On June 22, 2024, my husband was working on a project in *********, ** that required 51 yards of concrete. We had requested the concrete to be delivered approximately 30 minutes apart due to the large amount being poured. Initially, the trucks arrived on time, but then we experienced a delay without any clear explanation. After several calls, the driver informed us that one of the concrete plants had an issue causing the delay. Due to the delay, there was a risk of the concrete hardening and causing a crack, known as a cold joint.I reached out to ***********************, the regional salesperson for the area, and spoke to him on Monday, 07/01/24. He mentioned that he was looking into the issue and would get back to me. Despite my husband visiting the location daily to address the problem, we didn't receive any updates. The homeowner informed us that ****************** had visited the site and measured the area but was waiting to connect with the contractor. After leaving multiple voicemail messages and receiving no response, I contacted the plant. The dispatcher attempted to reach ****************** and later informed me that they couldn't assist with the situation without further explanation. As of today, 07/08/24, we still haven't heard back from ******************. In the meantime, my husband removed the cracked concrete on Friday, 07/05, and Saturday, 07/06, to address the problem areas. I am submitting this formal complaint due to SRM's mishandling of the situation. Despite assurances of contact, we were never reached out to. As a small business owner, it's imperative to highlight SRM's business practices. Despite being in the wrong, they have taken no action to address the situation. They acknowledge the issue but are unwilling to offer assistance or rectify the problem, which is entirely their responsibility.

Order 7.5 yard of concrete in the beginning it was going good. Once he decided to be on the phone I had to get his attention to pour. In 30 minutes the concrete was coming the drum dry and it got stuck in the shoot. When to add water the holes bust in the drum. He decided to drop the dry bash in the grass then he said he have to rush and drop the whole load out mountain high so we had to stop what we doing to level and remove some of the pile. He said order to fix the problem, he had to empty out the truck which the mechanic told him. I had to go rush to get 4 more guys to help out. I call the company explaining what have happen. They said they will call me back that was on July the 2nd. The driver call me asking why did I call to complain about what happened. I ask him why you calling my phone what this, I hangup the phone and on the 5th of July I decided to call back complaining why no one call back enjoying their holiday. Once the manager call me, I explained the situation. He came by the location took some pictures and call me back told me, he will only pick up the mess on the grass but won't replace the grass. I was lucky of doing that for me and I ask him what about the dry cement was pour on site. He is not responsible for that just bad job on my end. Wow

Smyrna Ready Mix Concrete, LLC (SRM) was made aware of this situation and worked with the homeowner to clean the concrete that was improperly discharged by ******************** prior to the submission of the complaint. The homeowner thanked SRM for cleaning up the mess left by the contractor and agreed that the work ******************** completed was unacceptable and is not the fault of SRM in any way. SRM denies the request for a refund of the purchased material as concrete is a perishable product and must be discharged before curing begins. According to our operator, the ******************** did not have adequate labor to place the concrete in a timely fashion, leading to the poor craftsmanship and improper finishing techniques, as shown in the attached photo. Additionally, the homeowner informed SRMs management that she has been trying to contact ******************** and, to our knowledge, has been unable to do so.It is on these grounds that SRM denies Mr. ********* refund request.

This company sent us two liens agains our home because a contractor did not pay the bill, just under $1300. We've emailed *********************** numerous times over the last two weeks and he's yet to respond. In the letter he claims this is a fraud situation with the contractor, but we're left here clueless as he will not provide any information. We stated in the email we would pay this since the concrete was used on our property, but that we needed additional information. Absolutely no response. The contractor states he's paid this company, so we are of course concerned that we are being taken advantage of. We would like contact only via email at this point as something seems very off with this entire situation. The fact that **************** is not responding at all and the contractor states repeatedly he paid this invoice, it's questionable at best. Furthermore a contractor by the name of *****************/JP Contractors is listed on the first lien notice. We have no clue who this is and this is not the contractor we used.

The claimant hired a fraudulent contractor and paid him in cash for the services provided. The contractor purchased concrete from SRM Concrete and has yet to pay the invoice. Our fraud department has contacted the claimant and has agreed to extend the payments due date until 7/15 before placing a lien on their property. The claimant had been using the wrong email address to contact our team member responsible for this case, and therefore was unable to reach us, despite having our team members correct phone number.

I am rejecting this response because:  The tone of this response is not good and is negligible.  It's as though SMT is taking absolutely no responsibility in this situation.  I'd thought we made progress when we talked with their employee *****,, but it sounds like maybe not.  We did not pay the contractor fully in cash, as we mentioned to ***** w/ SMT via phone.  We paid him via debit card and via cash with proof of full payment per text and our outdoor cameras.  Furthermore, we emailed *********************** at the email address provided on the paperwork SMT Concrete sent to us, not our error, but SMT's error, per ***** w/ SMT.  We were told by ***** that their employee in a different office listed the wrong email address on the paperwork in error.  I'd also like to mention that we provided the name and phone number of the contractor via email, in which ***** did confirm they have the emails and that she read them.  SMT has done absolutely nothing to contact ******************************* and collect the funds.  It is their company who accepted a fake name and fraudulent card number and now refuse to do anything about it. Just as SMT didn't know he was fraudulent, we didn't either.  But now they have the correct person's information, and again have done nothing to make this right.  It's disturbing how this is being handled and even more disturbing how this has been responded to.  Less than an honest response.

      Sincerely,

      *********************

Excuse me, I said SMT Concrete when I meant SRM.  Also, we made two calls to *****, the represented listed on the paperwork.  A voicemail was left, we did not receive a call back.  Please see the attached.

I apologize.  I attached our call history, but didn't highlight the calls to their representative *****. The calls are the first two calls listed on 6.7.24 to the ** number.  Thank you.

As shown in these emails we emailed the email listed on both sets of paperwork we received in May and June.  We ALSO emailed the *** with no response.  So between emailing two employees over two weeks, and leaving two voicemails, we received no response.  It sounds as though this company is doing everything possible to avoid any responsibility.  There are several more emails we sent that we can provide if needed.  Thank you.

      Customer Answer

************/ SRM stated the concrete ordered for our home by the contractor was ordered under a fake name, fake company name and a stolen credit card was used.  She states they would not have delivered to our home unless it was paid for in advance, and that they do not accept cash.  She stated that a couple of days after the concrete was delivered, the credit card owner denied the charges and reported the card stolen.  We asked for some type of proof of this, and ***** said they were not able to provide anything to us.  Given the response from the company through this complaint, I'm doubting everything we were told.  We would like proof that SRM received payment before delivery, and that the local office didn't drop the ball.  We would also like an invoice of what we are paying for, also denied to us.  SRM would like us to blindly pay almost $1300 without any proof of anything, to include a simple invoice.  As we've said all along, something is not adding up, and given the response we received, contradicting what ***** said, we're questioning everything.

      Complaint: 21863549

I am rejecting this response because: ***** stated on our first call with her that their company has experienced a great deal of fraud since **VID.  Yet in the next breath said "we have no reason to not believe the person placing the order, we trust that they are who they say they are".  Very contradictory.  We would like to see Smyrna Ready Mix put measures into place to ID the person ordering as well as upon delivery.  It's 2024, and there's just no excuse for this.  As ***** said they've had a lot of fraud.

The previous responses from this company were less than honest, which indicates they have no intention on taking any responsibility nor making any changes to prevent fraud.  With our recorded call of our first conversation with ***** (TN and ** are one party states), our emails to ***** and the company CEO, and our paid receipt, we do plan to go public with this and bring some attention as to how homeowners are left holding the bag for dishonest contractors and companies such as this company who are less than proactive.

      Sincerely,

      *********************

They asked for measurements, so we gave them to them. The employee miscalculated the amount of concrete needed, and so when the concrete was delivered they were about a yard short. Now I'm being charged for THEIR mistake, and they won't budge on the price. I am being charged for ANOTHER delivery fee along with other fees, even though they screwed up. When this company makes mistakes, they will not own up to it and make it right. Instead, I get penalized even more. They said if I didn't pay them for their mistake, they would put a lien on my property.

Before moving into our new home, SRM concrete did the driveways and walkways. We have only lived here since October 2023. After some weather in January, our driveway and sidewalk have begun to crumble and fall apart because they did not pour the concrete correctly. This problem also happened at about 20 other homes in the neighborhood. Because of their inability to do the one thing they advertise about, our driveway is now crumbling to pieces and continues to do so every time it rains and gets worse and worse. They have decided it is "not their problem" to fix their mistakes. Which leaves us out possibly thousands of dollars to replace because of what they failed to do.

      Business Response

      Date: 03/06/2024

      **********,

Thank you for bringing this to our attention, were very sorry to hear that youve experienced these issues with your driveway and sidewalk.  It sounds like what is happening with your concrete is consistent with scaling, which is localized flaking or peeling near the surface.  Scaling most commonly occurs as a result of freeze thaw cycles and the application of de-icing chemicals.  If the concrete is not properly sealed, water will penetrate through the surface and saturate the concrete.  When the water freezes, its expands and creates pressure within the concrete slab.  These pressures will generally release in the weakest part, which is typically at the surface.  Most commonly, the de-icing chemicals are the salts and brines put out during a winter weather event and tracked onto the surface from vehicle traffic.  These chloride-based brines can chemically attack the concrete and lead to deterioration, but they also lower the freezing point of water and can increase the amount of freeze thaw cycles that the concrete is exposed to.

We would be more than happy to send a representative from SRM out to your house to further investigate the issues.  They may also be able to recommend a solution that can mitigate the existing damage and potentially extend the lifespan of the concrete surface.

On 6/21 spoke to ***** the salesman for the Belton ** area for a price quote, while talking to him about the project, ***** gave me a verbal 139 price which wasnt to far off most of his competitors so I didnt think much of it. We went into more description about getting an acct. ***** kindly referred me online and how to get the acct started. We wanted to pay cod but was also told if we got a acct you get $5 off a yard, if paid within 10 days then they take another $2 dollars off. Im thinking great. On 7/25 I reach back out to *****, get the acct aquired/15k limit and we start to pour on the 31st. We pour 65 yrds on ************** and 107 on 8/3. I know this exceeded my credit limit and we had one more final pour to do, so I called ***** to see if there was a bill which there still wasnt. ***** gives me the number to the acct manager which I tell the situation to about wanting to bring them a check so we could pour the remaining on 8/7. We still didnt have online access to the acct to view things and no bills. We pour the final 73 yards and a few days later we get our first bill. Its for 147yrd. I immediately text ***** which of course says o we had a price increase in April, I say well you gave me this price on 6/21. ***** informs me to contact acct manager which has no idea what hes supposed to do cause he only collects and sends me back to *****. Now we are clear this is a normal tactic for this company and there giving me the run around, so I call the sales manager for this district. No answer, so I left a message. Waited several days, no answer so I called him again. He then calls me back and I go into detail on what happened. He goes to tell me SRM has never had a price of 139, which according to ***** was. Now there blowing smoke, plainly showing that Im wasting his thing he says to me is sir, it is what it is I dont know what to tell you. Srm has always been more expensive then everyone else. So ***** plainly lied, and SRM IS okay with it

Smyrna Ready Mix Concrete, LLC denies ******************** allegations and his request for a billing adjustment. Our pricing is set for all products at all plants, and our sales team members only provide approved pricing information. Our pricing was updated on April 1st, 2022, and according to our records, the price for the product purchased by ****************** was not $139/CY, before or after the updated pricing. We believe that while ***************** was gathering quotes from several ready-mix suppliers, he confused a few of the quotes. ****************** does not have any written communication with any member of our sales team quoting $139/yard.

Today, August 18, 2023, I was supposed to get concrete to replace my patio and driveway apron. The concrete company by the name of SRM Concrete which is based out of Tennessee came and when the concrete was coming out of the cement truck it wasn't soft and not coming out of the ***** easily. It was more like chunks of rock. My construction guy and his team kept adding water to see if it would help but it wasn't working so they barely had enough concrete to do my apron. They said it was "hot concrete" and was no good to use on my back patio. The crew from SRM didn't want to get another truck with "good" concrete so they left. When they lifted up the ***** a big pile of concrete fell out of the part where it folds into two and they left the clump of concrete in front of my driveway for construction guy's team to clean up. So now my construction guy is out the money he paid him and wants his money back. Not to mention I now have to wait 2-3 more days to get my patio done. SRM Concrete *************. ***************** ordered the concrete. Feel free to contact me at ********************* Thank you.

Smyrna Ready Mix Concrete, LLC has resolved this issue with the **************** contractor. The contractor was recommended the use of a ******er in his order, however he refused. It took the contractor over an hour to place 4 yards of concrete. After they had poured 4 yards, the contractor called our office and let us know that the concrete was curing. We sent quality control and sales team members to the job site to assist them, but they refused the recommendations and demanded the concrete be returned. The contractor failed to place the concrete in a timely manner, causing the concrete to begin to cure. We delivered a new batch of concrete the next day at 12:02, and we waived the delivery fee, and the contractor ordered ******er. It was also mentioned that some concrete spilled out of the chutes. Our salesperson and quality control team member offered to clean up the concrete, but we refused the opportunity.

To whom this may concern:I worked with exclusive concrete construction (ECC) and paid their contractor (***********************) in full after the job was completed in March of 2023. My contract for the job was with ECC, not SRM (Smyrna Ready Mix) . Two months later, I got a notice in the mail asking me for 1500$ because ECC didnt not pay their bill to SRM. They threaten to get a lien on my property if I didnt pay: morally wrong! It is the equivalent of going to Target and buying a toaster and then getting a bill from the toaster manufacturer because Target didnt pay their vendor. Now I have to pay for an attorney to deal with their incompetence for failing to get payment at time of their delivery to their customer (ECC). I am the final destination costumer at the end of the chain and have zero knowledge involving concrete and construction nor was I provided any notice in regards to the legality of the above at the time of project completion, I find it unfathomable that the final customer is responsible for the incompetence of both companies .Sincerely,*************************** ************** ******************
