May 24, 2021 To: Steven U** We received the complaint from Better Business Bureau, ID 1*****, in regards to the loan you obtained with us. The following is our response: Red Rock Financial extended a loan to you and your cosigner on 12/18/2019 for the purchase of a 1997 GMC Sierra, in which you signed adding VSI insurance on the 1997 GMC Sierra for a limit of liability $3000. We had been receiving monthly payments from you up until 10/30/2020. On 9/22/2020 you and the cosigner contacted our office to let us know that the vehicle had been damaged on 9/24/2020 from a hit and run, and would like to file an insurance claim for the repairs and had an estimate. You both came in on 10/23/2020 and the cosigner signed the forms authorizing a claim to be filed and also with a mechanic’s estimate for the repairs that were needed on the 1997 GMC Sierra. We submitted those forms to the insurance company. On 11/5/2020 we received a response from the insurance company, the insurance policy for liability is “shall not exceed the lesser of the following: A. Cost of Repair or B. The Net Payoff or C. Scheduled Balance of Insurance or D. Actual Cash Value given that on the date of loss (9/24/2020) the following is what each came out to: A. the repairs totaled $5851.06 B. net payoff was $2334.12. C. amount of insurance in force at date of loss was $1675 D. the cash value of the vehicle was $3950 The insurance companies issued a check of $1675, representing the Scheduled Balance of Insurance, which is the limit of liability. Upon receiving that payment, we then applied it to your account, which left a payoff balance of $859.12. We talked to you both and explained what had transpired in detail about the insurance claim process and so you said you would work with us on paying the remainder balance. Then we made multiple arrangements with the cosigner and you to make payments on the remainder balance, but those arrangements were never kept. Given that there was a signed contract, we received payments from you, then the insurance claim was authorized by your cosigner, and that we had been in regular communication from the beginning of the loan, during the insurance claim process, and after the claim was finalized and arrangements were set up for the remainder of the balance due. We do disagree that there was any fraud or scam committed from us and that we have been more than forthcoming with you regarding your account with us. Please feel free to contact us at 801-689-2999.
