Just prior to closing on my home Sam Yager Inc. instructed my builder to move my fence line 20 feet into my backyard, stating that my lot is not a corner lot. I referred to the lot map I was provided when I signed the contract with the builder and I was told that wasn't the correct lot map and they just happen to have a new one showing the fence line moved. My lot sits on the corner and my lot wraps around the corner towards the adjoining street. I am happy to provide the lot map of the property showing that it is indeed a corner lot. Sam Yager Inc. stated they do not recognize that my home is a corner lot so they are holding my fence to a front fence standard placing it 25 feet from the sidewalk, not the 5 feet it was supposed to be. This eliminated 20 feet wrapping the fence line of useable space in my backyard. The home being built directly behind my rear most corner will have their fence line closer to the sidewalk so our fences won't meet. I submitted several requests to have the fence line moved back and pointed out other corner lots with inconsistent fence lines, some sit 5 feet from the sidewalk, some sit 3 feet from the sidewalk, yet mine sits 25 feet in. I offered to compromise and have the most rear corner of my fence meet the neighbors adjoining fence and then sweep back around the corner meeting the front fence line, that wouldn't get me back the entire 20 additional feet, but would give me some of the space back, to which Sam Yager Inc. has refused. Sam Yager Inc. is making up guidelines as they go and unilaterally enforcing them in an unfair and inequitable manner. I am not being treated equally in regard to these guidelines. Since submitting my request to have the fence moved, Sam Yager Inc has made it increasingly hard for to have any work done. In addition to the fence denial, they also denied my request to install exterior window screens on my windows stating they are not permitted, even though there is no mention of window covering, screens, etc. in the documented guidelines. The only mention of screens or screening is in regard to solar powered gates or fencing and landscaping. We pay over $1000 a year plus yard maintenance to live in this community and all I am getting for my money is discriminated against and denied the ability to make my living space comfortable for my family.
