    On Saturday Jan 14 I met with ** ***** to view his townhouse in Wellstone! I got the application completed it and returned it along with giving ** ***** $100 zelle for his application fee on Monday Jan 16. ** ***** stated that I did not have to do a background and credit check because he knew some of my family! He then contacted me later that day and told me I was approved.I have everything that I am explaining in text! On Monday Jan 16 ** ***** and I met up and I gave him a $1000 money order for the security deposit, then agreed that I would put the other $1100 in his UPS drop box because he was leaving to go to Jamaica Tuesday Jan 17 and that’s exactly what I did. Then after speaking to him on Thursday Jan 19 about when I could move in etc he stated if I moved in the middle of February I would be responsible for March rent and February rent which would be prorated. ** ***** never notified me about paying March rent in Feb which I also thought was his way of getting over on me! I have all of our conversations in our text messages! My current landlord and I discussed about me staying until July due to the fact that my son who’s an high school athlete would not be able to stay at his current school so therefore he is willing to let us stay at our current address! I contacted ** ***** on Wednesday Jan 25 to let him know that I would not be moving in again and he at first tried to get over on me again by telling me that my deposit would not be refundable but I never signed nor agreed to anything! I asked him to provide any type of documentation and he stated he would return my deposit within 30 days in the mail. I’ve asked him several times if I could meet him or come by and get it and he still is telling me he will mail it! On Thursday Jan 19 he had stated he had no problem returning my deposit to me if I didn’t agree to paying the Feb and March rent at the same time. Being that I’m not moving in now he wants to try and hold my deposit which is against the law.

    After reviewing the complaint, my response is as follows:

     

    On 01/17/2023,  *** ****** secured a rental property with an option to lease deposit of $2000.00 fully aware that if she moved in late in the month she would need to pay the prorated days of the current month and the following month.

    It appears she decided to make other living arrangements while she held up this rental for 11 days making other arrangements; costing the owner rental income. The property was vacant and we had plenty of interest in this property with prospective tenants.

     

    Although it is within my rights to hold the deposit for 30 days, I refunded it in full on 01/31/2023 (Six days after she notified us she would not be moving in).

     

    Her complaint is not supported and invalid. More importantly, I would like to point out, we went out of our way for her because she was a relative of someone we knew and she expressed she needed help because her current landlord was raising her rent too high and she had nowhere to go.

     

    I would like to reiterate, *** ****** notified us she would not be moving in on 01/25/2023 and her refund was mailed out in full on 01/31/2023.
