    Oliphant Financial, LLC is aggressively attempting to collect an alleged debt of $5,520 from me. I have sent a formal dispute letter via certified mail demanding full validation of this debt, as is my right under the Fair Debt Collection Practices Act (FDCPA). Despite my dispute, their collection efforts constitute harassment and are in violation of federal consumer protection laws. I am seeking immediate cessation of all collection activities until this debt is properly validated, and for Oliphant Financial to cease all harassing contact.

    Multiple calls daily from collection agency Oliphant ***. They claim debt is owed but I have no accounts in default or collections and all of my balances are current. They are harassing me with constant contact. Some of their voicemails are lies, starting they have a promotional offer to try and encourage contact.

    I enrolled my 2 lending tree loans voluntarily into the national debt relief program 9/2022. while in the program lending tree settled on a agreed amount to be paid. somewhere down the line lending tree sold out to ********. i had never been contacted by them prior or informed by lending tree, or natioanl debt program and of the sell out happened at all. i just kept making my monthly payments as i was supposed to. one loan completely paid, and the second one also paid to the amount negotiated with natioanl debt, but on the 2nd larger loan i noticed the top corner stated the words "renegotiating". renegotiating what?? i never agreed, or signed or was contacted about any of that. i ended the natioanl debt program 12/2024, and noticed after Olphiant slapped a HUGE amount of money in my collections stating i owe them. I owe them what??? I have no clue who they are or why they were tryng to ruin my life. I am enacting); 15 U.S.C. 1692 (FDCPA);15 U.S. Code 1692(g)

    I am rejecting this response because: I have heard nothing from this company in regards to them buying out my Lending tree loans that were enrolled into the national debt program 9/2022 with a negotiated and agreed fee between lending tree, national debt and myself. I have heard nothing until I contacted BBB today. This company nor the other contacted me, I did not sign or agree to anything from Olphiant and had no clue who they were until.i saw them posting my lending tree as a collection with a absurd amount.     They are seeking a debt from over 5 years ago that isn't mine. I have disputed this in March with no action taken. I called several times, I was told to put it in writing, which I did. Then I have placed several phone calls with no action taken. I even disputed this on my credit report which they recognized, and no action has been taken. I spoke with the manager ******, and he said he would take care of it, and I subsequently called them back several times. Again, no action to resolve this matter. I get the run around and now my calls are ignored. I have worked very hard to make sure my credit rating is in good standing after the 2010 mortgage fall and now this has ruined my credit. Any help is greatly appreciated.

No returned calls.  They still have not acknowledged my dispute that I made back in October 2024, then again in writing in March of 2023 and I have yet to hear from the manager that I contacted several times.  He answered my call once then im told he is in a meeting every subsequent time thereafter.

    The drivers license submitted has clearly been tampered with  examine the plastic around the photo.
    The pay stub is fake  I never worked for the company listed. Nor does the *** have this on file.
    Several bank account tied to the transaction shows activity patterns consistent with the known thief in addition to proof docs from those aforementioned banks acknowledging the fraud and its subsequent removal from my credit.      My IRS filings contradict the employment claimed in the fraudulent documents.

    Failure to Investigate:
    This collection agency has conducted zero investigation into this matter.
    You have not contacted the police, **** or my Equifax-assigned representative.
    Instead of performing due diligence, you have attempted to enforce a fraudulent debt against me.

    Immediate Demands:

    Despite Equifax assigning me a credit specialist (from Experian) over three years ago to resolve these issues, and my submission of over 22 certified, notarized dispute letters with supporting documentation, these accounts have not been removed. *******'s own representative has acknowledged these accounts as fraudulent, yet the credit bureaus and the respective banks continue to report them, causing significant harm to my creditworthiness.
    This ongoing situation appears to be a violation of the Fair Credit Reporting Act (FCRA), specifically:
    15 U.S.C. 1681i(a)(5)(A): Failure to delete information found to be inaccurate or unverifiable.
    15 U.S.C. 1681s-2(b): Failure of furnishers to investigate and correct inaccurate information.

    Olyphant harassed me since purchasing this KNOWN FRAUDULANT DEBT from Shop HQ. In 2021 someone made multiple fraudulent purchases including this one. I have never used this merchant. My bank identified it immediately as part of the compromise to my finances and accounts and ruled it as fraud, notified Shop HQ and reversed all charges. The debt was sold to ********. A complaint was filed, a **** complaint was filed, and all three credit agencies were notified that the collection added at that time was indeed fraudulent and Olyphant is aware of that. The collections were removed from my file at that time.Olyphant, knowing the "clock" is running out on the debt has begun aggressive attempts again, in bad faith, and knowing the debt has been deemed fraud and already removed prior on multipole occasions, resumed calling, and threatening again. The ******** agent stated they did not care who the debt belonged to, if it were fraud, etc. and stated they would damage my credit intentionally to cause me harm and force me to pay the debt regardless of its fraudulent status. They readily admit it had been established that this debt has been determined to be fraud in the past. Olyphant further stated they saw I had applied for loans and was making soft pulls looking at autos and would sabotage that. Indeed, Olyphant has done this and has intentionally and with malice aforethought once again filed a collection on the fraudulent debt that they are very aware I am not responsible for.All of this is documented by bad faith and predatory behavior that the firm has exhibited and has a known systematic pattern of documented behavior and legal filings from consumers against Olyphant.

    The business is avoiding giving an accurate response to the BBB to avoid an "on the record" response.

    Further, Oliphant has EXPRESSLY been told (see original comments) not to contact the person posting, his work, his family, his friends or ANY associated person to him in ANY manner.

    ANY contact will incur further FCRA violations for each offense.

    Oliphant simply needs to REMOVE the collection IMMEDIATELY from all agencies and destroy the file, and acknowledge it did so.

    Stating such violates no confidentiality or privacy laws.

    Oliphant is a predatory agency and responses such as these are why they have been successfully sued, fined or forced to settle because of their systematic and intentional abuse of consumers.

    I am rejecting this response because:

    The predatory agency once again simply refuses to acknowledge that they have, or plan to, remove the collection that they are aware was a fraudulent transaction, have filing for such transaction, and that my financial institution deemed it as such. 

    There is no privacy concern doing such.

    This is the ONLY acceptable response.

    The predatory agency was not provided with substantial evidence by the original merchant who was involved in the aforementioned fraud to file a collection.

    This is yet another FCRA violation that caused me tangible damages.

    The continued attempts to fraudulently collect, not follow proper FCRA and cardholder agreements with my bank, harassment, and willingly causing me financial and personal harm by continuing to post these collections on my credit report with all three agencies are FCRA violations and prosecutable.

    Remove the items immediately and cease all contact, as you've been instructed prior.

    I do not know origin of this so-called debt and entry on my credit report that I've been disputing, I never provided my written consent to Oliphant Financial LLC to report this alleged item on my consumer credit report, I never had any contract with this company. Out of the blue they say I owe them money. I have never engaged in any business with this company According to *** guidelines, reporting this alleged debt on my credit report is a collection activity. This violates : 18 U.S. Code 894 - Collection of extensions of credit by extortionate means. to punish any person for the non repayment thereof, shall be fined under this title or imprisoned not more than 20 years, or both. Delete this immediately as it violate federal laws and pay a fine of $1000 per violation in damages as stated on my letter attached to this complaint. Please investigate.

    I have never done business with this company and all of a sudden they have popped up on my credit report. I have just purchased my home for the first time last year in 2023 and this company was never listed on my credit report for collections.     I am rejecting this response because: per cfpb regulations Oliphant was supposed to have notified me via mail or phone calls at least 14 days prior to this debt just being thrown on my credit report. This debt is heading towards 5 years or plus older. I reached out to Oliphant after they negatively marked my credit report and since this happened they issued me a invoice and had been calling or texting me. Oliphant is using "zombie debt collection practices". Also per my credit report this debt is also noted " 100% paid in full" from a previous collector or from whoever I originally established payments with over 5 years ago. Once again Oliphant violated all notifications to consumer per **** regulations. There is no way a 5 year old debt can just be thrown on a consumer credit report without proper notifications ahead of time.

    I am rejecting this response because: All documents have been forwarded to Oliphant; including letter previously sent to ************ last year before my home purchase in July 2023 and also copy of my credit report showing " loan was paid in full". This company is guilty of violating consumer notifications debt rights before they marked my credit report unlawfully. I have the **** involved who had also alerted the Office of Comptroller regarding this complaint. Per CFPB; Office of Comptroller has been handling many complaints against Oliphant.The only satisfaction Oliphant can give me is to make my credit report whole again and remove this unlawful strike on it. Once again Oliphant violated consumer  notification; before strike on credit report. I called them first and since then; they have sent me a bogus invoice; calling and texting me often.
