I signed a 2 year alarm contract with Protect America in 2019. I paid Protect America for the the first year and few months and then billing just stopped as it was being auto drafted from my account. Yesterday I was received a notice by my credit monitoring company that I had a collections notice on my credit score from Zion Dept Holdings for the sum of $490.56 from Brinks Security. I was informed that Brinks acquired Protect America in 2020. This is when billing had stopped and I was never notified that the acquisition was taking place and that I would now be billed by Brinks rather than Protect America. I was never notified by email, text or mail that this account was supposably past due on payment. Come September of 2023 I am now notified that Zion Dept Holding purchased this Dept from Brinks Security and have now put a mark on my credit and up charging the cancelation of my contract with Protect America. The fact that I was never informed by any means that my contract had been sold and that my account was past due and then sold to a third party and have no option but to pay Zion the $490 is unethical on so many levels. Brinks and Zion Dept Holding, LLC are both to blame and this is a scam.Business Response

The date that this company is reporting is false and I never had a contract with the creditor that's being reported. I have requested the original contract that has my signature on it thr rep. fir zion said that he had it in front of him looking at it while speaking with him on the phone also this was the first that I've heard about owing money for an account they never tried to reach out to me about this situation I also stated on the phone while speaking to the rep that this has never been a service that I used nor a street that I ever lived on so per the ftc I've asked for the original contract and the haven't been able to produce it.Business Response

We were subscribed to an alarm monitoring service from a company named Monitronics. We were not happy with the service and canceled via phone. The company kept billing us even after we canceled an no longer used the service. Naturally we stopped paying but they kept billing us. I believe this is something fraudulent they do to other people. The company was bought out by Brinks and now they have sent me to collections for a balance of $484.52

Although they billed us for services we did not use i tried to settle the amount but they will not compromise. Now i have negative impact to my credit and don't know what to do.Business Response

I am rejecting this response because:As stated, we canceled the services via phone and we kept getting billed. I’ve seen multiple complaints similar to me. Your policy to cancel via written response makes it very difficult to cancel. Additionally, the company got bought out. The only way to cancel was to stop paying.
Obviously we are not in agreement I don’t feel I should pay for services I did not want or use and you guys feel I have to pay $400+ you billed me for idk how many months?? but I’m a reasonable person and still offered to resolve the issue by taking half the responsibility. I’m here to close this issue and I agree to take 50% of the responsibility to close this once and for all

Your contract clearly states that you need to send in a written notice of cancellation. Please see below Service Fees and Terms of Agreement.
SERVICEFEES AND TERM OF AGREEMENT: This Agreement shall continue for an initial term of three (3) years (the'InitialTerm") unless earlier terminated pursuant to the provisions hereof, and shall there after automatically renew on a month-to month basis. After the Initial Term, Customer may cancel this Agreement with 30 days nolice by sending a signed request for cancellation to Company which includes Customer's name, address, account number and password Customer agrees to pay the total monthly fee above plus all applicable taxes, permit fees, false alarm charges, communication charges, return check charges, guard charqes, service charges, late charges, or other related charges, if applicable, whether imposed on Company or Customer. Company may increase Total Monthly Fee up to live (5)% annually during The initial or any renewal term without prior notice.

I checked my credit report and happened to see a collections charge of $270 from Vivant Smart home in November 2022. Zions reported this to the credit bureau.
