      On 11/15/2023 I met with ****, an associate from this office regarding a civil matter. Upon meeting I was told that the $195 consultation fee was waived if I retained him, so I moved forward. On Friday 11/17 I dropped off the retainer check and signed the engagement agreement.After several weeks with no update, I emailed and called the office for an update. **** called me back and did not remember the majority of what we spoke about and did not appear to have any notes in regarding to my case.On 12/26 I sent an email with my requests of the civil case based upon a phone conversation the week before. On 12/28 **** called with several questions, all of which were answered in our initial meeting and paperwork given to him. **** also wanted to rectify the situation by means of which I initially told him I was not interested in doing.On Jan 2, **** I sent email that I did not want to proceed with him due to a conflict of interest as well as taking almost 2 months and we have not made any progress.Upon firing the firm, Alexis *********************** one of the partners emailed and offered a refund of $1346.75, from initial ***** retainer. I requested full refund because I was initially told the consult fee would not be charged, and I feel they did nothing to bill me for. Although a phone call was made, an email was answered, nothing was done. I left a folder of paperwork and copies and was still asked the same questions repeatedly.As of today, 1/22/24 I have yet to receive refund. 22 days now since I spoke to ****** Espinoza who said they would issue refund. It should not take this long to mail out a check.

      I am rejecting this response because:

      Facts #4

      Perhaps ****************** needs to be trained on company policy because I was specifically told that if I was to retain his services I would not be charged the consult fee, period.

      ****************** told me that due to current case load, it would be 2 weeks, NOT 2 months before he could get to my case. If it was 2 month I would not have retained this firm in the first place as I did not have 2 months to sit and wait.

      Furthermore we met in a conference room alone behind closed doors. The office manager nor the bookkeeper were in the room when ***************** gave me this timeline.

      Again when I came back on 11/17 to leave the retainer I only spoke with 1 person in the office. 

      I find it interesting that I was given 2 weeks before work could begin, this timeline says 2 months, but within 3 days ****************** was able to start. 

      One of the reasons I fired this company was that each time I spoke with ****************** I had to re-explain everything, he had no notes in front of him and could not remember any specifics to my case. If research and/or work was actually performed on this case, 

      I should not have to provide details everytime we spoke, especially when I left a folder of documents and records pertaining to my case.

      On Jan 2 on a chain of email I provided the correct mailing address for refund twice both at **** am and 2:09 pm

      Alexis Espinoza confirmed this address at both 12:33 pm and 4:42 pm, but yet the check was still mailed to wrong address and the post office is being blamed for the company's error. 

      I also did not refuse to pick up the check, however I live 1 hour from them, and after their error they were going to send it to the correct place.

      In conclusion I'm being charged $653.25 for reviewing files I created and explaining the case to ****************** the couple times we spoke on the phone. Nothing was done.

      I understand how attorney's charge, but again no real work was performed, nothing was done.

      We stand behind our original response. We have verified with ******************** that she has received her check which represents the remaining retainer. Furthermore, a copy of the cleared check endorsed by ******************** has been provided to BBB. As far as our firm is concerned, this matter has been resolved.
