I am writing to respectfully request your urgent assistance on behalf of my daughter, ****** ********, a resident of ***********, *****. She is currently facing an unjust and distressing situation involving a local car dealership, Cars by Woody, which appears to have engaged in unethical and possibly unlawful *********** daughter purchased a vehicle from this dealership and has been diligently making her payments. Recently, however, representatives from Cars by Woody claimed she had missed payments and proceeded to repossess her vehicle. When confronted, she presented valid payment receipts proving she was current on her account. The dealership then returned her carbut not without incident. In the process of taking and returning the vehicle, they caused visible damage to the bumper.Shockingly, despite her compliance and documentation, the dealership returned again on 05/07/2025 while my daughter was at school and re-towed her vehicle without proper notice or legal justification. This time, they have stated they will not return the vehicle and have refused her access to personal belongings inside the car, which is in direct violation of Texas law protecting consumer property rights during repossession. She contacted the ***************************** for assistance, but unfortunately, no action was taken to remedy the situation. My daughter is a student and relies heavily on this vehicle for daily transportation. The stress and hardship this has caused is substantial. We are seeking your support in the following:1. Investigating the conduct of Cars by Woody in this matter.2. Assisting in recovering the vehicle and any personal items withheld.3. Helping to ensure my daughters rights are protected as a consumer under Texas law.4. Referring this case to the ************************* vehicle

Customer has been Delinquent many times and we have always worked with her. I have more screen shots of us constantly having to ask her to please make her payment or that she was late.Customer normally respond and would eventually come through however this last time their was 0 communication and response from her as we reached out multiple times to find out what was going on or how we could assist to help her, however we were unsuccessful in getting in touch with her. So we felt at this time our collateral property was in danger and we had to send a repo team to find the vehicle and repossessed the car. Everything is recorded from dash cam  of the recovery agent and can clearly show when we opened the vehicle there were 2 open containers of **** ******** alcohol the inside of the vehicle was in very bad shape and the windshield is now cracked. Upon repossessing the vehicle it was then revealed that the customer was also driving with out any insurance which is not only illegal but clearly states in contract as grounds for cancelation. At this time we do not feel comfortable reinstating the financial contract and have requested customer to find her own financing with her own lender. We specialize in customers with challenging credit and do our best to help our customers obtain car financing but again due to  payment deliquency, lack of communication, condition of the vehicle, Customers Attitude/ sense of entitlement and lack of accountability on  the situation we are accelerating the payment contract and have given customer payoff total with all repossession fees added, Which is in our legal right and we are definitely in compliance with all financing lawsand regulations and have all legal paperwork signed by customer and ready to be shown to whatever legal route customer decides to pursue. This is definitely the part of the business we do not like and is nothing personal on our behalf we sincerely hopes customer is able to aquire her own financing to redeem her vehicle and wish them best of luck in future

I am not in agreement with this response. I had my car broken down and they knew it. The windshield was going to get fixed next and I can get insurance it didn't have any because I was fixing it. I had just got the car fixed. Why can't they make a redemption payment they want the $3000 when they know I couldn't make the payment because I was fixing it, I talked to **** said he was a private investor and said he took over the contract and Woody had no say in it.

    Regards,

I am filing this claim seeking a refund of the $2,000 that I deposited on a 2013 ****** Prius on Sept. 28th, 2022. Unfortunately, there was a faulty problem with the hybrid battery, and I was led to believe that it would be replaced with a new one. I have text messages and voicemails from **************** and the general manager that are misleading and not true to the intention of the car being sold as is, which was not in fact a sellable vehicle. This car was trying to be sold under false pretexts, and when I had the time to have the car inspected by a licensed dealership, it was found to be faulty.I have asked in-person for a full refund of my deposit and was denied. I would prefer to resolve this dispute outside of small claims court, but I will pursue all legal avenues within my consumer rights. Please help me with this matter in any way that you can. Thank you

************* came and financed a vehicle put ***** down and was due to pay it off on October 5th. He bought the vehicle as is took delivery of the vehicle and then brought back and stated there was a issue with the vehicle and as a courtesy we checked and found the hybrid battery was in fact bad which is very pricey spoke w the owner and manager and we felt it was in good business practice to help the consumer and we purchased a battery for $900 and paid installation w no cost to the *************. Vehicle was returned to ************* and he took to ****** which at that time they looked over the whole vehicle and found small basic wear and tear items as normal on a 9 year old vehicle. ************* then voluntarily returned the vehicle and did not make his payments as his contract stated. We then enforced the contract and terms and the vehicle was processed for voluntary repossession and notice was sent to *************. Here are all the documents to support the facts of this case. It's pretty cut and clear vehicle sold as is and he did not follow through w the contract and make his payments

I am rejecting this response for many reasons; first of all, one, I did NOT finance the vehicle--it was intended to be a cash purchase. For proof of this, I did not ever receive ANY paperwork for financing from any financial institution. Second, I NEVER took the car home. The manager informed me that the car would be cleaned and detailed and that I would pick it up on the 28th or 29th of September. Once again, I never took the car home in complete possession whether it was paid off in full or financed as the vehicle was neither clean nor sound for sell or purchase. Third, it was not a courtesy that the car was checked for viability. When I drove the car before purchasing, ALL the dash lights went on, and the manager informed me that he would have their mechanic check it out and fix the problems (which was actually NEVER done). Fourth, another salesman, ****************, informed me that a NEW battery would be purchased and installed into the vehicle (this never happened either). I was lied to and misled the entire process of this transaction, and THAT is why I never paid the rest of the balance--the car was not ready to be sold as is since it was being sold under false pretenses. Fifth, the vehicle was NEVER returned to me as it was NEVER in my possession. I took the initiative to pick up the car and take it to a ****** authorized dealer before I paid off the remaining balance in order to make sure that it was 100% legitimately sellable. **************** told me at one point that he could not obtain paperwork from an authorized ****** dealer to prove the "new battery" install because it was too expensive, so they would be handling it "with a favor from a friendly mechanic under the table" **************** even bragged to me about how many mechanics he knew in the city who owed him favors. Sixth, when I took the vehicle to an authorized dealer to be inspected, the mechanic laughed at me when I asked if this car was a good buy because he informed me that it was NOT installed with a new battery. Seventh, when I confronted the manager at Cars by Woody, he showed me the invoice for a hybrib battery purchase, and it was a RECYCLED hybrid battery--it was in fact NOT a new battery as I was told that it would be. I would ask that Cars by Woody submit that paperwork to this matter. It would prove my case of this car not being 'sold as is'. Eighth, I NEVER received a notice that the vehicle was processed for voluntary repossession. There is NO email nor a letter sent that proves their claim that they informed me of anything. Again, I ask that Cars by Woody submit the paperwork that shows they informed me of voluntary repossession. I am asking, respectfully, to see the documents they have submitted for this case besides the purchase order that I have already attached. The statement that *************** to from Cars by Woody is outrageous and riddled with lies. It makes me sad as a consumer that I have to fight so hard to have my $2,000 deposit returned with integrity and respect, and it makes me worry about other consumers who do not have my means and knowledge to file this complaint of egregious practice by a local business. If this is pretty clear a "cut and dry" case (according to Cars by Woody's response) IT IS ONE OF CONSUMER DECEIT AND BUSINESS MALPRACTICE.
I would like to follow up with a copy of the text messages and voicemails that Cars by Woody sent me over the course of this dispute. Please advise me where and when I can do this.

    Respectfully,

    *****************************

It is cut and dry end of the day ************* bought a vehicle as is and he states he did not finance a vehicle yet said he decided not to pay the balance bc he was not satisfied so he did legally owe the balance, and he signed a contract with the date showing of when it was due, it is legally a enforceable contract and we are enforcing at this time, as we are in our legal right to so, and now conviently ************* claims he was never given any documents of such. But I will tell you we do and they are all signed by ************* and we will provide them in court so at this time we respectfully state we will not respond anymore as we have provided our response to be in compliance w the BBB and will save all our legal documents for court from this point forward

I am rejecting this response because Cars by Woody has not acted in good faith and tried to sell me a faulty vehicle. I was told lie after lie, for more than two weeks, about a new battery being placed in the car so that it would be in working order. All of the dashboard warning lights were on when I placed a deposit on the car. Even after they had plenty of time to fix it, I was assured that the car would be in working order by the time they told me that I could pick it up. Furthermore, the buyer's contract that I signed was in good faith that the car would be in working order. I was not expecting the car to be perfect as it was used; however, I was not willing to pay the balance on a faulty vehicle and that is the reason why I am asking for my deposit back. Cars by Woody is acting maliciously and is trying to keep my deposit regardless of them not holding up their end of the deal. All of this could have been avoided if they would have just given me back my deposit as the car was not sold "as is;" the vehicle needed thousands of dollars of parts and labor to make it operational. The car was faulty because of the hybrid battery, and they knew all of this. Cars by Woody has not been honest with the BBB, and they have made fraudulent statements to me as the buyer, which should nullify the buyer's contract. Again, I intend to pursue the refund of my $2,000 deposit to the fullest extent of the law.

I appreciate the BBB's help in facilitating this matter, and I look forward to its resolution.

    Respectfully,
