      We are moving because of the overwhelming cockroach infestation. We have three different cockroach species that have infested the entire apartment complex, and we are seeing them in increasing amounts. We have found them in our food, in our toilets and sinks, in the shower, in the washer, in the dishwasher, etc. In the past week I have woken up twice to cockroaches crawling on me. This is not even to mention the mice problem! Last year we caught sixteen mice in the span of one month.

      According to Utah Code 57-22-3(1) the owner of the apartment must maintain that unit in a condition fit for human habitation. Given the intensity of the roach infestation, the apartment is habitable. Roaches carry many diseases and several parasitic worms. We have also incurred property damage due to the pest problem. When we do move, we will have to get rid of several major pieces of furniture and the majority of our kitchen appliances because it is impossible to completely clean them of the pests. To replace these will cost between $3,000-$4,000.

      The management company has been aware of the infestation as I have submitted maintenance requests for pest control many times. Many times, we have ONLY gotten pest control because I have asked. There has been no serious attempt to rid the apartment complex of the roaches and as such, we have decided to move.

      I have reported the apartment complex to the Salt Lake Health Board for the infestation.

      The company still refuses to let us out our lease and holds us liable for the last three months of our lease, which will amount to $3,075.
