      In February of 2022 I started the home buying process. I should have known it was going to be a mess b/c I was lied to from the beginning. I was told I couldn't go under contract for a month, only to wait and month and then be told the purchase price had increased b/c I CHOSE to wait. That doesn't even make sense. Why would I WANT to pay more for something I could get for less? I asked what the change in mortgage would be approximately, and I was told no more than $100. Conveniently, the lender was unavailable to confirm this, and of course I was the pressured to sign before the price increased again. I have reached out to History Maker multiple times, w/ no luck. I even left a ****** review and they asked me to reach out via ******** so they could help. I do not have ********, and had no luck over the phone, so I instead emailed the company directly. Several times I have received the "...We have received your message and will respond as soon as possible." Not once have I received any kind of response.History Maker has displayed a lack of professionalism, honesty, and integrity. They absolutely use predatory lending practices, them and their preferred lender. When I tried to get answers and asked additional clarifying questions I was met with threats to cancel my deal. On multiple occasions this was said, somehow I was accused of cancelling the deal and they wouldn't return my initial investment. Yet I have correspondence from them saying the deal was being cancelled. I was offered to transfer my money to another home/community. Why would that even be an option if nothing was done wrong? Of course, after this offer came up, there was NEVER any follow up. For that alone there should be a refund! I had to rush to find another place to live, just an entire mess.There aren't even enough characters for me to continue to make a full complaint! I've submitted a few supporting documents, and have plenty more!

      Thank you for the opportunity to respond to ************************************ complaint. As a home builder, we take the privilege of building homes very seriously. HistoryMaker Homes conducts business with honesty and integrity. 


      We regret that **************** feels she was treated unfairly.  *************** registered with us on February 10, 2022, and between the time that **************** came in, to the time she contracted, ******************** had significant increases because of the market at the time. At the time our ******************** was on sales allocation due to the high demand of sales, and limited number of homes available. **************** was able to obtain pre-approval based on her applications, but the lender was unable to provide her with a full quote due to not having all the documentation from **************** at that time and closing being a few months out. In June, as closing was approaching and scheduled for July 19th,2022, interest rates escalated by nearly 2 points, and this impacted the financing.  Both HistoryMaker and ********************** made every effort to assist **************** with saving the sale, but even with these efforts, ultimately, the down payment needed could not be secured by *****************  Due to the buyer being unable to obtain the necessary funds for the closing, this placed her in default and therefore the contract was cancelled.  HistoryMaker has documented correspondence between our Sales Agent, and **************** from July 18, 2022, through August 11, 2022,communicating with her regarding the sales process.

      Per our purchase agreement signed by ****************, all deposits are non-refundable for any reason other than seller default.

      HistoryMaker did in good faith,offer to allow her to apply her deposit on a new purchase agreement in the future if her situation changed.

      I am rejecting this response because:

      I dont feel that I was treated unfairly, I know that I was. The issue is not that the ******************** had significant increases because of the market, it was that I was told to wait until March to be able to sign. Then, when I came in in March I was told about the increase. I was also told that I had been notified that for every x number of sales the prices of the townhomes would increase by x amount. This was not true b/c had I been told that I would have signed in February. So much for honesty and integrity here. The sales allocation should have been explained to me from the beginning. As I was shopping, other home builders had explained this, but not History Maker.


      The lender claimed to not have ANY documents, which was not true. If the lender didnt have what was needed, how were they able to tell me that my *** was 57%? What they couldnt tell me is,how was I able to qualify at all with that high of a ***? My God mother, who is a realtor in another state, was very concerned and inquired as well. We were never given an answer. Instead, I was told to buy the home and sell, buy the home and refinance it in a few months, buy the home and rent it or rent a room. If all of that is the case, I clearly didnt really qualify for the home.Even History Makers OWN SALES AGENT said that she would speak with the lender about the ratios stating, that difference makes quite a bit of difference.


      Whats interesting is that History Maker is saying the down payment needed could not be secured. There was no down payment to secure. Magically, the down payment went from $19k to $15k to $4800 to $0 the more questions we asked about the *** and how they approved me.So, to say due to the buyer being unable to obtain the necessary funds for the closing and that this placed [me] in default and therefore the contract was cancelled, is completely false. We still were never told how and/or why the down payment ended up being $0 in just a matter of hours. Looking at my W-2s alone,my God mother and her lenders reviewed the same documents provided the lenders here and advised I should have never even been approved in the first place.


      Adding to their honesty and integrity, my God mother also inquired about buying down the rate and why that option had not been offered. Only THEN was that option presented to me. It still left the payment significantly higher than the range I was initially given.Just as they have documented so have I and have included more screenshots,since before July 18, 2022. My God mother and I even found a local realtor here who reached out to History Maker about what was going on and after speaking with History Maker he advised us to speak with a real estate attorney, which we did.This further confirmed History Maker and their lenders unfair and predatory practices.


      I reiterate, History Maker brought up transferring the investment I had already made to another unit. This is not something that I, or anyone else on my behalf, requested. So, again, why would it be offered if History Maker hadnt done something wrong? Not sure how History Maker did in good faith, offer to allow [me] to apply [my] deposit to purchase agreement, when I NEVER heard from them again regarding the offer. Not only did History Maker not follow up on THEIR OFFER. They, STILL never answered the questions that my God mother and I presented. The ONLY follow up Ive had from History Maker was after posting my ****** complaint and this BBB complaint follow up. They are the ones in default! 

      I have included more screenshots from text messages and emails. Including a few of the times I was told the deal was being cancelled, when it clearly wasn't, they were just using pressure tactics.

      Not only is the business not addressing any of their clearly unfair practices, they are just recycling the same message.

      Additionally, it is a flat out lie that "HistoryMaker did in good faith,offer to allow [me] to apply her deposit on a new purchase agreement in the future if her situation changed." Although the statement was made, there was never any follow up instruction on how that process would even work. So there was no "good faith effort" made at all, just another dishonest statement from the business.

      I'm also rejecting the businesses response b/c they still have not told me how in the world they were not in default? From holding my original checks ("they were lost"), to not allowing me to obtain a realtor that would actually advocate for me in the beginning of the process - when there was no buyer's representation contract signed legally requiring me to keep a realtor that was clearly doing what was best for the business - everything History Maker did during this entire time was unprofessional to say the least. Including, not allowing me to go with the base package that did not require any additional "deposit." Citing, no one wanted that so I HAD to go with the next level up b/c they would not build the base. Only for me to visit during the construction process and find them doing just that. They pressure your with made up policies, like having to  "finance through their lender." Steering, just another example of their predatory practices. Through deceptive practices and a complete lack of transparency, they wanted me to take on a loan that they could never even prove I qualified for. They could never explain how in a matter of hours I went from $19k required down to $0. They could never explain why they didn't proactively offer me a rate buy down, better yet, why they didn't do a rate lock. 

      History Maker and their relationship with their "preferred lender"  is proof that predatory practices continue to disproportionately impact people of color. Their unwillingness to take any accountability is unfortunate. No matter how many receipts I produce it is clear that they have no interest in truly making this right. They wouldn't address my concerns during the process and they aren't offering anything more than a blanket response now. The ****** reviews say it all, "shady, terrible, discriminating."

      We are building a home with History Maker in Providence Village. We showed up to look at our house and noticed the wrong color floors were installed. We immediately reached out to the builder. The builder acknowledged he had learned about it that Friday (but had not contacted **) and he would find out what happened. He later calls my husband to tell him our floor was out of stock and to keep production going, they put whatever floor they had on hand. I understand things happen and colors may be out of stock. However I chose gray tile, with gray cabinets, a grayish backsplash and gray countertops. The floor is a very light tan and does not match anything else in the house. My understanding is that they should have at the least tried to find a similar gray, which I would have been agreeable to. My husband expressed to them that this would not be acceptable and we were told Wednesday someone would call **. Weve yet to hear from anyone. Anytime I express that I need to speak with someone via email my concerned is ignored. Per our contract we are supposed to be notified of the substitution of materials if it adversely affects the value of the home, which it does. It also states they are able to substitute with materials that are SIMILAR in pattern, design, and quality. So its clear they didnt even try to find a similar gray, they just used what was on hand in hopes Id let it go. I have a home where the floors dont match anything and now the resale value will be decreased because the floors will need to be changed out. We are paying a lot of money to have this home built. We should have received a call prior to installing floors that are not what we selected. Instead they are worried about trying to build these homes as fast as possible and not making sure they are done correctly.

      Since I moved in my new home that is a new build I have been submitting request to the builders advising them that Im unable to walk my backyard because of the many holes, I sink in the ground in some areas, & unleveling that have almost caused injury . The builder came out and put clean sand in certain areas of the yard. This did not help the problem but now there were bald spots in the grass, I continue to report the condition of the yard and they told me to give it time that the grass will grow through the sand after it settles. The builder adjusted my water sprinklers but there was still no progress and the issue was not fixed because the holes were still there, ground still unleveled. They told me I could buy topping soil to fill the holes so I did try that but didnt fix it. Season changed and we began to get a lot of rain. The yard would flood in the center and at the patio area. I would have a ponds of water in different areas of the yard. I continued to send pictures and complain to the builder. The water would sit for days in the yard before it would saturate. Anywhere from 1-3 days. We continued to get rain, then snow and the yard continued to flood. They sent someone out to put dirt and sod on an area up against the house because it was so bad the foundation was exposed and they only put 1 square of sod in the center. The yard continue to flood and hold water and I repeatedly sent pictures showing the builder what was happening and they continue to do nothing. I had a foundation company come out to inspect the property outside & they said the yard needed a drainage system. That the water was not flowing away from the ************ is now erosion in the center of the yard & on the side of the home. They said the grass was gone and I would be wasting money to put anymore dirt or replace sod because of the drainage issue. The builder is refusing to make the repairs under the warranty, or provide their reasoning. they are in breach of the warranty.

      HistoryMaker scheduled a representative who conducted an inspection of the homeowners backyard in January 2023.  During this inspection it was noted that there was a low spot at the back porch that was corrected by HistoryMaker but the middle of the yard was fine with no signs of wear or a low spot.

      Upon receipt of an additional warranty request from the homeowner, HistoryMaker conducted another inspection of the backyard.  It was noted during this inspection that there was an isolated area in the middle of the yard that appears to be worn and the grass is missing.  It is the determination by HistoryMaker that the worn area was done so by a family pet.  ** response to the homeowners request, HistoryMaker respectfully declines to address the area of concern as requested by the homeowner.

      My complaints and maintenance request regarding the back yard with complaints of the several holes in 
      the ground, sinking in the ground as if I was walking on quick sand , Yard being unleveled with many 
      humps, hills, etc of the ground began June 9th 2022 in communication to the project manager. He told 
      me that someone would be out to re-roll the sod. That did not happen
      7/13/2022 I put in a warranty request requarding the same complaints of the yard not knowing there 
      was draining issues because we did not have rain and was deemed a level 2 drought during the summer 
      months. 
      Another request on 12/12 which is when we began to finally see rain in the DFW from several months of 
      a stage 2 drought advising HistoryMaker that I had ponds of water in the center of the back yard, along 
      side of the house, and on the fence line. There were several text messages between myself and the 
      historymaker representative *********;
      12/14 sent text with pictures to Historymaker showing what is happening with the standing water and 
      how it is pooling and their response was that he had to help out in the neighborhood on some other 
      properties and if I had irrigation running still and warranty on drainage is 48 hours. Dec 16 I was told 
      someone was coming out to discuss the drainage with me but no one ever showed until first week of ***, 
      I believe *** 6th
      . Historymaker was advised that the landscaper came out and put dirt and sod along the 
      side of the house and only put one square or sod in the center of the yard and nothing else was done. 
      Jan 24 Historymaker was contacted again with time stamped pictures showing how the center of the 
      yard was pooling water and that it was not draining away from the house, I was told it is normal and that 
      every house will have standing water, 
      Again on 2/20/23 is another service request regrading the back yard. Additional complaints sent by 
      text messages directly to the builder telling them that this is not normal, and their response was still 
      saying that it is normal.
      March 3 **** and Historymaker warranty manger came out and looked at my yard and ********** the 
      warranty customer service agent I have been working with again said it was normal, he said I see a little 
      puppy damage, and His boss whom is the person that **** is saying that has declined my warranty 
      request for the yard was with **** in my home and stated it is not puppy damage. March 9th I sent a 
      text message to the builder again with 6 photos of the back yard showing the pooling that has After this 
      visit on march 15th I decided to have a 3rd foundation company to come out and do an inspection of my 
      yard, they sent a report and email advising that there is significant signs of oversaturation which is 
      causing ground erosion, lack of grass growth and pooling water. They also made it clear that it is not n response to HistoryMakers statement.

      company the water has killed the grass and the grass will never grow and that it would be a waste of 
      money and time to put more sand or sod in the center of the yard without the drainage issue resolved. 
      Historymaker has received many pictures over a course of many months showing the condition of the 
      yard as a result They have also been informed of the yard having frogs, snakes, mushrooms growing. 
      All claims in my statement is true and can be supported with photos, video footage, text messages and emails.

      When I first met the builder, they were very friendly and made it seem like it was a massive deal that we were given the opportunity to purchase this home. It was my wife and his first home so we werent very picky about many different things.We were given the absolute lowest quality of every single thing in this home. History maker, homes gave us the cheapest most standard items in every single room that you could possibly imagine. Additionally, we received absolutely no nice amenities no blinds, no gutters, no garage door opener, no concrete, no fans, no window, trim, no lights on the front of the house, etc. Initially we had to come with the grips that we purchased a home for more than what its worth. That was a hard enough pill to swallow.Fast forward a few months in our house, and we started to notice all of the things that were wrong with it. The most significant is that our tile floors were in such horrendous condition that it looks like construction was done right over the top of them, and no care was given to replace them. Fortunately, the *************** have a greed to replace the floor only in certain spots. I told him I wanted in the tire floor replacement, and they declined. The main issue that I have is regarding the drainage in the back yard. My wife and I took plenty of photos during the first rain storm showing that water was accumulating along the fence line on both sides of the house. We called the builder out to look at this, and they took the easy way out to blame the concrete that we installed for ruining the drainage. This is not the case. The concrete has no effect on the area in which the water is accumulating.History maker, homes claims to be a *************** company. As a matter fact, they boast about it on their website. However, their practices are far from it. Instead of making good by the homeowner, they choose profit over making a situation right. Please, if youre reading this stay far far away.

      I paid $7,500 deposit to HistoryMaker Homes for purchase agreement. I used their partner/inhouse lender, after I fill out all the questioner questions and they did check my incomes, working history all that, I've been told I got qualify for the loan. Right before we close the transaction, the lender told me I can't get loan for approval anymore, because I didn't go to work for 2 weeks, and my work contract is over (In fact, I extended my work contract). And never give me deny for approval the loan. ( If they don't provide this letter, of course the company have reason to not give me my deposit back) I asked the sales to return my security deposit, he said he will discuss with company then get back to me. Sales told me cancel the sale in the middle of Nov. While waiting on his respond, I keep on checking with him thru text, he ignored me then texted me back until **** 13th said no refund for my deposit. My concern is, they did verify my situations and told me I got qualify for the loan, then said no I can't get qualify. The lender never told me I can't take a sick leave until transaction is over. They didn't perform their job duty, why can't I receive my deposit back? Again, the lender never provides me my deny letter. I request they send my security deposit back to me.

      Thank you for the opportunity to respond to Ms. ****************** complaint. As a home builder, we take the privilege of building homes very seriously. HistoryMaker Homes conducts business with honesty and integrity. In response to your request for a full refund of ******* monies paid in the amount of $7,500.00.

      The Purchase and Sale Agreement explicitly states that: If buyer is unable to obtain a final loan commitment or if buyer obtains a conditional pre-approval and the buyer fails to complete and consummate the closing in accordance with the terms of such pre-approval and this Contract, the buyer shall be in default hereunder.  Buyer falsely causes the loan application to be disapproved,adversely changes ****** financial status, or relocates ****** employment.

      It is found that the buyer had changes to her work status and did not go to work for two (2) weeks, she adversely changed her financial status and was in default.

      HistoryMaker Homes respectfully declines Ms. ****************** request for the return of ******* monies paid in the amount of $7,500.00 as per the contractual documents.

      When we purchase our home in Augustof 2022, there was a missing screen in second bedroom which is our baby nursery. We filed a warrant a warranty request through their online portal and someone from company reached out a few days later and advised we should be receive a screen installation within a few days. The tech came out 10 days later and the screen they ordered turned out to be incorrect and said he will let the office know and to reorder the correct screen.A month goes by and we did not receive any update so I reached out to HistoryMaker and they hand ****************** contact me. They advised that the screen somehow did not get ordered and they would order it. 2 weeks later tech calls me to advised screen got damaged on the way to install so they will need to reorder again. At this point we are now in November of 2022. Since then we have gotten nothing but excuses and everytime we call they say they need to reorder. It's now January 20th 2023 and we were told today again the same excuse that they need to reorder screen. It's been almost 5 month's and we have no resolution.

      History Maker is building a house (**********************) adjacent to mine in *****************, ******, **. I had several issues with the cleanliness, the workers damaging sod and plants on my side and the debris flying over. I've videos from my security camera showing all the damages. I've reached out to construction managers (******* and ****) in the past and their sales office in the community multiple times but got no response so far till now to solve any of these issues. ******* in particular was very rude over the texts she sent. **** didn't even bother to reply over texts or picking up his phone. I've even asked them multiple times to meet in person. I've contacted them via a warranty request as well to resolve these issues but no updates on that. Today the cleaner used a pressure washer to remove the dirt from the driveway and in that process pushed all that towards my side without even picking it up. I called up the local sales office at the same time but have been told to wait for a call from one of the construction managers. And in case I don't get any, have been asked to call again tomorrow. I'm now quite exhausted with this and would like to have this escalated to the top management and have the issues fixed.

      Complaint: New home I purchased on 5/10/2021. During the pre-inspection process, I mentioned that the flooring looked uneven and wanted to have that fixed. A few days later, the representative said she had contacted the flooring company and was told nothing could be done, and that it would not be noticeable when we moved furniture in. Since then, it has gotten worse - and it is very noticeable and unsightly. We had a different flooring expert look at it who said it was definitely due to poor workmanship, and could and should be repaired before getting even worse. I put in a warranty claim prior to the year being up, but still the floor is not repaired, and History Maker Homes has been extremely slow to act on it. There are other issues with this home that I filed claims and made complaints about, but they remain unresolved. One is the air conditioning on the second floor. It is highly ineffective, and the room up there typically gets up into the 80+ degree range. This happens even in moderate weather, and with the ** unit running constantly. (Which causes the first floor to be extremely cold at 70 or below, while second floor may get down to 78 degrees). During the hot summer months this was even more profound and this room was often as hot as 90 degrees with the ** running. History Maker did have the HV** company come out and install a sensor in the upstairs room, and that is what caused the ** to run all day to try and even out the temps, but it is very ineffective. The ** is just very ineffective into this area of the home, it makes very minimal improvement to the temperature. It is a major pain point about this home, and the only thing the sensor really does is cause extremely high electricity bills. (The HV** representative told me he had worked on the same floorplan in other homes and that it was a known issue).The back yard is extremely uneven, water will pool for days after it rains, but was told they will not fix that, but it is bad.

      History Maker Homes **************** Representative has met with the homeowner. The flooring concern has been sent to a 3rd party inspection group. The **** system has been inspected and adjustments were performed. Some depressions in the yard can occur.

      We closed on our home with History Maker in June 2020. We immediately began experiencing issues with our home. In fact, i submitted my first warranty request the very next day. I repeatedly submitted warranty requests online that were closed by History Maker Homes without completion of the requests. Our one year inspection report and the warranty items noted in the report supplied to HMH were not completed. Our community has had 3 different **************** Reps in two years. I am still trying to get HMH to complete warranty items that were submitted prior to the warranty expiration and have even supplied screenshots of my communications with the **************** Reps to the **************** Manager. I have asked for a printout of all submitted warranty items and previously asked two of the **************** Reps to sit with me to determine which requests were closed in error. HMH should honor the warranty and complete all requests submitted before the warranty deadline. Homeowners should not be penalized for employee turnover. I have emailed the **************** Manager, provided screen shots of communications with his CSRs and offered additional proof my requests were submitted & received but not completed. Ive even offered additional documentation. My requests have gone unanswered.

      My wife and I were not allowed to have a final walk through before closing on our house because we were told they would be working in it all morning and after closing went to the house to find a long list of items incomplete with the house that we were told we now had to live with until they could get around to it. The are endless quality issues and the response we have been given is that's how it is supposed to be or this is how we do it.After living in the house for 2 months most of the items have still not been corrected.Doors broken, door seals turn off before move in, the floor creaks throughout the upstairs, the entire tile floor is not level from tile to tile, concrete driveway was poored poorly and has already multiple issues and that is just a few of the items. Instead of removing paint from master bedroom carpet it was cut out with a razor blade and there are holes now down to the base of the carpet.

      I am rejecting this response because:while we are in the process of correcting the issues the issues have not all been resolved. Furthermore no one at History Homemakers has reached out to me to discuss why we were not granted a final walk through on our home which is a breach of contract. Someone needs to be finding a way to make this right.

      Once the house has been fully repaired and History Homemakers discuss why this happened and how they are going to make it right I will then consider closing the case.
