On May 4, 2021, I paid for my 1 year of termite treatment in full, $230.52 My account #XXXXXX. A renewal contract is not signed each year. The last one signed is attached, June 2019.This contract runs from 6/11/2021-6/11/2022. On June 18th, I called the office and spoke with Vanessa. I explained that we put the house on the market and our pest control was paid in full. We also discussed the CL100. She advised that once house sold, call her back, they would pro-rate and refund funds. On August 4th, when we closed on our home, I called the office to notify them that we had sold the property and we wanted our refund only to be told by Susie, a very rude woman, that we would not be getting a refund. The funds should have been transferred at closing from the buyer to us. Well, the contract clearly states, that it terminates upon sale of property and they MAY issue a new contract to the new purchaser etc etc. I feel this is theft as the contract is now void. Please help me get my money.

      Business response

      10/26/2021

Business Response /* (1000, 9, 2021/08/23) */ Mrs ******* did call our office to have a cl100 inspection and she did speak with a representative that has been with us for 8 plus years and sadly miss understood that we do not give pro rated refunds once coverage has started. The agreement she is referring to is a renewable agreement and only can be cancelled with written notice which she did not give. She paid her renewal every year and received her coverage as such. In the written contract it doesn't not state that we must prorate or return any funds of such kind but doesn't state that we can not. We have since revised this contract. We have informed Mrs ******* that when we received her 30 written notice of cancellation we will then at that time mail her a refund check for the balance on the renewal. Mrs ******* did not recieve the answer she wanted to hear but it is and was always company policy. I (Dewey B******) assured her that we wanted to satisfy her as a customer even though she was leaving our company since her house was sold. I have ordered a refund to her and will be mail here shortly in the coming days. Consumer Response /* (3000, 11, 2021/08/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) Just to clarify, I left numerous messages for him to contact me and he only did so after I blew up his social media page with a bad review of his business practice. I did inquire about an inspetion as I was told it needed to be done at my expense only to find out that our attorney firm supplies it at half the cost of this business. He did not want to refund my money at all, and only did so after I recited his own words from his contract to contradict what he was trying to say. I was not in agreement with anything he said but he stated that if I was holding him to his contract then he was going to hold me to a 30 day written notice. I would appreciate keeping this claim open until I receive such refund to see how it is broken down. thank you
