I have been having an issue with my child attorney he is very disrespectful he stated I have nothing to do with my child case and he will choose to settle for what he think is best for my child even after I told him I think the settlement amount is unfair and not in the best interests for my child. If I have nothing really to do with my child case then I will not sign any paperwork I been reaching out to the manager leaving messages and no one returns your call at all.

Auto accident happened 10/22/20 in *************, **. My orig atty was ********************* (now out of business) and I got passed off to *************************************** PLLC. Ben ******************** firm files my civil case (Cause No. ************ in *************, **) against driver who caused accident on or about Nov 16, 2021. Case drags on and on and on. Feb. 9, 2024 I was informed case settled by Ben ******************** firm *******************. I was told by phone it would be 4 to 6 weeks to get the money. Feb 21, 2024 Ben ******************** firm informs court that case is settled. Mar 8, 2024 Ben ******************** firm's atty informed me they are waiting for my insurance company (Geico, under MY auto insurance medical) to cover more of my medical bills. Apr 29, 2024 I e-mail Ben ******************** firm's atty telling them to wrap the case up and give me an accounting of the funds and request to know when my check will be ready plus I send proof Geico paid them on 4/18/24 another $3,339.56 towards my medical costs). Crickets. I get no response from Ben ******************** and ******************. No accounting of funds. No check. No more returned e-mails nor do they return my phone calls. **************************** ********************** DISGUSTS ME. I want an immediate accounting of funds and to know when my check is ready. NO MORE DELAYS. I also want other people inquiring if there are complaints about Ben ******************** & ****************** to maybe think twice before retaining them for legal services.

I filed my BBB complaint on Friday, 5/10/24.  Ben ******************** & Assoc. mailed me correspondence dated 5/9/24 that I received Saturday, 5/11.  ***************** firm finally sent me a Settlement Memorandum (3 months after they said the case was settled) and I had questions which they answered (they didn't make it clear, to me, on the Settlement Memorandum what some charges were for).  One sore subject seems to be I don't think the firm is entitled to charge me (from MY portion of the settlement) 40% of what my medical bills were since I had a PIP policy on my auto insurance that would cover medical bills up to $10k.  I paid for my auto policy.  I got the coverage myself.  Whether or not there was a lawsuit makes no difference.  Those medical expenses were going to be paid for.  Period.  The law firm had nothing to do with it.  So now they think they are entitled to take from my portion of the settlement 40% of my medical expenses that were paid by my insurance company.  So they want 40% of $8,208.12 medical expenses, or, $3,283.248 from MY PORTION of the settlement. That is on top of the 40% they get from the entire settlement which came about because of the lawsuit.  The law firm did not "recover" that...it was due me without them.  Contract verbiage:  "Client retains the law firm of ********************* Injury Lawyers to represent Client in a claim for personal injury arising from the above occurrence.  In return for advice and representation, Client now assigns Attorney thirty-three and one third percent (33-1/3%) of all amounts recovered in this case, 40% if a lawsuit is filed."  And they won't budge.  I want people to be aware of this type of shady dealings coming from the Ben ******************** & Associates law firm.  They did not "recover" my insurance company paying my medical bills per the policy I paid for.  I contend they are not entitled to this extra charge.  They want an extra 40% on $8,208.12 out of my portion they ALREADY GOT 40% of.  Looks to me to be double-dipping!  How can this be legal?  How can this be permitted?

I sent a copy of my BBB complaint to the Managing Partner of the *** Abbott & Assoc firm (certified/return receipt requested) in preparation to escalate the complaint with the proper legal authorities that deals with problems with attorneys in ******  I received an e-mail from *** ***** firm that they would be waiving their claim to 40% of what my insurance paid for my medical bills (that would have come out of my 60%, after they had already taken their 40%). They refigured my portion (60%/40%) of auto insurance company settlement payments and sent me a document to e-sign to finalize the settlement.  I signed it on May 16, 2024.  I had to keep after them to find out when they would be sending me a check.  They refused to ***** it.  They wouldn't send it Priority with tracking.  They would only send it **** overnight mail at a cost of up to $70 (taken from my portion) or they would just drop it in the mail, regular postage, which they did. I work in ******.  Their office is in Garland.  I received the check in the mail on June 5.  I WOULD HIGHLY RECOMMEND THIS NOT BE THE FIRST CHOICE FOR SOMEONE WHO HAS BEEN INJURED IN AN ACCIDENT AND IS LOOKING FOR LEGAL REPRESENTATION.  During the time they "represented" me, I was passed around between lawyers and the next one would say they never got the documents I provided to the previous lawyer, etc., etc., etc.  One of the lawyers along the way suggested I settle for $5,000 which was absurd.  My dealings with *** Abbott & Assoc has been nothing other than pure frustration.  My personal opinion is that they are too big to care. Too big to adequately take care of clients (unless, I suppose, if one was going to give them a huge monetory win--my settlement was very modest since hardly anybody has enough insurance coverage to adequately take care of the physical damage they cause others in an accident).  My accident was in October/2020.  Settlement check received FOUR months after case was "settled",received June/2024.  *** Abbott & Assoc certainly didn't seem to stay on top of anything to get the case settled in a timely manner.  SOMY BUSINESS WITH *** ABBOTT &ASSOCIATES HAS CONCLUDED.

This complaint WAS settled to my satisfaction.  *** ***** & Assoc firm agreed to NOT take an additional 40% out of MY 60% portion of the settlement, originally wanting to take an additional 40% from my 60% left in regard to the amount my insurance company paid for my medical bills.  I pointed out that my insurance company was paying my medical bills regardless, and the *** Abbott firm had absolutely nothing to do with that so they had no claim on those funds (or a portion of those funds).  The agreement was they get 40%, I get 60% of the settlement.  My personal/private insurance paying my medical bills didn't enter into that equation.  They finally agreed.
