I went to auto dealer 1 to finance a ****** Pathfinder for $9,500. I put half the money down on Saturday evening before closing time on Memorial Day weekend. Sunday morning when I went to start the car there was a lot of smoking coming out the tail pipe. I took it to 2 very reliable mechanic and they both told me to take it back because the motor is bad. Everytime I start it the car smoked bad. I recorded to show the salesman. I took it back the first day I could which was Tuesday morning. The salesman told me he just got that car and they guy he go it from said it was fine. I told him I didn't want it. He said I couldn't get my money back because it no warranty. He gave me a van to drive while he got it checked because I was already coming back because he was going to get the oil changed for me so I let him take it to the shop to check everything. I drove the van for 1 day and I called and ask him about the car on Wednesday morning...he said the mechanic said the car was fine and it just needed a oil change. I felt like he wasn't telling the truth so I went to talk to the mechanic myself without him knowing. The mechanic told me soon as I got there that the motor need to be replaced but the car salesman told him just change the oil only. So I was upset I went to the car lot and demanded my money back and he said he don't do refund until I told him I talk to the mechanic myself. He then gave me $4100 back and kept $400 for no reason. He said it was because the mileage but I provided a video to him so he can see the mileage was different before I even drove the car but he didn't care he knew I was right but he really just wanted to keep some of the money. The mileage on the sticker said ******* but when I went to just look at it it was way pass that. He knew he had no reason to keep my money but he just said it was a fee and he can charge even tho it's not in the paperwork nowhere. I have pictures and videos I will screenshot the video of the smoke.Business response

She came in Saturday and test-drove the car; it was to her liking and so she decided to buy it. She took it home and after around 4 days, she came back on Tuesday, claiming the car was smoking. Even though we sold it as-is, I gave her another car to drive while I took hers to a mechanic. Though on Thursday she said she wanted her money back and didn't want to wait for the repairs. I agreed to pay her as her husband explained that they had 2 children and a difficult financial situation at home, so in the end, I gave them 200$ cash and 4100$ in check just to help them out.
