On, June 29 2022 I signed a contract for solar panels. The solar panels were installed in October 2022. They were not activated until May 24, 2023 (almost 11 months later). Payments started in January. I was reimbursed for those payments. However, they were lower payments (interest only) which meant paying around $1,000 more total over the life of the loan. Since I was not benefiting from solar until May, I lost 6 of the 18 months of lower payments/electric bills. There are a couple larger issues though. My contract included a $2,500 rebate to be paid by CPS. I did not receive that rebate, because someone at American Solar forged my wife's signature on a form forfeiting it. We had never seen that form until I inquired with CPS around when I could expect the refund. I brought up this issue with both my sales person (Ra Ra) and someone else at American Sun (*****) and sent them a copy of the form. The first time I was given excuses. The second time, it was blamed on the sales person and I was told the contract gives them permission to sign forms on my behalf whenever necessary. How is it necessary to forfeit a refund? I asked. They advised they would escalate to upper management. I never heard back. My wife's name wasn't even on the contract, which makes forging her signature even worse. The next issue is when the solar panels were sold to me, I was told I would have access on my phone to monitor their performance. On 11/5/22 I received a contract form Ominidian a monitoring company for five years of monitoring service paid for by American Sun. Three weeks after solar was installed, I called American Sun to inquire about when this would be activated. They said they would have a technician come out to get it set up. On 6/29 I got an email from ******** advising they terminated their contract with American Sun, as a result of American Sun Solar's inability to honor the terms of their contract with ********. They previously advised me American Sun hadn't provided the necessary paperwork and info to activate. Sounds very similar to all the delays I experienced with them getting what they needed to CPS to get solar panels installed and why this whole nightmare of a process took 5 days short of a year. I believe at minimum American Sun owes me $2,500 and monitoring service. At best, they should also pay the difference between my interest only payment and the full payments for six months.Customer Answer

Appreciate the follow-up. I have not heard anything either. However, a subcontractor they had do about $1500 of install work on my solar contacted me and advised that American Sun has not paid them for 5 or 6 jobs including mine and they are considering putting a lien on my property as leverage against the solar company. I entered into a contract with American Sun Solar in June 2022. The solar panels were installed on August 25, 2022. Electricians, inspectors, etc. have done their work. The last part, installing the meter, has not been completed. I got a loan with Goodleap. Payments started being made on November 2022 via autopay. Since that time, American Sun Solar has reimbursed me for every month except July (thus far). I contacted them for the July reimbursement but they have not responded to texts. I called and it goes directly to voicemail and the mailbox is full. I was able to talk to my context person - but she doesn't know who is working in that office and they do not respond to her messages. I called Goodleap to ask if they could stop payments until the system is complete - if possible. They are working with me to try to reach a solution.Business Response

I have tried multiple times to contact someone from American Sun Solar for my July reimbursement. I left a message 2 days ago. I called again yesterday and it went to voicemail and said the mailbox was full. The technician called that he would be here yesterday (July 19, 2023) to install the meter. When he hasn't shown up by 4:30, I texted to ask if he was coming. His response is in the attachment.

The company completed installation on the solar panels and wiring on August 25, 2023. I changed my electricity plan to Solar buy back. However, I received an electric bill for the last month. I called the electric company and learned that the interconnection agreement between the installer and AEP was not completed. Texas Solar Broker LLC is the company in charge of installation. I will file a separate complaint with this company's information. I will also contact Goodleap, the lender, to keep them appraised of this situation.Initial Complaint

11/4/22-contract w/American Sun Signed 11/2/22 Loan w/Goodleap signed Total Cost $62160 for standard installation and connection of Solar ****************** installed the panels then when utility came to inspect, it failed inspection, company came to correct and now have not heard back from the company. *************** states the solar panel company has not requested new inspection. They have not been returning any phone calls or messages. We are now left paying the loan for panels and our monthly utility bill and the solar panels are not connected. I am requesting that our project be completed as stated in the contract signed. Multiple messages have been left via voicemails and secretary who answers phone as well as text messages and ****** review. I bought solar panels two years ago from this company and they have never worked. The city has red tagged my solar panels and the company still wont repair them. I have paid 49k for these panels and they will not help me. I am paying for panels and paying my electric bill and its not fair. I spoke with *********************** and he said if I didnt go the legal route he would fix the panels for me. I have been fighting with them for two years and they have done nothing. Solar panels installed on our house and caused leaking to our second-floor living room and bedroom and bathroom. They have repeatedly ignored our request to have it fixed. We now have water damage throughout the house causing one of our closets to collapse in from the top. It is still actively leaking even though they set someone and saw the problem. They still have not fixed it. They have scheduled someone to be in our home several times and have not shown up even though we have taken personal time off work and wasted a day spending waiting for them for them only to no-show completely disappointed spent $38,000 on a solar panels that are not working properly. Solar panels were installed we have leaky roof and pics to show it was caused by the installation they are refusing to come and fix the issue and we have our insurance report that proves its from the installation. They called and asked me to remove the bbb complaint and promised to fix leak and still havent the panel need to be removed for roof to be fixed. Panels also not working properly Cannot access the application and cant connect to the electrical panel box. The company has told us repeatedly they will fix the issue and we are still having the same leak not repaired and lied to. we had solar panels installed on our home and we were charged $38,000. We have had problems ever since which include: leaking to out roof (which was brand new prior to solar panel installation.), the panels have stopped working and our electricity bill is over $250 monthly and we are still paying for the panel $187 that is double what our bill was prior to solar panels. There is an app that the company never told us about to try and see your panel usage and watch the entire system and now that we were finally informed about the app We cannot connect to it as the solar panels are not connected properly I have spoken to a few different people from ***************************** who calls and complains I am costing him deals and demands we remove our complaints I have also spoken to ***** and Texas solar warrior and Texas solar broker which by the way never answer the phone and its almost impossible to get a response from them. this entire process has caused damage to a bedroom and the closet in that bedroom and smells terrible to the point we cannot use that room in our home.Initial Complaint

I paid to have a generator installed. American Sun Solar was in charge of procuring and installing the generator. The generator was dropped in my driveway around December 2021. Then the company started the installation many months later around mid 2022 (they attributed this delay to needing *************** inspection for solar however with poor communication overall and disregard in part of ***************************** and American Sun Solar. In late 2022 the generator was still not running. Finally in December 2022 they finished the installation with gas lines. Since then however the generator has not been working and *************** has not ** or yes it *********** give us the runaround and keep saying that they will come fix it and then give us silence for two weeks at a time. When we placed honest reviews about our experience the owner of the company asks us to take the reviews down (then they removed them). Bottom line is this company installed a generator a few months back and it is 2/27/23 and it is still not working with ongoing issues as of February 2023.Business Response

Solar panels were installed in the fall of 2021. I have been back and forth for 2 years with Texas Solar Brokers/American Sun Solar, Obsidian Solar (with last contact with the company regarding this issue with an on October 27th, 2023) to try to get the solar panels permitted and they are not offering a way to do this that is satisfactory. I am basically still being ignored after years of continuously asking for this. I finally contacted *************** and pulled all the permit history given the run arounds and today 10/30/2023 I found out that Texas Solar Brokers/American Sun Solar, Obsidian Solar never received permit approval and that two permits one from 2021 and one from 2023 had drawings that were never approved. I have attached the contract, the email from *************** and also communication about permits from 2021. Im waiting from resolution from the company to obtain solar permits with *************** as well as permits for a generator they installed in 2022. Additionally, per *************** permit applications there are either 55 or 56 solar panels on my roof, but the contract says 59 panels were to be installed. Sales agents for ******************, LLC took advantage of my elderly mother and lied to her, falsely claiming that their company would be able to provide her savings from the high light bills. Turns out that this company has already been confirmed to be involved in many scams targeting the elderly. To make matters worse, this company did not provide any paper work and forced ******************* to sign electronically. There are four things I want to point out here.
#1:
******************* was not approved for a loan, she attempted to get approved twice and was denied.
**************************** are the individuals on the loan. One of them has to be on the deed for the loan to have gotten processed.
#2:
The loan company REQUIRED EXTENSIVE Documentation AND TWO RECORDED WELCOME CALLS to proceed forward with the loan!
Documentation Required was the following:
- Mortgage Statement or deed
- ACH Information for Auto Draft
- Docusign Contract sent to their personal e-mails and SIGNED by BOTH ****************************
THIS NOT elderly fraud.
Point #3:
There is a entirely BRAND NEW ROOF rolled into the loan!
Typically savings is seen when it is a SOLAR ONLY deal, when you roll in an entire new roof, that is obviously a significant amount of money, in this case an additional $13,198 for the roof. (Please see contract)

My cell phone number has been listed on the National Do Not Call Registry since September 5, 2005. Furthermore, my cell phone number has been listed on the Texas No Call list since February 23, 2022. American Sun Solar failed to follow the Telephone Consumer Protection Act (TCPA) and the Texas No Call by calling my cell phone number today, 1/4/2023, at 1:08pm. I answered the phone and noticed that the caller ID information was blocked and the number ************. After a bloop sound there was a pre-recorded message about solar from Jason. The pre-recorded message used artifical intellegence to make it appear that it was a real person.
There were multiple violations that occurred on today's phone call. Since the call was made by American Sun Solar using a pre-recorded message and without prior express consent by me, then by law this is actionable with a private right of action for me to recover $500 in damages for each violation from American Sun Solar. Furthermore, American Sun Solar acted willfully by calling a number on the DNC Registry which increases the damages to $1,500 per violation. Because a pre-recorded message was used then this call is automatically actionable for both 227(b) - use of artificial or pre-recorded messages and also for 227(c) - placing a call to a number on the DNC Registry. Per these 2 violations the actionable damages that I can recover is 2 x $500 x (3 for willfuly action) = $3,000.
I am willing to let American Sun Solar can resolve these violations by paying me $2,000, provide me a copy of American Sun Solar's DNC Policy & Procedures manual, promiss to put my cell phone number on their internal DNC list, and to never call me again. The expectation is for American Sun Solar to resolve these violations immediately.

Thank you for continuing to research my complaint.
I attached the requested screenshot below. I receive "spoofed calls" frequently just like everyone else. In this case the call I received started off with a pre-recorded message using artificial intelligence. The message was about solar and then I was transferred to a guy with American Sun Solar. The guy did not provide his name, but he did say that he was with American Sun Solar located in Dallas, Texas. I registered my phone number on September 5th, 2005, as shown below. Since the call that was placed to me used a pre-recorded message, then it violated the TCPA 47 U.S.C. §227(b) and it was wilful because the American Sun Solar did not scrub my phone number from the Do Not Call list. This constitutes a willful action thus increasing the private right of action from $500 per violation to $1,500 per violation. I also attached a PDF of my demand letter that I emailed to **************************** (invalid email that bounced back not found). That email address was taken directly from the American Sun Solar LLC website. I researched the website and there are no other emails provided, however I was able to identify Christopher * **** - Managing Member and Michael ******* - Managing Partner without any email addresses. I find it frustrating that a company does not provide a valid means to contact them when situations like this happen. I have gone above and beyond to help them out by trying to notify them so that they can resolve the matter and not do it anymore.
