  • Advertising Review:

    On May 26, BBB contacted Chattanooga Pepsi-Cola Bottling Company regarding a billboard advertisement located on Highway 153 in Chattanooga, TN. The billboard read “Chattanooga’s Favorite Soft Drink,” and included an image of a can of Pepsi.

    Section 28 of BBB’s Code of Advertising states the following:

    “Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved.”

    BBB asked the company to substantiate the company’s advertising through documentation, such as a recent survey or poll, recent local sales comparison, etc. or work to modify the advertising.

    BBB received an initial response from the company’s leadership on May 26, 2022, and additional correspondence on May 27, 2022 and June 1, 2022. The company indicated it had chosen to replace the billboard with another advertisement, which would display a woman drinking a Pepsi with the caption “AHHHHHH.”  The company’s leadership stated that the request for the replacement advertisement had already been submitted to the outdoor advertising company and an estimated turnaround time was June 20, 2022.

    On June 24, 2022, BBB noted that the company’s billboard had been replaced with an ad that contained a can of Pepsi along with the words “WE WIN.”  BBB reached out to the company and requested substantiation of the replacement advertising. BBB received the following response from the company’s leadership on June 24, 2022: “We were recognized internally within our market earlier this summer for performance recognition, so we did this in recognition of our Chattanooga employees as a morale builder for the hard work they do each day and the recognition they received.

    BBB determined that the company continued to advertise a superlative statement without substantiation of the claim.
