D1 Sports Training - Temecula will not stop harassing me and illegally processing my Credit Card. The facility initially misled me on their startup program, upon reviewing the contract I did not sign anything nor did grant permission for my credit card to be charged outside of the initial interest list fee. Please ensure the business has clearer business practices and are not taking advantages of other consumers. Thank you

In The beginning of October when I enrolled my son ******, I was told there was no contract. Yesterday on December 27th I was told I was being emailed an early termination agreement to sign. This is not a proper business practice and they are trying to get me to sign a document to I entrap me.

The 6 week challenge is $600 and you are supposed to get your money back after the 6 weeks if you come to at least 18 classes and do an ****** scan once a week. I asked many members of the staff including the manager himself if there was anything else I needed to do to be on the correct terms to get the $600 back. They all said to just do the body scan every week and come to the classes. If you choose to stay with the gym, the $600 will be applied to your continued membership (which is $100 a week). This is clearly a new gym. They do not even have the correct telephone number to reach their office on ****** and I have had to call several times to get a response just to schedule or reschedule appointments. The workouts are disorganized and there is no accountability involved or nutritional support that they advertise when you sign up for this challenge. I personally, would not pay $100 a week for these services because it is solely a 45 minute boot camp class. With this said, at my exit interview when I was going to elect to get my $600 back instead of continuing my membership, the manager, ****, asked me of I had filled out my forms. This is the first I had heard of forms. He then explained to me that they sent a text message at the beginning of the challenge with a link to my weekly form to fill out about the challenge. He said that this was a condition of the challenge and that since I did not have the weekly forms filled out then I was not eligible to get the $600 back. This to me, is not transparent. Obviously, if all I had to do was fill out a weekly form, I would have done it. I have left work early just to make these classes and asked more than once of I needed to do anything else because I really wanted this option. Because my work schedule has changed, I cannot make the only evening class they offer and there is only one weekend class offering at all. This is service I cannot use and do not want and I feel like I did my part to receive my money back.

I signed up for the D1 6-week program after an employee named ******* told me I would be able to leave the program at any time and be refunded due to my chronic knee issues. I never would have signed up if there were different terms. The employee ******* even had me write "I have patellofemoral" on the agreement to note it. There is probably and audio recording of us going over these terms in the main office as he pressured me to sign up instead of paying for one class (which he said would be $** and it would make much more sense just to sign up for free...). My knees flared, I had to end the program, and D1 is now spinning their story. I contacted the manager and owner, but they don't care. The manager threatened me with legal action. The owner never responded. I marked it as fraud on my bank account, and D1 is fighting it. D1 thinks fraudulent misrepresentation of a contract is totally okay and they're happy to ***** you over.
