    I am being charged $300 plus dollars for the property manager from Elite for fixing my railing to the third floor. This is the second time because the first time a poor job was done. By law a tenant is not supposed to pay for normal ware and tare. I have multiple pictures of how the first attempt went which cause them to have to come out and fix it again. Not to mention they still used the original railing from when the house was built. I Also had to wait months for them to even come out and fix it.

    It was admitted by the tenant to the technicians that the son fell on the handrail, which then ripped the brackets completely out of the plaster wall.

    To BBB,I rented a townhouse from Elite in November 2019 and paid a substantial deposit of $2,025, equivalent to 1.5 times my monthly rent. I remained a tenant with Elite for over 4 years, and our lease concluded in December 2023.Despite fulfilling my obligations as a tenant, Elite Property has refused to return my full deposit. Instead, they deducted $937 from the $2,025 they held for an extended period of over 4 years!Here are the key points of concern:Lack of Explanation:- When Elite returned $1,088 to me, no explanation was provided for the deduction.- I had to follow up with them to understand the specifics of the withheld amount.- Elite claimed deductions of $450 for cleaning and $477 for touch-up paint.My Efforts:- I meticulously cleaned the unit before moving out, leaving it in excellent condition.- Despite this, Elite still deducted a significant amount for cleaning.Inconsistent Evidence:- Interestingly, after my lease ended, the house I rented from Elite was put up for sale.- Upon reviewing the listing photos, I noticed that the unit remained in the same state as when I vacated itno additional cleaning or painting had been done.- This raises questions about the validity of their deductions.My Claim:I firmly maintain that unless Elite provides proof of the cleaning expenses, they should return the deducted cleaning fee.Regarding the paint deduction, it should be refunded, as no such work was carried out.Attached Documents:Leasing contract with Elite.Communication records during the move-out process and deposit settlement.Photos of the unit as listed for sale, demonstrating its unchanged condition.I kindly request your support in resolving this matter. Elite Propertys actions have left me unfairly deprived of my hard-earned deposit. I trust that the BBB will investigate this issue thoroughly and ensure a just resolution.Thank you for your attention to this complaint.Sincerely,*********************

    We appreciate the feedback from *********************, and in response to the concerns he raised we provide the following explanation.

    ********************* was a good tenant who lived at ***************************************** since November 2019. Upon move out, Elite followed the lease and standard cost deductions. ********** brought up two deductions of cleaning and touch up painting. Both are covered in the lease and cost sheet. 

    For instance, in section 1.6 of ************ lease (he provided the lease already so I did not also provide it). The lease states the following:

    Landlord can take money from the security deposit to pay for any damages caused by Tenant, Tenants family and Tenants guests. Landlord may take the security deposit to pay for any unpaid rent or other charges. ****** agrees to thoroughly clean the entire premises, including all appliances, fixtures, lawn care, and snow removal. If carpet exists in the unit, Tenant is responsible to have all carpeted areas professionally cleaned (with receipt for proof). Any carpets not professionally cleaned will be charged a fee of $100.00 per area (room, hallway, stairway, etc. if deodorizer is required, additional fees will apply).

    In ************ home carpet exists on the second floor of the home. Carpet areas are the living room, stairwell, three bedrooms and a hallway. ********** did not submit a receipt that the homes carpets were professionally cleaned. Elite could charge $100 per area. This would be a total charge of $600 as there are six areas listed. However, the charge to Elite was $460 and passed on to the tenant.

    As for painting, the home did not need to be fully painted so touch up paint was the only charge. A total of 550 square feet was needed out of 1600 square feet. For this ********** was charged $477. Again this is outlined in section 1.6 which states Landlord can take money from the security deposit to pay for any damages caused by ******, Tenants family and Tenants guests.

    Last, I know ********** saw pictures online of a listing in which 544 ****** was up for sale. However, those pictures were taken by another company who listed the home after ********** moved out. Those pictures do not represent Elite Property Management or the work done by hired contractors or vendors.
