    Paid deposit $850 and rent apartment Oct 2023 through May 2024.
    Deposit returned 7/10/24 was only $650 shorting me $200 (dated 6/14/24)
    Business stated it was for damages. I requested documentation. 3 pictures revealed paint chip from shower rod, scuff mark on shelf from dishes and a scuff mark on wall. I stated that the pictures demonstrated normal wear and tear of tenant. I asked why no one contacted me when discovered with no response.
    Email dated 7/10/24 was sent requesting the remaining deposit based on the fact it was normal wear and tear with no response from business.
    7/24/24 followed telephone call with business stating they would not refund $200 and I could elevate issue to BBB, small claims court or whoever I wanted to.

    Thank you for bringing your concerns to our attention via the BBB. We understand your frustration regarding the deduction from your security deposit. Upon inspecting the unit after your departure, we identified several damages that required repairs, which amounted to $200 for materials and labor. This deduction was made in accordance with our lease agreement, which stipulates that tenants are responsible for damages beyond normal wear and tear.

    The security deposit is intended to cover costs incurred due to damages beyond what is considered reasonable use of the property. As such, we are unable to refund the $200 deduction.

    We value our tenants and aim for transparency in all our transactions. If you have any further questions or would like additional clarification regarding the charges deducted from your deposit, please do not hesitate to contact us directly.

    I am rejecting this response because:  Tennessee landlord tenant Laws of 2024 and LAET

    1-Landlord must give itemized list of damages within 10 days of vacancy.  I was not notified until 40 days later and then only when I inquired where my other $200 was from original deposit.  Landlord had my cell number and never communicated any issues/concerns.  Also when we moved out, no one was available to inspect.

    2-Normal wear and tear versus damage from references above.  Paint chips, scuff marks are considered normal wear and tear not damage.  Under Tennessee Landlord Tenant Laws of 2024 damage is holes in walls, doors ripped off hinges, broken windows, etc.  Pictures provided by landlord and shared by tenant demonstrate normal wear and tear.


    It is obvious based on Tennessee Landlord Tenant laws as well as photo evidence, i am due the balance of $200 from my deposit.
