  The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

  On January 14, 2025, the Pennsylvania Attorney General's Bureau of Consumer Protection (BCP) announced it had entered into a settlement agreement with Sundance Vacations, Inc., for alleged violations of Pennsylvania's Unfair Trade Practices and Consumer Protection Law.

  Specifically, the Assurance of Voluntary Compliance (AVC) settled allegations that the company:

  • Misrepresented the overall price of its vacation packages.
  • Misrepresented product values in comparison to competitors.
  • Failed to provide consumers with adequate opportunities to review written materials and otherwise engaged in high-pressure sales tactics.
  • Misrepresented sponsorships from various third-party entities.
  • Misrepresented the characteristics of sweepstakes prizes.
  • Misrepresented the nature of accommodations available through its booking systems.
  • Made false statements of fact concerning promotional or limited-time offers.
  • Failed to fully disclose its policies regarding canceling consumer contracts.

  To resolve these allegations, as part of the settlement, the company agreed to: 

  • Disclose, upfront, all costs associated with travel packages.
  • Provide certain eligible consumers with the opportunity to cancel their contracts.
  • Send a written notice to consumers eligible to cancel their contract and any outstanding financial obligations to the company.
  • Provide a written Notice of Cancellation to Pennsylvania consumers who purchase a vacation package.
  • Implement enhanced measures to train and oversee sales representatives to ensure compliance with the AVC.
  • Adopt and implement enhancements to its current policies and procedures and assign quality assurance officers to enforce them.
  • Retain business records related to vacation packages sold to Pennsylvania consumers and make them available to the BCP.

  The settlement also requires the company to pay $500,000 in civil penalties and restitution and $100,000 to cover the costs of the investigation.
