    I am writing to formally address a dispute that began on December 17, 2024, regarding maintenance issues related to the plumbing and sinks in the office. On Tuesday, December 18, 2024, I was informed that if I did not pay the full amount of $721.86 for the replacement of the plumbing and bathroom sink by the end of the day or agree to a three-month payment plan, I would be locked out of my business. Please note that I am current on my rent payments and have never been late. The dispute at hand pertains to the question of responsibility for the worn-out plumbing, which I believe requires further clarification. Also note that before signing my lease in January 2024, I asked them to check and fix things in the office; one of those things being the sinks in the office, that I am now being asked to pay $721.86 ( worn out plumbing) with no notice. Also note the things I asked to be fixed in the office, have not been. One of those things being a room full of wires on the wall that are visible and not useable in my practice due to the so many of them hanging off the wall. Additionally, I must express concern over the unprofessional behavior I have been subjected to. I have been threatened with the possibility of being locked out, and I have experienced harassment, false accusations, and an uncomfortable work environment (their office is right next to mine.) The constant yelling and cursing from next door, which is audible through the walls,has been disruptive and has led to complaints from my patients and clients. I have asked to set down with the business owner multiple times to have a meeting, with no response, only response is from his office manager who has been nothing but unprofessional and hostile.

    Good day-
    I have attached the original commercial lease and the commercial lease amendment extending the lease dates with increased rent rate.
    Please review page 8 paragraph 15:C showing the responsibility of the Tenant for maintenance repairs. During tenancy they are responsible for any and all items checked under "Tenant". Mr. ***** is responsible for the *** Mechanical invoice in the amount of $721.86 as a result of his submission of a maintenance request on 12/4/2024. (WO#*****-1) see attached.
    Mr. ***** was aware that if he sent us a request, he would be responsible. It is outlined in his lease AND he had a repair due on 5/4/2021 for bulbs changed and HVAC filter changes which we waived one time only. It was explained, by Mr. ********************** at that time that he was responsible for all maintenance outlined in the lease contract. (WO#*****-1) See attached. If Mr. ***** had the choice to hire his own plumber and make repairs on their own, he chose to send the request to us. 
    Next, please review the amendment/extension there are no repairs, or outlined upgrades listed as a stipulation to this contract. If items were discussed and were in negotiation for an extension, it was not agreed upon or promised if not outlined in the contract.
    Any payments made may be used for past due balances for repairs first, which makes rent late, late fees will apply and if not paid, lock out procedures may be used to collect balances per the lease.
    For the term of the lease, Mr. ***** ignores emails by myself,the office manager and always requests to speak to Mr. ********************** because he knows I enforce the lease as that is my job. He asks for meetings after hours with Mr.********************** when I am not present so he can try to talk his way out of his financial obligations. To be fair Mr. ***** tactics has worked for him in the past and I can see why he attempts it continually. Mr. ***** refuses to acknowledge his responsibilities per the lease contract and skirted his financial obligations repeatedly. Mr. ********************** has been more than generous with Mr. ***** and is not willing to waive this balance due.
    The balance of $721.86 is due, will not be waived and I am not willing to apologize nor is Mr. **********************. Mr. ***** should apologize for an unwarranted report to the BBB, wasting our time, not fulfilling his lease, and being a difficult tenant. You would think business owners would be professional and handle the responsibilities of the lease contract without constant hand holding.
