    Business Response

This customer has been a customer/consignor for some time now and has been fully aware of our policies and procedures that we implement in the store. In January she sent a message asking about her consignor balance (which typically has to be called in, EVERY consignor knows this!) at which I let her know there were no funds on her account. How our system works is once the items sell and post to the account, thats when funds are available and can be let known to consignors. At no point did her items sell and we deliberately lied to her and told her she had no money. Prior to this time, she purchased items off of our live show, which totaled $64. After sending her an invoice to pay for her items she claimed, she failed to pay after multiple attempts. We have a policy in place that ALL consignors are aware of (that also is just common sense) that states if you willfully leave the store stuck with an unpaid invoice (which she did) you no longer have a valid contract with us and you forfeit all funds and clothing left in the store as this leaves the store stuck in a negative. We were gracious enough to not void her contract at that time in hopes that she would make things right and pay for her items, but she did not, even after associates in the store personally reached out to her to let her know she had an unpaid invoice. So, as soon as funds were available in her account our store system flagged her account & made us aware she was a consignor who violated our policy of leaving us stuck with an unpaid invoice. I made her aware of this and she became irate, threatening to report us to the BBB (which she did) when we have done nothing wrong to her. At this time, I made her aware of the policies on the contract she signed and formally sent her a termination of contract as the relationship is no longer beneficial. Her complaint stated we told her we disposed of her items which is completely false. Not once was she told that, she was however made aware that items that arent freshly laundered and have stains (per the contractual agreement) cannot be sold in our store. Many of her items were not up to our stores quality standards therefore explaining why she did not have the funds she was expecting on her account. Out of all fairness, why would she expect to receive money from us when she knowingly purchased items from us and chose not to pay for them? Im sure no customer would ever be able to receive merchandise from Wal-Mart without paying. As far as her receiving payment when she is not present in the store, that was a policy we bent and made an exception for a few times for her due to her circumstances but as of 2024 we no longer make exceptions as weve noticed they tend to cause customers to do irrational things such as this. At this moment there is no refund this customer can receive as she violated the store's policies. Per our store policy, we do not offer refunds of any kind & also stated on the contract she signed, we do not return any items back to consignors. She would also not be eligible to receive any consignor funds as she had an unpaid invoice from the store. At the Harvest we value the golden rule do unto others as you would have them do unto you therefore we put policies in place to ensure fairness.
Attached are the stores consignor agreement that all consignors sign prior to consigning with us, store policy posted in store, and termination of contract sent to consignor.
Thank you and have a wonderful day,
    The Harvest Consignment
