I purchased my Mini in December, ***** was the sales manager.I brought my Mini to *** NW ******** after I was involved in a near accident that required use of the horn, only to discover it did not work. An ASE Certified Technician working for *** NW ******** serviced the Mini on January 20, 2023. *** has owned Mini since **** and thus they have plenty of experience servicing Minis. The ASE Certified Technician's initial inspection showed that both horns were completely missing as their connectors were dangling loose and that this was a serious safety concern. After conversation with the *** Service Technician, it was explained that it would be highly unlikely for any mechanic to have not seen these horns missing. Upon further inspection, other items were discovered to be problematic, in need of repair, and very likely existed when I bought the mini from Vdubs Only in December (the location at ****************************************************). The following items were found to be faulty.1. O2 Sensor 2. Engine Mount 3. Alternator I asked the Service Manager at *** NW ******** why the Engine Light did not immediately come on after purchasing the vehicle from Vdubs Only. It was explained to me that check engine codes can be cleared, or wiped out, and can come back on after some time has passed. An additional observation brought to my attention was that this Mini had several panels repainted, and harnesses not put together properly, which may have indicated it was in some sort of accident. Vdubs claimed this car had not been in an accident. The total invoice for repairs was $4,724.51. Upon hand delivering a notarized sworn affidavit of the facts encountered to Vdubs Only, a reasonable middle ground amount of $3,862.00 was requested and a response needed within 5 days. Now that 4 weeks have passed, it is clear the owner has decided to not respond and hope I go away. I'm seeking the amount of the repairs to now resolve this issue, lest a small claims court decide this outcome.Business Response

We notified you on what we were willing to do. You chose not to bring the car to our location an let our certified techs take care of the issues. I'm sorry you got way over charged by ****Customer Answer

What VdubsOnly was willing to do was unacceptable and considered dangerous.
1. VdubsOnly wanted the car driven from ******, ******** to *****, ***** (337 miles) without a working horn, a bad O2 Sensor, a cracked Engine Mount and a bad alternator. As mentioned in the initial filing, I was nearly run over by a truck not seeing me and turning into my lane and that is when I so desperately needed a horn.
2. VdubsOnly's offer, since it was not shared in their response, was that they estimated it would cost them $3,000, AND that I would have to pay $1,500 of that amount.
Most people who have jobs cannot take off several days of work to drive an unsafe vehicle not to mention TRUST a "certified" mechanic didn't even recognize a missing horn, had a faulty O2 Sensor, a cracked Engine Mount and a bad alternator
As was stated in the initial complaint, a hand delivered option was then presented to VdubsOnly, rejecting their offer, and they chose to ignore it hoping this will go away.Business Response

When you called us with the issue, we offered to pay to have the car towed back to us. We presented you with an estimate and it would only cost you $1500 to have everything fixed. The *** dealer charged you wayyyy more than that and they did work that was "recommended", not vital. YOU then CHOSE to have them do the work even after we were willing to help. That was a choice YOU made. It's all documented in the 4 recorded phone calls we have. Again, i'm sorry YOU chose to leave the car at the dealer and be over charged.Customer Answer

There was never an offer made to have the car shipped to Vdubs Only.
On January 25th two conversations were with *****. The only mention of repair was to "bring it here and they would pay for the horn and they'd help out with the other stuff", and in the second conversation I was told it would cost them $3,000 to do all the repairs, and that Vdubs Only would charge me $1,500, and that *** NW ******** would charge me $5,200 (which was not true). AGAIN, NO MENTION OF THEM ARRANGING FOR SHIPPING THE VEHICLE.
And as previously documented and presented to Vdubs Only, an ASE Certified Mechanic found needed repairs to the car and without them would have made driving the car a safety risk. Any conversation from Vdubs Only would certainly have included how they would have arranged for a rental while I would be without the vehicle as well as when/how they planned to get the car back to me (please tell me they would not have expected me to take a day off from work and drive a 1-way rental car from ********** to *****, ** to pick up my vehicle).
Please upload the conversation where this offer to have the vehicle shipped was made along with the date and time this call was placed. Be aware, I have record of any/all voicemails, conversations and emails. I also have access to my phone records for all incoming and outgoing call on my Tmobile account.
Why my original offer to settle this for $3,862 was more than fair is as follows: As you claim it would have cost you $3,000 for the same repairs that cost me $4,724. The cost incurred by Vdubs Only to ship a car round trip (700 miles) along with a rental car I would have needed would have added at least $1,300 or more making the cost for Vdubs Only in the range of $4,300.
It is also interesting that Vdubs Only has not addressed the additional complaint that shows this car had been in an accident. As previously documented, this car was presented as never having been in an accident.Customer Answer

There was no response from Vdubs Only in over a week, and it appears these complaints get closed out after some back-and-forth. If not, happy to keep this back-and-forth going, as we are awaiting their recordings they said they have. Because Vdubs Only cannot prove the offer they said they made, we will wait 3 days following this submission to share this audio offer. If not, we will allow them to provide that evidence in small claims court. Unfortunately for them, I actually have the phone history from ******** and the actual recordings of two conversations where they are proven to have never made that offer. If they would like, and it would help them see my why, I will provide that audio conversation in a .zip file.
Also, as of today, we also filed a formal complaint with NBC5 Responds.

As we have said from the beginning, we are sorry this is taking so long. Myself and my title clerk have talked to you on the phone and in messages no less than 14 times. All along the way we have clearly explained the situation with the process of getting the title. We have explained what the hold up is with Colorado DMV. This morning you sent a threatening message that your bank is going to file a complaint with the BBB. I have attached a copy of the conversation. I quote what you said "THEY are filing a complaint with the BBB". I have also attached copies of some of the phone logs showing when we have talked on the phone, along with the lenders from Colorado DMW and ALLY Financial, both which you were provided copies of. You have harrased me late evenings after hours and on weekends and I have taken your calls and after today I politely asked you to stop harrassing me again. We have assured you that it is being handled and even provided you with the phone number of the Colorado DMW to check progress. I also informed you that if your bank wrote slander about us online, there would be legal repercussions. We had NO BUSINESS DEALINGS WITH YOUR BANK. YOU BOUGHT THE CAR CASH.

(The consumer indicated he/she DID NOT accept the response from the business.)
I wonder what a cash deal has anything todo with your poor customer service. My bank hasnt done anything, i just want my title to the vehicle i bought in april.
the TX Dmv states i should have had the title 40 days after i purchased the car. that is the law.
i have been the most reasonable customer you could have had when it comes to buying a car and not being able to use it for over 6 months. so i try to light a fire under you to make you move faster and you start with talk to my attorney and threaten me if there is a negative review. it is my right to write a review about how Horrible this transaction has been so i will be doing so and including your text saying you will sue me if i do.
Nothing you say or the 3 times you and i talked on the phone justifies the fact it has been over 6 months and i dont have a title. meaning you should have better customer service and had you said "hey you know what ****** i understand this is crazy and my company dropped the ball as we didnt do anything till august" i would have said you know what i get it things happen.
instead you threaten me, so yes i will write a review based on facts, i bought a car in april and have not gotten the title i had 3 peaceful phone calls with *****, but once i tried to pressure you you blow up pic included.
all i want is my title, i get your working on it but it NEVER takes 6 months for this to happen. so now the ball is back in your court im interested in how you can remedy the lose of use for this car and end with a happy understanding customer.
Business Response /* (4000, 9, 2022/10/25) */
We provided you with all the FEDEX tracking numbers and have made you aware of the situation just as soon as we have been. We are getting the title.
Consumer Response /* (4200, 12, 2022/10/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
i was given Zero contact till the end of august. at that point you already broke the LAW. Texas Law states 40days. zero excuses and then your childish antics to go write a review on my business when i havent even wrote one.
you sir shouldnt be in business.
where is the title.
Business Response /* (4000, 14, 2022/10/27) */
Apologize for the inconvenience. Again we have communicated with you about the entire process each step of the way.
