    Prior to the expiration of my home warranty. (1 year). I had an inspection done by a home inspector. The inspector notated that the grading in my yard was done improperly. This with other items were listed and sent to Creekside Homes LLC. The company acknowledge receipt of the same. Creekside Homes sent out three employees completed some of the repairs and all agreed that the drainage/grading in my yard was done, improperly, and should be corrected. Creekside Homes strung me along for the last several weeks, today they advise me they were not going to correct the flooding and improper grading they created on my property. The improper grading has created, standing water that is a breeding ground for mosquitoes, and has the potential to cause other health issues. Furthermore, after advising me that they were not going to correct the situation that they caused. *****, one of their employees attempted to get me to sign off that they completed the repairs to my property. I advised him that I would not sign the paperwork since all the repairs had not been completed and that I would be seeking counsel today. (sadly, ***** was one of the individuals that agreed that the drainage/grading needed to be redone). Creekside Homes LLC, in my opinion, has failed to stand up to their warranty, obligations on the property that I purchased from them.My expectations:Is to have the ***************** graded the grass that has died from root rot due to water damage be replaced and Creekside live up to their warrantys. I do not wish any monetary compensation, or other compensation I just wish Creekside Homes LLC to meet their obligations and correct the grading/drainage on the property.     Lot 18 ****** Place closed on 6/13/2022. The  NON-WARRANTABLE CONDITIONS-portion of the Purchase Agreement, signed by ****, paragraph 16. DRAINAGE AND ALTERATIONS TO GRADING, states,
    "All yards will be graded to drain away from the house.  There can and often will be standing water in drainage ditches and ******.  The homeowner is responsible for maintaining their portion of any drainage structure (ditches and ******) by keeping them unobstructed and by maintaining the grass to avoid erosion.  Grading and drainage are not covered by any warranty, nor will they be modified by theSeller after closing in any way whatsoever.

    The contract goes on in Paragraph 17.  LAWN AND SHRUBS, states:
     "....The Seller will not regrade a yard, nor remove or replace any shrubs or trees, except for those that are noted as diseased at the final inspection." (pre-close walk through).

    The pre-close walk through (on 6-14-2022) Punch List had nothing on it about the yard. **** signed off on the Certificate of Acceptance at Punch List Completion on 6-14-2022.

    Items 1 and 2 that **** listed on the The One Year Warranty Request form about the grading/draining, do not belong on the warranty request as they are not warranty  items. . 

    No drainage pipe/tile under the driveway because Horry County did not require one since this lot is the high point for *****************.  Horry county is the permitting agency for driveways along ****** Road. 

    The home inspectors report states it "reflects the opinion of the inspector".   The inspector is giving his opinion on the matter   SCLLR is the governing body over home construction in **   They state that any water standing after 72 hours is an issue and should be made ti drain properly   The attached picture was take 8-1-2023 at 11:26 am   The area received an 1.5 inch rain over night on 7-31-2023   No viable water was standing at the time of the inspection .

    No one from our office has "agreed or told the homeowner that the drainage/grading in his yard was done improperly and should be corrected." 

    We have repaired all of the other requested items.   No further action is required from our office.

    I am rejecting this response because: I was told by my agent that the deposit was at the discretion of the owner, in being returned. I trusted them. ( My mistake). I was told by the property manager ***** that Creekside was upset because I had to continue to change the closing date and that they was missing out on good summer selling months that the home could sell. I was advised by my agent to write them a letter explaining situations and to possibly let them put house on the market to see if it would sell and then take my $5000 and put it toward another Creekside home. They cancelled the contract and kept my money. I also signed the extension But they would not accept it. I want my money returned.

    1. Contract for lot 6 King ***** was signed on 6/5/2023. Their property in ** was to close by or before June 17, 2023.    6 King **** was to close  on or before June 21, 2023.


    2. Then their property in TN was not going to close until on or before July 19,2023, so an extension was given to them.   6 King **** was scheduled to close on July 21, 2023, the CD was completed by the Attorney and approved by all parties.

    3. Then the Buyers agent received a voice message from Hall, which he forwarded to 
        Creekside's agent.  It stated there was a delay in the closing of their property in TN, and they needed another extension until August 8,2023.
       An Addendum was done granting this extension, and sent to ****** agent for them to sign.

    4. Instead of receiving that Addendum back from Hall, her agent forwarded this email to us:

My homes at ****/**************************************** have a binding contract but they will not close until sometime in September because of an important paper that we are waiting on. The finance company, can't complete the loan until they have the signed, stamped and certified copy of the plat at ****/***************************************** The surveyor, *****************, has completed the moving of some plat lines at the said property. The documents then are turned in to Knox County to be reviewed. At the present time we are number 5 in line to be reviewed. After it is reviewed it is then presented to Knox County planning commission at a meeting that only takes place, once a month, generally around the 10th of the month. Because my paperwork is still in the review process I will not make the 10th of August meeting . It will more than likely be the 10th of September or at the September meeting. Once it is reviewed, gone to planning commission, signed, stamped and certified, the loan processor can then complete the loan and we can close on said properties. 

    5. Creekside then sent a Release of Agreement to ****** agent for them to sign.
      The Purchase Agreement the Hall's signed, paragraph 5. PURCHASER'S FINANCING ARRANGEMENTS AND DEPOSITS...............
    "...........All deposits are nonrefundable when paid.....".

    It was a deposit paid to the Seller, Creekside Custom Homes LLC.  It was not ******* money.

    Creekside has worked with them, granted extensions, and has been bearing the carrying costs of the property.

    Our Contract is a legal and binding Agreement  states the following with respect to deposits:

    Paragraph 5. PURCHASER'S FINANCING ARRANGEMENTS AND DEPOSITS:......"All deposits are nonrefundable when paid.....".  "Deposits can be used to defray the costs.."
    What may have been discussed between her and her agent has no bearing on the agreed to terms in the signed Contract.
    Hall may be confusing it with paragraph 3. CLOSING. , "the Seller's per diem interest carrying cost", in the event closing does not occur by the scheduled date......".
    When the Seller accepted this Contract, the closing of Lot 6 King **** was to occur on or before June 21, 2023.  Creekside Homes occured extra  carrying costs on this property since that date.

    **********,  ***** our sales agent  is not the property manager. She is not involved in conversation with the Seller, and therefore could not state what the Seller thought. All communictaion has been between ************ and her real estate agent.   

    In ***************** email of July 19, 2023, stated that she was going to have to cancel the contract, since her other property was not going to close until "some time in September".  The extension that had been done and signed by all parties on 6/16/2023, was to July 19, 2023.  The Contract expired at midnight on July 19, 2023.

    I am rejecting this response because:

    I spoke to *****, last week and that is the information she gave me. She stated the "seller was upset because they feared my home would not close and he was missing out on good selling months". That is exactly what I was told! Based on the information from my agent and from ************ thought I was doing the right thing. I even suggested that the $5000 be used toward another property if the seller wanted to sell that one so fast.Of course, it's still on the market. The seller would not even discuss further options, he wouldn't even come to an agreement so that everyone was happy.  I signed the extension, I have no idea when my agent sent it. Most businesses want to maintain a healthy relationship with their clients, word of mouth can either help or destroy a business. I will not stop until my money is given back.

    I am rejecting this response because: There are many inaccuracies with Creekside's response. 

     

    Creekside stated we did not notice the window at our final walkthrough pre-closing, which is correct. However, the contractor stated I took months to notify them about the window. That is incorrect, from the date of closing which was April 12, it was 31 days after. My first text to **** with my window concern is dated May 13th 2022 (See attachment). 

    Secondly, Creekside states "We offer to change it to be centered on the dining room". He refused our offer to change it out. He instead stated the window could stay but he wanted $2500.00 instead to leave it as is." This statement is also completely inaccurate. When **** reached back out to me for the window, he gave me two options. 1) replace our current window with an 8 inch smaller window that will not be centered. I refused because I want it centered.  2) He than came back and offered a window 12 inches smaller, but made me aware that it will be the closest but still not centered. I refused this as well because I want my original size window centered correctly in my dining room. (See attachment of text message photos below). **** did not say this, but I know the reasoning for wanting to put a smaller window is so they do not need to redo the framing work from the original window.  

    In regards to the $2500, I did not ask for this amount so again Creekside is incorrect. After I refused both offers that **** gave me, I asked for $2400 (See attachment) so I would be able to outsource the work to keep my original window centered.  He denied my request.

       

    The response that Creekside made to BBB is as if they agreed to recenter my original window. If this were to be true, I would have agreed to this because this was my intention from the beginning. I have logs of text messages that shows they did not want to center my original window and also myself stating several times that i wanted to keep the original window but want it centered. **** made me feel like my only options were to downsize window size which would still not be centered. As a consumer of Creekside LLC, I deserve to have the same window size and centered window as everyone else in this development. All I want is for Creekside to center my original window.

    pictures in/out of other homes which i got okay to do so from neighbors. May 13th 2022 at 11:10am I contacted the project manager **** *****. He answered me on June 1st 2022 that he can come by to see my window on Thursday June 16th 2022. June 8th 2022 he was in the area and decided to come by to see my window and **** agreed that it was a framing error and didn't look good.June 10th 2022 **** ***** contacted me advising me that he spoke with owner ***** ****** and he was willing to change out the front dinning room window for a smaller size window of 12inches, but it still would not be 100% centered. This did not interest me being i'd be the only home with a smaller size window and it still would not be centered. Clearly he knows there was an issue with the window if he was willing to change it out, the reason for him not recenter the original window is because its a big framing job where you need to recenter the window header. Not mentioning you have to remove and replace siding, sheetrock, plastering, sanding and painting. I still considered it but after much reflection I disagreed with that being said that I paid for a home that came with this size window and i want my home to be as i was promised. Contract says that there can be a variation in size up to 2-3 inches which i'd be able to live with but not 6 inches.June 13th 2022 I sent **** a text explaining that we do not agree with what ***** was offering and haven't heard from **** until July 6th 2022 when i reached out asking for a credit instead so i can have it fixed on my own. He answered me back on July 27th 2022 asking how much i was asking for. I told him the price and August 23rd 2022 he replied that ***** did not agree to the price, I asked **** to ask him to counter or to reconsider centering the window with the same size. Today we are April 2nd 2022 and have never heard since

    Mr ******** did purchase a home from ** in April 2022.  We had a preclsoing walk thru and nothing noted on the window being off center.  Some months after him living in the home he did contact us about moving the window.  We offer to change it to be centered on the Dining Room.  He refused our offer to change it out.  He instead stated the window could stay but he wanted $2500.00 instead to leave it as is. We are not interested in paying this.

    I am rejecting this response because: Im very disappointed in the action that Creekside has decided to take. Its obvious that the craftsmanship is not important to Creekside. It clearly shows that when its not in there favor they close cases, why would i accept to downgrade a window size due to a framing error as well as a project manager error not noticing this while the house was being built. They have my money now and not interested in rectifying the issue with my original window because they know its a big job and they expect me to pay that after i purchased a new home.

    The customer does not want us to change the window and we are not going to pay him $2400.  There is nothing more to respond to.  It is an attempt to extort us for money.  The window will be ok if the money is paid.  The customer paid for a 3/0 5/2 twin window, which was installed.   Our contract states that measurement may be field adjusted.

    For the last year creekside homes, builder of our home ( project manager Jeff D**** and sales person Jillian pursley) has promised a drainage system behind our home and the other homes on our block. The problem is when it rains ,water pools and floods our back yard. You can't walk without sinking in foul smelling mud and can't mow the grass. Jeff D**** has been promising to fix the problem but has not. At one point he said they couldn't afford a system. The oily looking water is multiplying mosquitoes. I'm worried pets drinking this water will become sick. There is a 20 foot drainage easement behind our home which would allow room to put in a French drain. This is what I am asking. This is a small community and the builder has almost completed development and I am worried when he is finished he will leave without correcting the problem.

    They installed a swale instead of a French drain.this is the cheapest thing they could do.we will have to wait and see if it works. At least one of our sprinkler heads does not work.this was caused by the intire area being covered by sand or the heavy machinery used to build the swale.

    We will go check the irrigation head. The homeowner contacted Horry COunty Stormwater. We meet and the county told us what to do to correct the issue. We meet with Horry County yesterday on site to review the repair. They asked for one area to be regraded. Once we complete this we will be finished with the repair. No french drain will be installed. The property has 14" of fall from the back yard to the front.

    They didn't install a swale that would help. What they did was create a bog where you can't walk or mow the grass.The problem is the extremely high elevation of the homes behind us. The runoff from these properties is the problem. Creekside didn't create a swale across the back of our property where it is needed. It needs to be about a foot deep and extend across all of the properties on our block. This is the reason why they have a 20 foot drainage easement behind all these homes.
