Purchased a vehicle from the business and I stated that there was an issue with the airbag light and they stated they would fix it but for a charge. Then they proceeded to have the car inspected and it should not have passed inspection with that light on.

I was sold an audi Q5 with a never ending list of engine problems. Owner stated that motor was rebuilt out of state. Stated there aren't issues with the car. With in 1h of leaving the lot engine codes poped up. From chain almost skipping time to turbo leaking and under boosting.... also drinking oil. 3 oil changes in 400 miles... did not wanna adjust the price of sale... was aggressive with his tone speaking over you the entire time. He took the car in... Chain fixed under wrong tension... turbo was from junk yard and worked like the old one... and catalytic converter was cata cleaned.... not replaced or worked on... still shouldn't be able to pass state inspection. But this man got it to pass anyways... if that doesn't concern you I don't know what will. And to this moment he is pushing for as is.... on the purchase. I have my own receipts from other mechanic looking at the car. I'm over 800$ out of poket already and it's my 2nd tank of gas in 2 months.

We appreciate your effort in this matter. We prioritize customer satisfaction in our business. We have tried on our part to resolve this issue by making repairs as requested and agreed by the customer. We fix the problem customer complaint about and after the work was done we invited the customer to test drive before taking the car home. During the repair process, customer was duly updated with pictures and videos of effort made to repair the vehicle. As a courtesy and due respect to the customer we offered to help in our best capability. The vehicle is 'sold as is' and no dealer warranty. Despite this buyer's guide, we still did our best to help make repairs on the vehicle as agreed. Thank you.

    ** style="line-height: 115%;">Dear Sir/Ma,

** style="line-height: 115%;">Thank you for the letter dated June 16th, 2023, with reference to ID number ********. At ******************, we placed high value on customer satisfaction and it has always being our company policy to listen and resolve customer complaints if any. On this particular case, we had attempted to resolve the issue with the customer and offer to repair despite that used cars does not have a warranty per Buyers Guide meaning vehicle was purchased As Is. Unfortunately, the Customer had not given us a bit of time to resolve the issue. We even provided a courtesy vehicle for the customer to use pending a little time to resolve the problem complained about. This is the exact issue that transpired. On 6/2/23, a customer by name (..), came into the dealership lot, test drive and purchased a 2011 *** X3. She made a down payment of $1500 (zelle payment) and she got financed through a 3rd party finance company called ***************************** with contract approval #(...........). She also purchased a **************** from a 3rd ************* called Superior Protection Plan with contract #(..). At the time of purchase the paperwork she signed has a buyer guide which stated clearly that there is no dealer warranty (As Is). She signed and consented to all the paperwork as required. Few days later, she called and stated heard sound like an alarm while driving. We suggested for her to bring the car for us to assess the sound, she came into the lot, we checked and could not find any sound, So she left. After a day or two, she called again for same issue, we requested she comes back and have us check again but still we could not find anything wrong with car. So we further suggested for her to leave the car so we can take time to assess what could possibly making the alarm sound. As a courtesy, we gave her a temporary car (like a loaner car), for her to drive while we try fix the problem if any. After two days, she came back to the dealer lot without notice and picked up the car, by then we had not enough time to detect the problem. So she left the lot. Another day, she called and said she had gone to *** dealership to check the problem and requesting if we going to pay for the diagnostics, we declined because we never at anytime agree or instructed her to take it to anywhere for diagnostics. We had only tried to help as a courtesy for customer relationship and not obliged to repair since vehicle was bought 'as is' with no dealer warranty. Afterwards, She had driven this same vehicle over **** miles. She sent a message on WhatsApp (messaging APP) 6/20/23, stating she plan dropping off the car at the lot on 6/21/23 by noon and she was no longer interested, before we could read and respond to the message she had gone to drop off the car (abandon)at the dealership lot without our notice and approval 6/20/23. In sum, the vehicle is owned and registered to the customer name and a lien by *****************************. As at now, the vehicle is abandoned at the dealership lot. Every document pertaining to this transaction is available upon your request.  We are available to further dialogue and willing to resolve the issue.

    Customer Answer

    Date: 07/05/2023

I am rejecting this response because:

    1. By virtue of the contract which was duly signed on June 2nd,2023 between the dealer and myself, a contract which was assigned to the lien holder Credit Acceptance, I have the right to demand for a cancellation of contract and refund within 30days.This is written on page 3 of the agreement. I have sent a Demand notice and cancellation letter dated 28th of June,2023 to the Dealer and the lien holder Credit Acceptance via **** certified mail, which has been duly delivered to the parties, demanding a cancellation of the Contract and refund of $1500 down payment. Both the Auto dealer and the lien holder have refused to acknowledge the letter. Instead, they have gone ahead to open a claim for repairs for the *** X3. This is not what ************** them to acknowledge the cancellation of the contract and issue a refund of $1500 accordingly.

2.The car dealer refused to respond to my messages and calls that is why I reached out to the better business bureau to intervene on the 15th of June 2023.This is the reason why I dropped off the car at the dealership lot on the 20th of June,2023 demanding for a refund and a cancellation of contract by virtue of the contract signed between the dealer and myself. The dealer hurriedly applied for a transfer of title with the ***** ********** of ***** vehicle on the 22nd of June,2023 to my name and the lien holder name.
    3. The dealer wrongly accused me of adding over 1000miles on the vehicle. This is not correct because when I dropped off the car for repairs, the dealer insisted that his "in house" mechanic "Thony" drive the *** X3 (2011) home and to wherever he wishes to go to in order to diagnose the issue with the car. By so doing, the in-house mechanic added miles on the car. I dropped off the car from 06/09/2023 to 06/12/2023. The mechanic did not use any diagnostic tool. Little did I know this was just a ploy and deception to add miles to the car and waste time. Only heaven knows where the mechanic drove the car to because I got tired of waiting for the car, I went to pick up the car up, the check engine light had come on and the gas cap was broken.
4.At this point, I called the **************** (Superior Protection Plan) to inform them about the issues with the *** X3 2011 on the 13th of June,2023. I was told that it was too early to file a claim. That I bought the car less than 10days ago. This is why I want the contract cancelled outright because the dealer failed to disclose to me that the *** X3 had faulty valve.
