On 9/6/23
Inspector, Adam R** met with me and a 5th crew. Adam briefed me on his communications with John. This was THE FIRST TIME HEARING about all the communications and violations. To be very clear, I had a bad feeling about John and his workers after I saw their work. I had NO IDEA he had been repeatedly ignoring the Inspectors too. Adam issued a STOP WORK NOTICE on the project. I told John to remove himself and his stuff from my property IMMEDIATELY! I told him that I could not do business with someone who repeatedly and willfully violates Sandy City Building Code. He violated my TRUST!

We had nearly completed the job for this customer, all that remained were some window flashings, when customer demanded we fully refund his money and would not let us complete the job. The job was essentially 90% completed.

Customer paid $29,150 out of a total owed of $47,300.00. The $47,300 price was a significantly discounted price in the first place.

Customer kept all materials from the job.

We did have to pay a permit fine of $800, but that did not change the quality work we did for this customer.

We are still willing and able to complete the job for the quoted price and have a third party expert inspect the job to the customer's satisfaction.

I am rejecting this response because:

Sandy City Building Inspectors FAILED the work performed by Snowbird Roofing.  They POSTED a STOP WORK ORDER on my property! Sandy City is now requiring a complete removal of all the siding, soffit and facia due to the fact that the Weather Barrier Inspection failed inspection multiple times and Contractor was told multiple times to not proceed or put any siding on until the Weather Barrier Inspection had passed inspection. There demands fell on John’s deaf ears and John took it upon himself to go forward anyway, against Sandy City Inspectors demand.

This is going to cost the me (the customer) $73,240 to redo everything John did wrong.

Due to the contractors complete incompetence and unwillingness to comply with Sandy City Building Officials, I can no longer in good faith allow John on my property. All materials will need to be trashed because it cannot be reused once it is removed from the house since it’s a concrete Hardy Board.

    Sincerely,

In the interest of settling this matter, I would accept arbitration but I do not see the customer agreeing.  Their demand makes no type of compromise possible but I would be willing to try pursuant to BBB policy.

My business entered into a contract whereby the business was to do work on the customer's house.  On the initial day of work, I was not there to supervise and my workers did not properly put flashing on the windows.  When I went to the jobsite and met with the Sandy Community Development (SCD) inspector we both saw the issue immediately and I agreed to correct the work.  The inspector agreed and work was started.  We were advised that all of the work was going to be approved once the windows were fixed.  In fact, if you look at the report, it states that the inspection was passed.  The report is attached.

Apparently the business was not working fast enough for the customer and he repreatedly called the inspector which led to the cease work order.  There was no need to keep pestering the inspector as an agreement was already reached and the work was progressing.  In fact, attached are photos of the completed windows to see the superior work that was done.

One day when the business arrived to finish the work, the customer started yelling at the crew, belittling the work and the workers, threatened the workers and told them that they were no longer allowed to be on the property.  The business was ready, willing, and prepared to finish the job.

All of the work that was done was to industry standards once the window flashing was completed.  There was and is no need to tear down everything and to do so would be at the customer's own decision.  The client did not pay all of the bill owed and there is an approximate balance of $13,000.

I have dealt with many difficult customers and try my best to have everything resolved beneficially with the customer but there is no reason to my myself and my crew treated as poorly as this owner.

I am rejecting this response because:

According to Sandy City Inspectors, John was told several times by Sandy City that the barrier inspection did not meet code. He was given numerous chances to fix the flashings by Sandy City and failed to comply.

Please see supporting documents previously attached to this complaint.

I’m not interested in any of that. I did nothing wrong. Mr. *****’s will be under investigation for false claims. If you want to file a complaint against me I guess that is God’s will but I believe in God and I prayed to him all the time and he will let nothing bad happen to me. I hope you’re well.
