    Business is refusing to honor a warranty and contract that was signed under the previous owner/father. Charging us $865 for a part that is under warranty. We still have the contract and the messages from the owner. When asked why we were being charged the amount we were before the work was done. He threatened to get a lawyer and file charges against us. At that point he refused to do any work for us he stated he is allowed to charge whatever he feels because it is his company.

    In regards to the equipment:
    The original homeowner is not the current homeowner (as evidenced by the invoice submitted by the current homeowners).
    The original homeowner did not file the warranty (as evidenced by the blank warranty certification form submitted by the current homeowners).
    The original homeowner is deceased.
    The equipment has not received regular maintenance.
    The capacitor has been replaced twice, which is not uncommon to need replaced every couple of years.
    The warranty for the compressor is five (5) years for the original homeowner.

    The warranty certification clearly states, under the section labeled “Other Applications”, that the warranty is to the original owner only and is not available for subsequent owners. My company was going to file the warranty under the original homeowner’s name for the compressor, even though this puts a liability on my company with the manufacturer. The $865 cost proposed was to cover the cost of the warranty handling fee, shipping/freight, labor, and recharging the system with freon. The warranty itself only covers the cost of the compressor. The freon existing in the unit is considered contaminated and cannot be used without risking further damage to the unit. While attempting to explain the cost during our verbal phone conversations, the homeowners became agitated, belligerent, and threatening. I, then, declined to perform services without payment upfront, as we have the right to refuse service. My company does not engage in this type of behavior and risk of non-payment. I informed the homeowner that they were more than welcome to contact any other company to perform the services.
