On our first phone call with David Myers he quoted us $*** to complete a perc test on a piece of land. A couple weeks later he increased this price to $*** for no apparent reason. He completes the work and sends me a bill for $****….

I called him and he said that the previous owners of the property (who live in California and I don't know/have never met) never paid him for previous services years prior so he added the services they ordered onto ours to try to recoup costs.

Absolutely ridiculous logic and business practices. Imagine going through the drive through and the person in front of you not paying so the restaurant attempts to force you to pay.

When Mr. ***** initially called, I quoted him the cost of a soil evaluation, which is *** dollars. At that time, I didn't know which property he was wanting the test on. When I realized which property he was refering to, I stated that I had looked at it a few years prior for a builder and had already performed a soil evaluation on it. But what was needed was a percolation test in addition to the soil evaluation. That is another fee as additonal work is involved in getting to a conclusion if the soil will support a septic system. I don't believe he understood anything I was telling him. I added the additional cost for the soil evaluation that I had originally done because I realized that never got paidr. I told him that I shouldn't have done that and said I was sorry and adjusted the cost back down to the *** I originally quoted him. With this said, I have no idea why Mr. ***** is complaining about anything. If he had called anyone else, he would have had to pay a tremendous amount more to get the testing done. I do the percolation tests cheaper than anyone does them. My prices haven't gone up in years on those, while everyone else's has. I believe he is just the type of person that wants to find something to complain about no matter what.

I am rejecting this response because:

Once again David Myers is beating around the bush. I was very clear from our first phone call that I would like a perc test and nothing more. He tried to slide additional charges in with hopes it would just be paid.

I have our recorded conversations and I never once received an apology.

Extremely unprofessional response, typical from David Myers, blaming the customer for David’s actions.

    Sincerely,

This is a common mistake people make when requesting a soil evaluation/perk test. Per regulation in TN, the first step in obtaining a permit is to conduct a "High Intensity" soil evaluation to determine the soil types. Depending on the soil types found in this initial test, will determine if you'll need additional testing such as the percolation tests. I was trying to convey that I did a High Intensity soil evaluation on that property already, but it needed the additional perk testing. I was never paid for that initial soil evaluation where we spent the better part of 2 hours taking soil samples. Plus the time in the office creating a contour map, downloading GPS points and overlaying them etc... There is a lot of time involved in that process. Then with the percolation testing, we have to go back to the site two more time, dig the perk holes, carry water etc... So at the end of the day, you got a good deal on the testing as a whole. What you paid for the perk test was far less that if you have used someone else. You're just doing this to retaliate against me for threatening to put a lien on the property if you didn't pay. Because you ghosted me from two phone numbers I had for you when I asked if you closed on the property and if payment was on the way. It wasn't until I threatened the lien that you finally responded.

We paid $1400 for soil mapping and perc test. We’ve yet to receive any paperwork about the findings and cannot get texts or calls returned. We’ve been waiting for 2 1/2 months. The soil mapping and perc test is done, but we have not received paperwork. Therefore we cannot build our house.

I'm truly sorry about your situation. It bothers me more than you know when a property doesn't work out favorably. First of all, we completed the job for 1400. Our work there is done. It didn't pass. I've had the report sitting on my desk for weeks. I always do all my reports by the end of the week. I could have easily sent you the results. I was simply waiting to see what we were going to try to do next. I laid out additional test holes (on my time) so your husband could test them himself to see if they were going to work. It sounded to me, based on his results, that they failed as well. Your only option after this is to get a drip emitter system. These are rather expensive and I hesitate to go there unless we've exhausted all other options. I have been corresponding the best I can with your husband. There may have been a time or two I forgot to call him back, but I haven't forgotten about the project. In my entire 24 year history of soil consulting, I have never left anyone hanging. I always see projects to the end whether it's a possitive or negative outcome. But I can say that I don't appreciate someone jumping on the BBB site and complaining about me just to vent their frustration because they have a property that won't pass. It's not my fault, I just report our findings. I simply cannot continue to help someone that rubs my name in the mud. I don't deserve this. I've been working 70 plus hours a week trying to keep up with the high demand. I was going to circle back to yours soon before this complaint. There has been a lot of rain this year and I've had a few setbacks.

Also, I have tried to get your husbands email to send my results but he hasn't responded. Good luck with the property.

I am rejecting this response because my complaint with the BBB  was not due to negative results on soil testing. I understand these things happen. It was an attempt to get the report we are owed, and get a response to the multiple attempts at communication. Your voicemail is typically full. You don’t return calls or texts. If you do it’s weeks later. I don’t appreciate being made to look like I am just upset about our soil test. Communicate with your clients. I reject your statement that you did communicate with my husband because we have multiple texts where you didn’t respond. And you sure did have his email when you sent us the bill for $1400.

    Sincerely,

    ********,

I'm doing my best to keep up with the extremely high demand for my services in this area. I'm one of only a very few that work in this area. I'm currently working on one of the biggest, if not the biggest, developments in Tennessee. I have major commitments to this developer. I'm basically up there 40 hours a week and have to work other people in. Frankly, I don't need any other work besides this 2500 lot development. I'm just trying to help other people in need the best I can. You're just impatient. I was about to get around to finishing yours. I do these all the time that we run percolation tests on and they fail. We usually do that in as timely as possible. When they fail, we are left having to revisit the same property multiple times while we have numerous others on the schedule. So we have to get these jobs back in the circulation. You can complain all you want, but I have a sellar reputation for doing a good job. I have countless builders, realtor, developers, and engineers that can vouch for me. Most of these people understand the pressure I'm under and they are patient with me. I hope you're able to get your property passed with someone else.

All it would have take  for us to be satisfied is communication. Being busy is fine. But not responding to texts or questions or phone calls is the reason we are going back and forth. Again this has nothing to do with my property not passing. It has to do with lack of communication.

    Sincerely,
