    I was looking to sell my home quickly to get out of a very high mortgage payment. I contacted Nexxus and was contacted by ****. **** came out and seemed amazing. He made an offer on the house and we agreed. Everything was great. He had an appraisal done and somehow a foundation issue that was never there before was found by his “engineer”. He advised that he couldn’t purchase the house but “felt awful” about it because it “wasn’t our fault”. He offered to reach out to a realtor friend who would list the house and take a discounted realtor fee if sold. Sounded wonderful. **** advised that if the house didn’t sell then he would have first right to the short sale. We agreed and I signed the paperwork for what I thought was that. It wasn’t. The house sold through his realtor friend and we were looking to make around only $12,000 on the sale, but it was going to be a lifesaver for me. Closing time comes and **** and his company have taken the exact amount of the profit we were to make. So we made $0. **** has tried to justify this and there’s no justification for this. He flat out duped us and took every cent of profit. He made $12,000 for a simple referral to a realtor. Very very shady

    Initial Agreement & Property Condition
    Ms. ***** reached out to Nexus Homebuyers because she was seeking to exit a burdensome mortgage quickly. We made an initial offer to purchase the home directly, subject to inspection and due diligence, including a structural assessment. That assessment revealed potential foundational concerns, which significantly affected the feasibility of moving forward as-is. This was not manufactured or fabricated — it was a legitimate concern substantiated by a third-party contractor.

    Transaction Coordination Using Novation Model
    Due to the condition of the property and the seller’s risk of short sale or foreclosure, we supported a transaction structure commonly referred to as a novation, in which a new buyer is secured prior to closing. All parties, including Ms. *****, were fully informed in writing, and she acknowledged the terms—including the involvement of third-party professionals and their compensation. This was not a simple referral to a real estate agent, as suggested in the complaint. Our role involved coordinating necessary repairs through licensed contractors at significant discounts to help facilitate a successful closing with the end buyer.

    Compensation Disclosure
    Compensation earned by our company was clearly outlined in the closing statement (HUD-1/ALTA) — which the seller signed at closing. We were compensated for the time, risk, and resources used to resolve the sale in a complex situation where foreclosure or a short sale were likely outcomes. This was a structured solution, not a commission or referral fee.

    Seller Proceeds
    It’s important to note that the home was originally in distressed condition and would not have likely sold retail without intervention. Ms. ***** did not make a net profit from the closing proceeds, but her home was sold without foreclosure, without credit damage, and without lingering liability. These were the outcomes she initially sought when she contacted us.

    Good Faith Conduct
    At every step, Ms. ***** had the opportunity to consult with outside counsel or work with any of the realtors she mentioned in her complaint. She chose to move forward with our proposed solution voluntarily, and all documents were reviewed and signed by her directly. We never represented that our services were free, and we disclosed the structure in writing, prior to closing.

    Conclusion:
    While we understand Ms. *****’s frustration with the financial outcome, we acted in good faith, followed all contractual agreements, and delivered on the service promised — which was the full resolution of a property sale under significant financial pressure. We are confident our actions were ethical, transparent, and legally sound.We regret that she now feels misled, but no misrepresentation or wrongdoing occurred.
