    I am rejecting this response because:

    The last section of the wall was not built as per spec.

    I spent 4 months chasing them to complete it, and they claimed issue was because other people did not pay them, yet I had already fully paid them due to constant pressure of wanting money before starting any work.

    Attached are the plans prepared by architect and handed to JNS.

    They built wall according to spec on the long length side, but did not do so on the corner.

    As you can see with photos supplied, they did the required drainage work on the long length, but nothing on the corner section.

    The work was rushed and there were seemingly unhappy with me constantly chasing them to complete work i already paid for. I don't feel as a customer I should have had to chase them for 4 months after paying in full.

    I'm not prepared to pay them a cent further, as I've not wasted over 8 months in total with company and now also have relay my whole lawn at considerable cost due to time lost with this company.

    When we first spoke, **** said we'll probably need one more pallet of retaining blocks at a cost of $800.

    As I have drainage pipes and well buckets, and 1.5 bags of 57 stone and loads of retaining wall ***** they can use all of that to fix this wall. They will however need to do the footers the same way as the engineers spec with concrete and rebar. I also have enough rebar for them onsite already.

    As an olive branch, I'll be prepared to pay $1000 only if this work is completed by end of May 2023. I have already logged this issue with ************** Attorney General too, and will escalate that if this is not acceptable by JNS as I'm not longer prepared to waste more time and effort with this company.

    This response was provided verbally to BBB.

    The business will fix the wall for the customer for the price of $4000 instead of the original quote. The reason the wall is collapsing is that drains and the grading were installed wrong and the business did NOT perform the work.

    The customer got a 70 wall quote later added another portion and ended up with almost 95.  

    Wall was not engineered because wall is only 4 in height.  Due to the unstable soil/back fill he had. 

    I recommended concrete footers as a solid base and G.O GRID. During this process we were stopped due to  his HOA counsel till all work was documented. 

    The wall was never engineered. The engineer **** and documented the plans based on what I was doing. Everything we were doing was on point and no changes were added or made by the engineer since everything was getting done right. 

    So engineer **** plans based on what we recommended. We did dot follow any engineer plans to build wall. 

    The portion that is sinking was also added later additional from the 95. 

    The customer did not wanted to spend the extra money and STATED that the area was shallow and just to build the wall like a traditional wall. 

    This portio was not on the original quote. 

    We can not warranty the repair of the wall because we did not do the finish grade of the yard. 

    Drain/ flow was not done correctly so this is the cause of the wall sinking. 

    NOTE. Portion of the wall with this issue was added later outside of the original quote. 

    There was no contract signed. It was all verbal agreed.
