In March of 2022, we signed a contract to have a deck torn down and a new one built by Dan D******, co-owner of Able MC LLC. The work was supposed to be completed in a time frame of 14-15 business days per his contract. Work began on June 20th, 2022. From the beginning, we were concerned about the pace and quality of work. My husband pointed out obvious errors that Dan acknowledged and attempted to fix. But it was becoming clear Dan was not cut out to complete the scope of work in the time frame he agreed to and the quality he assured us we could expect. On business day 20, Dan requested more payment despite not being halfway through completing the scope of work and having already received 75% of the total payment. We had already paid the three installments (25% each time) based on the contract. We refused to pay the fourth installment on day 20, because according to the contract it should be paid upon completion and the deck was not nearly completed. The next day, on July 16th, Dan terminated the project after we had already paid him $20,737.50 of the $27,650.00 of the agreed upon amount. The only thing he 100% completed was the demolition and removal of our existing deck. He left material behind, but there is about $4k worth of material, including the ****, needed to finish the deck. There are some **** placed and a small piece of handrail installed, but because the underlying framing isn’t done right they will need to be removed to fix it. When we demanded a refund of 10k by July 20th, we were denied. When we asked for the missing material to be brought to us, he told us he would bring it if we paid him more. Obviously we declined. In summary, the problem is we paid 75% of the total for the deck, but the deck is maybe 30% complete. Dan breached the contract by exceeding his timeline and then terminating the project before completion.
