      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********. ***** ***** ******* was also contacted by Mr ****************** personally which was greatly appreciated. Mr ****************** has kindly offered us a full refund and also further legal help at no cost which we are really grateful for. Normally, that would resolve the issue, however we still have not received the refund that was mailed to us. And when we contacted Ms ***** ******* from the ********** we were told that the check was lost in mail. We also were told that we would receive a refund via credit card dispute that we previously initiated. However no refund was issued still by credit card company either and we were told by the bank that the ********** is in process to recover their money. The issue will be resolved if we receive the refund, but nothing was received yet as of today.
      Regards,

      Constantin Galanitsky

and as we found out later, no paperwork that we sent to the ********** was presented or filed anywhere.Despite repeated attempts to communicate with the office we were met with silence and indifference. As a result of ********** inaction and neglect, has caused significant harm to our legal case. In light of above, we demand the immediate return of the retainer fee in the amount of $2500. Furthermore, we expect a full explanation for the negligence and breach of duty exhibited by the firm in handling our case.

      Business Response

      Date: 03/08/2024

      Dear Sir/Madam:

On ******* 29, 2024, Mrs. ***** ***** ******* hired our office and paid a flat fee of $2,500 for services outlined in a contract that was provided to her in Spanish for her reading, understanding and signature. Those services included an evaluation of the clients case, which due to the distance between detention centers and our offices are conducted by a phone interview. ******************* contract does not state that the client will be visited in person and upon review of the phone call recordings our office in no moment informed her the client would be visited in person. The detention center legal calls are to be scheduled through the detention center and the closest date they were able to offer was February 9, 2024, which was completed. This call was requested on ******* 31, 2024. We did receive paperwork regarding the clients case which was to be provided upon the possibility of clients release to the officers of US Immigration and Customs Enforcement. Additionally, on February 1, 2024, our office sent a request for a Credible Fear Interview entering our representation for that interview as well.  Our client ****** was contacted at the detention center on two occasions. Calls were made between the client and an attorney at our office. After the call with the client, the same attorney contacted ************************** who was a primary contact on his case, to discuss the results of the call with the client. Unfortunately, by the time we were given the call with the client he had already accepted to do the Credible Fear Interview without us, even though one of our attorneys had previously recommended to the client that he did not accept any interview without our representation.

The fact that the client had his interview and he agreed to move forward without our representation is not due to any inaction or neglect on the firms part.  When the attorney spoke to Mr. ********** after the client call, she explained to him we could offer a new service of representation at no extra cost to compensate for not being able to be present at the interview which was the initial service hired for. These interviews are spontaneous and as explained to Mr. ********** by the attorney, it is out of our control when the interviews occur and whether an attorney is available at that time to take the call. There was miscommunication internally to where the additional service was not done unfortunately, which was discovered after an internal investigation was completed. This entitles Mrs. ***** ******* to a complete refund of all services she paid for with our office and has been offered to her, which she accepted. Mrs. ***** ******* and Mr. ********** were in no moment met with silence and indifference, their calls were always answered and when no one was available to speak to them at the time they called, they timely received a call back.

We have spoken to Mrs. ***** ******* regarding this case since receiving this complaint. We have offered her a full refund of all services paid for and have offered to represent her son through a separate service at no cost. She spoke to one of our supervisors and is pending confirmation on whether they will accept the new services at no cost. We are truly sorry this miscommunication between our team caused such disappointment in this clients case. We at Manuel Solis always strive for the best service we can offer our clients and we look forward to having the opportunity to show Mrs. ***** ******* that we can represent her case with excellence.
