Transaction date: 5/1/2024, payment for Encore's Timeshare Exit Services. . . . . . .
Before attending Encore Law's 4/16/2024 "educational" presentation, I was enjoying the travel benefits of my timeshare and had no intention of dumping so valuable an asset. I trusted Encore's self professed "expert" representatives who insisted, despite my protest, that ALL timeshares were inherited by one's heirs, and I was PRESSURED into signing Encore's Service Agreement UNDER THE FALSE PRETENSE of it being the ONLY WAY to protect my children from inheriting my timeshare obligations. During the one-on-one I was specifically told NOT TO MAKE CONTACT with Interval International or my timeshare agents, and to notify Encore if they attempted to contact me. Before leaving the meeting, my "advisor" instructed me to text him a copy of my timeshare Contract when I got home. In my text to him I wrote that I did not have a Contract, only the attached Points Certificate. Encore's "expert" advisor AGAIN CONFIRMED that my Points Certificate timeshare would be inherited by my heirs, when he texted back, "Deed/ Trust both still in perpetuity and right of survivorship!" (photo of text uploaded), I again trusted Encore's assessment of my Points Certificate and their professed need to protect my children, so I proceeded with payment for Encore's exit services, (none of which have been performed), based upon their verifiably FALSE information. . . .. . .

The information from this client is not factually correct. The client's deeded Marriott timeshare ownership is a deeded real estate property, and a real estate deed does pass on to the client's heirs. Our staff does not force anyone to sign contract documents. This client has not fully complied with the release of ownership process, and this is the only reason why the release of ownership process has not been completed yet. Our staff is fully able and willing to complete our contractual obligation to complete the release of ownership for their deeded Marriott timeshare. I am rejecting this response because:It is Encore Law that does not have correct information regarding my timeshare! I DO NOT HAVE A DEEDED MARRIOTT TIMESHARE! Obviously the Business has not even read my Complaint, which includes a copy of my Hyatt Vacation Club POINTS CERTIFICATE. Please read it now, along with the text thread to ******* ****** submitted with my Complaint. Contrary to the information I received from Encore’s April 16, 2024 presentation headed by Director ***** *****, my timeshare unequivocally DOES NOT pass on to my heirs. This was confirmed by Hyatt Owner Services when I contacted Hyatt in November 2024, after Encore repeatedly ignored my grievances as posted in my earlier September 2024 reviews of the troublesome experience I had with them.
Those reviews explained how, after Encore’s team crafted the urgent need for me to protect my children from being encumbered by my timeshare and presented me with their costly solution, I became frightened and visibly distraught. As an 82 year old widow lacking the resources to pay for the proposal, I asked for time to ‘sleep on it’ until morning but was told I had to decide before leaving the site. Shaking and tearful, I could not make a decision. So, yes, I felt pressured to have to choose between struggling to pay off sizable debt or dumping my timeshare obligations on my children.
Per my “advisor’s” (******* ******) instructions to text him a copy of my Contract when I got home, I texted the Points Certificate to him, with the explanation that I did not have any Contract. A copy of this text message (which the Business also did not bother to read) was submitted in support of my Complaint, wherein my “advisor” reaffirmed that my Points Certificate was definitely held in perpetuity. I trusted the accuracy of Encore’s “expert” presenters - that the ONLY way to protect my heirs from inheriting my timeshare’s financial obligations was to use Encore’s exit services; that was the ONLY reason I agreed to do so.
Dismissing the facts presented in my Complaint which described what actually occurred during the presentation I attended, and deflecting their responsibility for the misinformation given to me, is typical of Encore’s unethical sales practices.
To be clear, I was misled by the information I received from Encore Law’s meeting. I now know that I do not need Encore’s exit services to protect my children from my having to deal with my timeshare, nor do I want Encore to provide such unnecessary services .
What I do expect is a full refund for the $9600 charged to my credit card.
So, no, I do not accept Encore’s unsatisfactory Business response.

Encore Law's response has not changed. For clarification, Marriott Resorts owns Hyatt Resorts. Our staff started the Release of Ownership process for this client, and is fully capable of completing the Release of Ownership for this client as we are contractually obligated to do. If the client has been offered a new option from Marriott/Hyatt Resorts to be released from the ownership and ongoing maintenance fees due to the client contacting the resort directly, which is in breach of contract, it would be due to Encore Law starting the Release of Ownership process. The client is free to accept a Release option from their resort if they choose to, but Encore Law is not responsible for the completion of the Release of Ownership by that means.
As previously stated, Encore Law is fully willing and capable of completing our contractual obligation of Releasing this client from their Timeshare Ownership, and therefore is not due a refund. If the client needs Encore Law to complete the Release of Ownership process, they can contact our toll-free number to resume the process. I was sent an invitation postcard to attend a catered event. At a local hotel.. I attended the meeting hours before I was leaving on vacation.
I have asked for someone to contact me to go over how to get out of my timeshare. I was also promised the $100 visa card to be mailed by tuesday which was a lie or scam. Nothing has been mailed to me and when I contacted Andy back he said he was going to block me. Ive called their office still NO call back. I want what I was promised as I drove over 45mins to this meeting, sat thru it and listen to it and the dinner was cold BBQ and a frozen hamburger patty which made me very ill before my trip. I wanted to get out of my timeshare now I dont even trust this compamy after looking at the BBB website which they talked on in the meeting

On 11/3/24 I rescinded a services agreement with Encore Law dated 10/31/24. This was within 3 days after date of execution, as stipulated in the agreement. Photo of the agreement and my email rescinding it are in supporting documents.
On 11/17/24 I called Encore Law to inquire when I could expect a refund. On 11/18/24 ***** ******* (417-396-4499) returned my call. He said a refund would be issued to my credit cards, but it could take as long as 10 days. No refund as of 12/2/24, so I attempted to call ***** ******* again, but his voicemail box was full. I left a message with Encore Law’s answering service, but no one has ever returned my call.
It is now 3/3/25 and still no refund!
Note - $6000 was charged to my Visa with Barclays. I disputed the charge. Barclays sided with me and provisionally removed the charge. However, that is not final until 3/22/25.
$5837.25 was charged to my Master Card with Synchrony. I also disputed that charge. Synchrony determined that I am responsible to pay it. I have no idea why and am in the process of getting details.
As for advertising, I received an invitation in the mail to attend Encore Law’s event. Photo of that is in supporting documents, along with two other invitations that they had the nerve to send me. Also included is a list of contact information that was given to me on 10/31.
Encore Law appears to be playing games or running a scam. I did nothing wrong. I am a senior and feel completely taken advantage of. Please help me.Business Response

On 26 July 2023 we signed a contract with Encore Law for $44,538.00 to obtain a release from our Hilton timeshare which Mr. ****** and Mr. ****** said that it would be no problem. It has now been more than 18 months since the contract was signed. The contract states in all caps: IF, AFTER 18 MONTHS ENCORE LAW IS UNABLE TO OBTAIN A LEGAL RELEASE FROM YOUR TIMESHARE, ENCORE LAW WILL BE RESPONSIBLE FOR ALL FUTURE MAINTENANCE FEES UNTIL A LEGAL RELEASE CAN BE

The 18-month time period in our contract starts once the initial documents are signed and returned to our Release Department. I am rejecting this response because:I received a call from MS ********** on March 3rd stating that our request for cancellation of our timeshare was a done deal. We have received nothing in writing stating that. Her response to BBB was that they are still working on our case and if we needed further updates, we could email Encore Law or call the toll-free number. We have sent emails to Encore Law on the following dates.
September 5, 2023, directly to ***** ****** with no response. February 21, 2024, again to ***** ****** and CF to Resort Resource Group. Mr. ****** did not respond but Resort Resource Group did. February 27, 2025, to ************************* and CF to ***** ******, ***** ****** and Resort Resource Group. Received no response from either of them. We received an email notice on March 1, 2025, that the email to ************************* was undeliverable. This email address was taken right from their website.
The only response we received from Encore Law was after we filed our complaint to BBB. Our last contact with Resort Resource Group was in December 2024.

If a client tells our release department that they want to stop the release process, our release department acknowledges that and puts the file in a pending status, as the client's participation is required to complete the Release of Ownership. I received an advertising flyer addressed to me with images of a $100 bill, stating that if I attended a seminar on Wednesday, October 16, 2024, in Summerville, SC, I would receive $100 cash. The seminar, facilitated by Encore Law, promised to eliminate all my timeshare obligations. After the seminar, I decided not to pay over $14,000 to get out of my timeshare with Westgate Resort.
In the lobby, ********* told me they were giving $100 Pre-Paid Gift Cards from Wal-Mart instead of cash. I agreed, but she then said the cards were left in Knoxville, TN, and would be mailed to me within a week. After multiple calls to Encore Law with no response, I finally spoke with **** *******, who assured me he would take care of it. We talked several times in November and December 2024, but since then, I've been "ghosted."
As of today (Friday, January 31, 2025), Encore Law hasn't addressed the issue. It's not about the $100 but the principle. I want my $100 cash or $100 Pre-Paid Wal-Mart Gift Card and an apology. I have the advertising flyer and specific dates of my conversations.Business Response

Last year we attend a seminar to release us from our Club Exploria Association Inc. time share with Encore law corp in Houston Tx. 77092. We paid Encore Law Corp ***** ****** $23,718.00 with Credit Cards they had us apply for. They gave us the breakdown on how much it would cost to release us from the contract. They have not paid off this debt off yet and it’s a year later, as a result we still must pay this debt which has now went into collections for non payment. Encore Law advised me and my spouse that they could get us out of our time share.We paid encore law 16,127 dollars in October2023. My wife paid the maintenance fees in advance for fiscal year 2024. Starting in January 2025 the maintenance fees will start again and the fees should be paid by Encore Law. When we call the call center the ladies on the other end told us all they do is forward the message and that was all the could do. Encore Law is diligently working to complete this client's Release of Ownership process. Our release department has spoken to the client numerous times, with the most recent contact within the last 30 days. Our contract stipulates that the client is responsible for the Maintenance Fee on their property for 18 months after the contract is signed. The Maintenance Fee for 2025 will need to be paid by the client in order for our company to complete the release, as it is within the 18-month period stipulated in the contract.
Encore Law's contract states that Encore Law will be responsible for the clients Maintenance Fee beyond the 18-month period, so the 2025 Maintenance Fee will be the last fee that the client will need to pay. Please let us know if you need any other information regarding this issue.

In response to a flyer, I attended a meeting on Nov 25, 2024 with a team from Encore Law at a local hotel to discuss my exit from a timeshare. After a briefing and discussion with ***** ********* and **** *******, we agree to sign a contract with Encore Law for help in exiting our timeshare. The next day, ***** ********* called me at 9:30 AM on Nov 26, 2024 and we discussed the contract and I told him I did not like the wording in some of the contract clauses. I was also informed that Encore Law is not actually a Law Firm. I said I would try to exit the contract myself in December and then I may be willing to sign a new contract with them in the future. He said he would cancel the contract. I also called and sent emails to the corporate phone number that day and mailed them a letter rescinding my contract since the contract stated I had three days to cancel. The day after I called to cancel the contract, Encore Law charged my credit card $8012 even though we agreed to rescind the contract. I have called them multiple days since then and the receptionist always says someone will call me back to refund my card, but I do not receive any calls back from them. I finally called **** ******* on Dec 2, 2024 and he said I would be refunded within a day. It is now a 5 days later and I still have not received a refund nor a return call from their corporate office.Business Response

On 9/8/2024, we were contacted by Encore Law, offering to help cancel our timeshare. After meeting ***** ***** on 8/14/2024, we were coerced and pressured into signing an agreement and immediately paying $20,565.02. We were told to split the payment across three credit cards and promised cancellation of TS within a week. After the payment cleared, a company called "Vacation Properties Fulfillment Group" (VPFG) sent additional agreements, requiring 18 more months of payments & more money. Researching we discovered that Encore Law and VPFG had suspicious addresses and no legitimate legal services. Attempts to cancel and get refunds failed, and ***** ***** gave contradictory responses. On 9/1/24, we disputed the charges, but no refund was received yet, Mr ***** ******* promised a full refund if we drop disputes. On 9/10/24, ***** ********** received a call from ***** *******, offering a partial refund of all fees except $4,000 per agreement signed. We provided proof that no services were offered YTD. After discussing with family, we conference called ******* back, and a heated conversation ensued. I insisted on a full refund, citing pressure during the signing, false information about cost of service and lack of adequate contract review time. ******* defended Encore Law’s actions, insisting on the contract and insisted we had a change of heart which is not true. He clarified that Encore Law is not a legal firm although works with attorneys but dismissed concerns about the company’s legitimacy. He offered a full refund if we canceled the credit card disputes. He promised a refund within 7-10 days if the disputes were canceled, he followed up that a refund is issued but has been avoiding calls since. We request an immediate refund of the full amount as we were promised, $20,565.02. We have been waiting on it since 9/10/24, today is 11/17/24 and all of our phone calls remain unreturned.Business Response

Encore Law has spoken with this client numerous times. There are many incorrect claims from the client in this complaint, that are directly refuted by our contract documents. Our contract does not stipulate any timeframe for the completion of a Release of Ownership due to each resort and state having different requirements and response times, but what our contract does guarantee is that if the Release of Ownership process takes longer than 18 months, Encore Law would be responsible for all Maintenance Fees on that ownership until the Release of Ownership is completed. The typical timeframe for the Release of Ownership for this client's specific property is approximately 6-9 months, contingent on the client complying with the Release process.
All clients of Encore Law do not have to pay any additional costs above and beyond the contracted cost. The documents from the VPFG office that refer to any additional fees that the client would need to pay are only referring to a fee that the client's resort requires the client to pay directly, and in that scenario, the VPFG employee lets the client know that fee would be immediately reimbursed to them by Encore Law.
The date of contract for this client is 8/14/24 and the client's first request to cancel the contract was on 9/6/24, which is well beyond the 3-day rescission period. Encore Law addressed the client's initial request to cancel their contract by offering to refund them minus the $4,000.00 penalty that is stipulated in the contract. The clients declined that offer. After further discussion with the client after the client disputed their charges with their credit card company, an offer for a full refund was extended with the stipulation that the client agreed to drop the dispute. That dispute was never dropped by the client, and it was ultimately returned in our favor. At this time, Encore Law will not be offering a refund to the client and our company is ready and willing to complete our contractual obligation to complete the Release of Ownership for their Wyndham deeded ownership. Encore Law stands by its original response. A client changing their mind well beyond the rescission period due to their children's input is not a valid reason to be fully refunded. Encore Law is ready, willing and able to complete our contractual obligation of the Release of Ownership for the client's Timeshare Ownerships, but the clients must be ready to move forward with that Release process. The clients' file will be in a Pending status due to non-compliance with the Release process that is stipulated in the signed contract, until the client contacts our office and agrees to move forward.
