    I sought painting services to make my property more marketable due to my relocation out of state. ***************************** owner of superior colors LLC, doing business as (DBA) superior painting and remodeling LLC presented himself as having an A+ BBB rating he claimed he licensed and has $2 million in insurance coverage. On May 23rd, I signed a contract with ***************************** for exterior painting, following his assurance that the work could be completed in two and a half weeks so I can put my house on the market. Additionally, I requested an interior painting quote based on my realtor's advice.I paid 50% of the exterior painting cost ($7,187.50) and 50% of the interior painting cost ($8,000) via separate checks.I needed to obtain ACC permission for exterior painting, which took one and a half weeks. Upon receiving permission, I contacted ***************************** to schedule the start date, but he provided vague responses and no definitive timeline.Further research revealed numerous complaints against the defendant on BBB, Yelp and Angies List, for taking deposits without completing work, doing substandard work, or subcontracting without notice.When I informed the defendant of my intention to file complaints with the BBB and the ************************************************ he threatened to sue me for defamation and place a mechanic lien on my house even though he never start work or provide start date.Despite multiple attempts to resolve the matter, including sending demand letters phone call, house visit and contacting the Bexar County Sheriffs Office, ***************************** remains unresponsive and refuses to start the work or issue refunds keep saying you will hear from my lawyer in which we never heard from.Due to the defendants deceptive practices, misrepresentation BBB, failure to fulfill contractual obligations, and subsequent threats, I am seeking: Full Refund: Of the deposits paid for both exterior and interior painting services.

    This is Superior Colors LLC dba Superior Painting and Remodeling responding to the dispute issued by *************************** and ***************************** on June 21, 2024.  Please note that as of the date of filing this complaint with the BBB, *** and ******************* (hereinafter referred to as *******)sent Superior Painting and Remodeling (hereinafter referred to as Superior) a letter from their attorney dated June 27, 2024 (Demand letter) threatening legal action against Superior. There will be several references to the demand letter received by Superior within this narrative.


    On May 23, 2024, Superior was contacted by ******* for an exterior project to be performed at the home of *******************************************************************************.  The initial contact was via phone to Superiors office for an exterior repaint quote.  ***************** states in her BBB complaint that she I sought painting services to make my property more marketable due to my relocation out of state.  However, the Demand Letter state Superior showed up unannounced, showed up at our clients home and solicited to them for painting services.  (See Demand Letter,Page 1, Paragraph 3). This is one of the many inconsistencies made by *******.  ******* states they searched the neighborhood ******** page requesting recommendations for a reputable painting company.Superior does not solicit customers from ********. ********************** relies solely on ****** ads and their website to promote its contracting business. It does,however, have a ******** page as part of its business communications to potential customers.  ********************** never solicited *******.


    On May 23, 2024, a contract was sent to ******* regarding the scope of work to be done for the exterior of the residence. Thereafter, ******* requested Superior provide a quote on the interior of the home. On May 30, 2024, a contract was sent to ******* for the scope of work to be done for the interior of the residence. Both contracts required deposits and as a regular business practice Superior secures deposits for its residential and commercial projects.  Please note that we also granted ******* additional time to provide a full deposit as a courtesy and because she is part of the neighborhood. Also required is acceptance of the contracts to add the future projects to Superiors project calendar for scheduling purposes.  Projects are scheduled on a first come, first serve basis. The exterior project at issue here required *** approval which also impacts start dates. Weather is also a factor which impacts exterior start dates. Superior is not required to provide a concrete start date as projects may change or if weather is a factor. Superior does not control the timeframe for *** approval. Nor does it commence an exterior project without such *** approval if required.
     ******* demanded that Superior begin painting the interior of the home while pending *** approval for the exterior.  Superior stated the exterior would have to be done first.  Further to that, with projects that are this large in scope Superior never told ******* that the projects would be finalized within three weeks (See pg. 2, Demand Letter,Paragraph 4).  See also ******* BBB statement:On May 23rd, I signed a contract with ***************************** for exterior painting, following his assurance that the work could be completed in two and a half weeks so I can put my house on the market. Additionally, I requested an interior painting quote based on my realtor's advice.


    June 3, 2024, ******* requested Superior remove the repaint of the deck from the exterior contract.


    On June 7, 2024, ******* requested *** approval for the exterior painting of the home.  (See Demand Letter, Page 2,paragraph 5).  Per ******* BBB complaint I needed to obtain ACC permission for exterior painting, which took one and a half weeks.  However, on June 7, 2024,at 3:03 pm, Superior received a text from ******* on stating ACC paint had been approved.


    On June 10, 2024, at 5:15 pm, Superior received a text from ******* stating I will have someone else to do the inside to speed up process I will have you refund I side deposit I need to speed up process I will be losing benefit I found someone to start on the inside next Monday. I need the deposit to pay him. (sic).  


    On June 11, 2024, at 7:13 am another text message thread demanding start dates by ******* was received by Superior. Superior responded by stating they would be communicating with its attorney and CPA. Further ******* via phone stated she would no longer communicate with Superior.  Superior agreed to this request. However, ******* continued with a barrage of text messages and phone calls threatening Superior with complaints to be filed with the BBB, ************************ and FTC.  Superior merely responded that threats such as those could lead to defamation of character and breach of contract lawsuit.  


    When Superior would not agree to Condicts demands, ******* began a spree of disparaging, slanderous and harassing conduct:
    On June 18, 2024, a small claims court case was filed against Superior Colors LLC. The case was dismissed on July 1, 2024.  Case No. 31S2400435.

    Prior to June 20th, ****************** and his real estate agent showed up at the ******** home. ***************************** told them this was a civil matter to be handled by the terms of the contract and to please leave his residence.

    On June 20th at 1:03 p.m. ******* had a Bexar County Sheriff Officer and an Investigator show up at ******************************* residence.  After showing the Officer and Investigator the terms of the contract language, both agreed that this was a matter to be handled by the terms of the contract.  

    On June 22nd, ******* posted defamatory and slanderous statements on the Summerglen Residential ******** page, a neighborhood where ******************** and ********************* reside to include personal information outside the scope of the issue at hand. It was so disparaging that the Summerglen ******** page removed the statements and came up with rules regarding how future posts would be viewed and approved. The posts were removed on June 23rd.

    On June 23rd several neighbors and customers from the ********** neighborhood and the *** contacted ***************************** regarding Condicts statements in the Summerglen ******** post. Statements made by these neighbors/customers reflected a sentiment that ******* was known to create issues throughout the neighborhood.  ******************** were a source of embarrassment for the Espinozas. 

    On June 25th and June 26th Reviews on Yelp regarding Superior which were defamatory and slanderous in nature were posted and were untrue.

    Approximately one month ago a review on ****** which was defamatory and slanderous in nature was posted and is untrue.

    A slew of harassing phone calls and text messages were received by Superior from ******* throughout the course of this matter.

    Internet research shows ******* has a habit of posting derogatory statements regarding other reputable companies.

    Superiors contracts clearly state its Limitation of Liability, Dispute Resolution, and Termination clauses. Also, on the Superiors webpage there are Terms and Conditions along with its Cancellation Notice.  ******* agreed to all these clauses and conditions when they entered into the contracts.


    ******* has been on a destructive course against Superior and sought to destroy its company,reputation and character along with providing sensitive and personal information related to *** and ********************* outside the scope of the issue at hand. Contracts for May 23rd and May 30th are well beyond the cancellation date as stated in the Superior contracts. ******* is in breach of these contracts.

    I am rejecting this response because:
    ******************* is deceptive in his timeline and chain of events, and some statements listed here are not even factual. I will dispute them with records here and in court. I appreciate the BBB demand him to submit evidence for every statement he made here. Please review my messages and my dated demand letters submitted with my original claim. I also have video and audio recordings of his house visit which tell different story than what he stated, as well as a police report.
    ******************* never responded to any of the text messages attached or to any of the demands letter attached. The bottom line is that ******************** misrepresents his business and falsifies his BBB record to trick people into signing contracts that he knows he cant fulfill, when I demand start date he threatening me to place lien on my house if I dear to say anything. Please see text messages. I submitted all corresponding with this business to BBB. and they can compare these corresponding with every statement he made here to show the level of deception.
    My review is based on my own experience which all true with evidence, and its aligned with many other experiences on yelp and BBB claim section on the same business please see attached. And public record.
    Despite all the demand letters, text messages, and a sheriff's office visit, he still refuses to start work, provide a start date, or refund our money of $15K. This is why we are suing him in court under the Deceptive Trade Practices Act.
    I advise ******************** to forward all communication to our lawyer, as he admitted here,he received the letter from our lawyer on June 27, 2024.

    Hello. We have reviewed the rejection made by ******************. We stand by our original answer previously filed. We also intend to stand by the terms as stated in the contract. ******************* breached the contract by cancelling the projects well after the time allowed for cancellation. Further, as per the terms of the contract, filing a compliant with the BBB is the improper venue and as such ******************* has obviously not read or understood the terms and conditions on page two of the contracts as well as the notices posted on our business website. We intend to vigorously defend our company and also defend ourselves personally and has harassed, defamed and attacked us via social media platforms. We ask that the claim by ******************* be dismissed and removed from the BBB platform. Please see page 2 of the contracts. We stand by if the BBB needs to contact us personally via email or phone. Thank you for your time.

    I am rejecting this response because:

    ********************, owner of Superior Colores doing business as Superior Painting and Remodeling LLC, will face the full weight of the legal system for service theft and deceptive trade practices, both of which are criminal and civil offenses.Contrary to what you suggest, I have not submitted any cancellation paperwork as it required per contract. For any of the contracts (the outside house paint or inside house paint contract). since the contract signed on May 23/2024 and as of today Aug 16/2024,Superior Painting and Remodeling LLC owner ***************************** has refused to start the work or refund our $15K deposit.
    This business operates out of a mailbox to avoid liability. We have sent numerous demand letters to both the home address and the business mailbox, all of which were returned as undeliverable (attached). Even when a court deputy attempted to deliver the court notice in person at their home, they refused to answer the door.
    I am fully committed to protecting my family's interests, as well as the interests of our community, against this theft. I will pursue this matter both civilly and criminally, and I will not be intimidated by a shell company designed to defraud people and enrich its owners and their family at the expense of others.
    I have audio recordings, video evidence, a report from the Sheriff's office,text messages, eyewitness accounts, and testimonies from others who have suffered similar service theft at the hands of this company and this ownernot to mention the contract you have breached. All of this will be included in our legal case.
    I also urge the BBB to thoroughly investigate all the positive reviews submitted by so call " Customers" and request proof of payment associated with them. I believe its crucial for the BBB to adjust the rating of this business, as the current rating is being used as a tool to mislead and defraud more people out of their hard-earned money,just as it did with us.
    We have ample evidence that this is not the first time this business has engaged in service theft, which is why we have also filed a claim with the ************************* to investigate further. Bottom line: I will keep pursuing this matter until it is resolved, no matter what it takes. And I advise the owners dont expect any thank you letter for the service theft you have committed against our family.
    since May, we have given you ample time to reconsider your position, but with no response. We are done waiting; this matter will now be resolved through the legal system. If you have anything to say forward all communication to our lawyer.

    I was looking to get my house painted and found Superior Painting and Remodeling online. It had great reviews.The owner ***************************** came to my home on January 10, 2024 to inspect the home and provide an estimate. Later that day January 10, 2024 I received an estimate of $4400 to paint the home. I figured that was a good price compared to other quotes received and I called ****** on Jan. 11, 2024 that I would use him to paint my home. The owner of the business ***************************** came to my home on Jan. 11, 2024 and collected half of the cost $2200 in cash and the remainder to be paid once job was completed. ****** was to send the info to my HOA on Jan. 11th for approval. January 16th the email had not been sent to my HOA. I asked ****** what was cancel policy and to provide refund since email still hadnt been sent. He stated he would get the email sent and it must have been a mistake in the email address that I provided him. An email was sent to HOA by ****** and I had to submit the application on Jan. 17th and I received approval from my HOA on Jan. 24th. I notified ****** on Jan. 24th that approval was received he stated that he would contact me by end of week to setup start date. I didnt receive a call so I reached out to ****** again at the end of January. I spoke with ****** on Feb 6th and again was told that he would call later that day to schedule start date. February 9th I still had not received a call from ****** with a start date so I reached out to him and requested a refund of the $2200 payment. On Feb.12th I spoke with ****** who stated that he would send a release agreement so that a refund could be issued. I signed and returned form on Feb. 12th. Still no refund. Feb 27th I checked on status again and ****** said he had Covid. I have yet to receive my refund of $2200 and ****** keeps saying that he will get completed and its a process. Its going on 2 months since I selected ******** said it would be 5-7 business days to receive refund from Feb 12

    **************** signed a contract with Superior Painting and Remodeling on January 10, 2024, for an exterior repaint of his home.  The homeowner is responsible for notifying their HOA of their intent to use certain paint colors for painting their home.  As a courtesy to ****************,Superior sent an email on January 16, 2024, to ****************** *** for their review of the scope of work to be done and approval.  Please note that if **************** wished to cancel the project, it is his right to do so under the terms of the termination clause of the contract.     E.         TERMINATION
    YOU, THE ****** MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THE TRANSACTION. SEE TERMS AND CONDITIONS, NOTICE OF CANCELLATION AT ********************************************;


    At this point of communication, we were well beyond the third business day for **************** to cancel the contract.  Trying to do so past the three-business day **** would constitute a breach of contract. Also, during this time, we began to receive numerous text messages and phone calls from **************** outside of business hours; some at midnight during the week along with leaving messages calling me, ******, a liar.  In good faith, Superior that it would be in the best interest of the parties to have a Release Agreement signed. The Release Agreement was sent on February 12th to ****************. To date, Superior has not received a signed Release Agreement from ****************. The harassing phone calls and messages continued and I, ******, do not wish to have further communication with ****************. We have a signed contract and technically, **************** is in breach of the contract. Therefore, I, ******, do not believe ************** is entitled to a refund.

    I am rejecting this response because:

    I have attached text messages sent between myself and ****** the owner of superior painting and remodeling llc. This gentleman is saying that he has not received the signed release agreement that he sent to me on February 12th. I have attached a copy of the signed agreement sent back to ****** on February 12th the same day that he emailed it to me and a text message that was sent to ****** on February 21st following up on the refund and the release agreement. I also have message sent on February 27th and 28th. ****** agreed to give a refund of the $2200 since he never gave me a start date or provided a service to me. How does he feel that it is fair or just to take money from someone and not provide a service? I would like to get my refund that he agreed to give back. He keeps giving me the runaround about the refund the same as he did about a start date. He had no problem coming to my home to collect my money but couldnt give me a start date or refund. He also stated that he and wife had been ill again with ***** and that he had been diagnosed with cancer. It may not be his policy to send emails to the *** but he agreed to do that on the January 11th which is why I sent him a text with email address and paint numbers.  It was not the 10th as he stated it was on the 11th of January. If you guys cant help me get my money back from this person can you direct me to who I need to contact or what needs to be done to get money  back? *****, feel free to give me a call ************

    We signed a contract #***** on 19 July 2023 to paint the exterior of my home(25923 Laurel ****** stain my fence and paint two exterior doors for a total amount of $6300. I paid a deposit of $2900 on 19 July 2019. The owner has rescheduled more than five times with various reasons: weather too hot, too cold, medical issues, not enough people. On at least three occasions I was not notified in advance and I had to reach out to inquire why no one showed up. As of January I asked for a refund due to no work being done and me needing the money back. Since January he has given multiple excuses including medical issues for he and his wife and he will have his attorney or accountant contact me to sign a waiver to get a refund. I have not been contacted by any representatives for a refund. At this point its been 7 months since I paid him money and almost two months since I asked for a refund.

    This is Superior Painting and Remodeling LLC responding to the dispute issued.  Please note that the contract is dated as stated, however the deposit date of July 29, 2019, is incorrect.  It is true that my wife and I had multiple medical issues during this timeframe including the necessity to travel to ******* to MD ******** for treatment. Also, during this time, we had to seek another CPA to take over our business accounts. We in no way intended to not pay the refund requested and owed. We will send over a release agreement to be signed prior to a refund being issued via cashiers check.  We would ask that the complaint be removed from the BBB site as we do have proof of the medical issues due to cancer.  We can provide proof of treatment to the BBB only.     I am rejecting this response.  I have previously been told on numerous occasions that a waiver and refund was going to be sent and never received anything. I would like to receive a timeframe of refund and ultimately have refund in hand before I withdraw or close my complaint.  Once refund is received I will be satisfied and close my complaint immediately. The owner is correct, the deposit date should read 19 July 2023 not 2019.
