Heavenly views was paid nearly 7,000.00 for a wedding that was cancelled 8 Mos before the date. We were told by ******** that we could not get any kind of refund, but could reschedule the wedding. She did not state it had to be the same couple. I purchased the package, and now the venue refuses to let me use the package for a different couple. They are taking the money and run.Initial Complaint

Almost impossible communication with this wedding venue. I paid $500 for a save the date deposit on 4/29/21 and was told the contract would be sent soon to finalize. After 5 months of unanswered emails, phone calls and texts I was finally given and signed a partial contract on 10/22/21. This contract only contained the venue rental and nothing about the rest of the package that we had agreed on. Since then I went through the anxiety of additional unanswered correspondence requesting payment information and to finalize additional details for the next 2 months. When I finally received a return phone call on 12/29/21 from the owner, ***** ******* i was told I would not be provided with any of the original promises of service and there would be a price increase. He claimed he did not have any contracts or information about the wedding. I reluctantly agreed since we were 4 months away from the wedding. I asked him to send me the new contract. I requested the new contract 3 additional times with no response. I sent him an email on 1/8/22 requesting my initial $500 back since I still did not have an amended contract or payment information. He called me and became verbally abusive and threatened to sue me for the remainder of the rental agreement of $4,164.38. He had "found" my contract by that point. I feel Heavenly Views deliberately acted in Bad Faith and breach of contract. Changing venues and hiring vendors at this late date has caused considerable financial and emotional distress. I have since talked to a few others with similar situations along with his former employee who is suing him for back pay.Initial Complaint

I booked my wedding with Heavenly Views with a $500 deposit on 2/3/2021. The wedding was supposed to take place on 10/8/2021. On 3/15/2021 I paid Heavenly Views $1371.00 On 4/15/2021 I paid Heavenly Views $1371.00 On 5/15/2021 I paid Heavenly Views $1371.00 On 6/15/2021 I paid Heavenly Views $1371.00 Total Paid by me to Heavenly Views on 6/15/2021 was $5984.00 - the grand total of the wedding was $10,097. **I was paying more than I needed to over the course of those 4 months** I tried reaching out to my planner ******* on July 5th to cancel my wedding - she did not respond and to this day I have no communication from ******** I emailed and cancelled my wedding on July 7th and received confirmation on that from ***** **** responded again on July 14th saying "We will get a resolve on monies by the end of the week for you" I gave Heavenly Views 91 days notice of cancellation. Heavenly Views refuses to give me any of my money back at all.Business response

Business Response /* (1000, 5, 2021/11/17) */ On February 8, 2021. ******** ******* signed a contract for wedding venue and services for October 8, 2021. The contract states clearly there is no cancellation or refund available and that is acknowledge by the client. The total of that contract was $10,097.oo. The venue and services were reserved as agreed, no other parties were allowed to reserve those services or venue times as they are held for the exclusive use of the client. The full balance of that total is required to be paid in full on or before 45 days prior to event. With the contract use date of 10-8-2021 - the balance paid in full was required by 9-24-2021. In July 2021 - ******** ******* emailed that she would no longer be getting married. At that time she had paid a total of $5984.00 and held a remaining balance owed of $4113.00. We immediately agreed, outside of contract to cease the payment process and release Ms. ******* from owing the remaining balance. According to procedure, we informed the associated vendors and schedules of this change of use. Ms. ******* was informed that the vendors do not allow a cancellation of service, the expected service is paid regardless of use. This is an industry standard as the time / service cannot be replaced that is held for the clients. It is expected that payment is rendered for guarantee of service and time reserved, that is not something that can be recovered by the parties involved who refused other business for the reserved service and time held by Ms. ******* contract. We additionally attempted to recover the reserved time and services by opening to other interested parties, however, July being only 2 months prior - absolute impossibility to recover by our team, venue or vendors. This is outlined in the contract. We have released Ms. ******* from the remaining balance owed. It would not be logical for a business to be asked to pay for the services at a loss, we have gone outside of standard industry practice and our policy to release the client from liability of the contract. We are saddened by the circumstances for Ms. ******* and wish we could do more to ease the situation. As stated to Ms. *******, when threatened with a BBB complaint, we will continue to work as the wedding season closes out for our venue to see if more can be attributed to Ms. ******* - that is just something we cannot guarantee and takes times, we will update accordingly to Ms. ******* regardless of this complaint action. Consumer Response /* (3000, 10, 2021/11/18) */ (The consumer indicated he/she DID NOT accept the response from the business.) Please have the business provide payment statements of the exact amounts that were paid to vendors for my wedding. The below statement makes absolutely no sense as "wedding season" closing out and the results of other weddings should have ZERO effect on the amounts that I believe should be attributed back to me seeing as how my wedding never took place. "...We will continue to work as the wedding season closes out for our venue to see if more can be attributed to Ms. ******* - that is just something we cannot guarantee and takes times..." Business Response /* (4000, 12, 2021/11/18) */ In the previous response, a copy of the signed contract was attached. The contract clearly states no cancellation or refund. This is the standard for the risk to unrecoverable funds when providing the guarantees of service required by that contract. We have released the client from the breach of contract with the remaining payments according to that contract being forgiven. As we close out this wedding season and due to the circumstances expressed to us by the client are willing to review the loss impacted on the business and update if we can assist further in easing the situation for the client.
