I paid the business $455 plus another $50 for membership and swim lessons. We have been to the pool twice in the three weeks since we paid for this. My son is only 4 and I bought the membership not realizing that there is only one area of the pool he is allowed to swim in unless he can pass a swim test which is very hard. At every other pool parents are allowed to take their children into the pool. This pool is very odd in that it has a horseshoe shaped shallow area and the children cant go past. I found the pool to be very dirty and the staff unhelpful. Other pools let you try the pool for a day before purchasing a membership. We were not given that option. We are living on snap benefits and ********* $500 is a lot of money to us, and I have asked the staff 4-5 times for money back but they have not responded. I am requesting a full refund.

    Business Response

    Date: 07/11/2024

In response to Kara **************** on the application form she signed on 5/31/2024 it states No Refunds.  We have 3 pools  that are available for her son to swim in.  The main pool, which is circular has a catwalk around the inner circle to keep children that have not passed their swimming test to keep non swimmers out of the deep water that starts at 5 1/2 feet to 12 feet of water. A  children that have passed their swim test are given daily wrist bands that identify them to the lifeguards that the a swimmers and passed the test.   This was the section of the pool that her son wanted to go in.  I don't know why you would want a 4 year old non swimmer to go in that deep of water.  An adult could hardly stand on the edge of that section of the pool.  The outer circle goes from 8 inches to 3 1/2 feet.  This section is used by both non swimmers and swimmers.

The second pool is for 6 and under.  This pool goes from 8 inches to 2 feet.  The Third pool is an L shaped Olympic racing pool that goes from 3 1/2 feet to 5 feet of water with a diving well at the end of the L.  Every other hour we allow a non swimmer accompanied by an adult in that pool.

We are concerned for the safety of both the swimmers and non swimmers.

She also stated the pool was dirty.  Early in **** you had the pods dropping from the trees that blew into the pool.  During that time we have the lifeguards walking around the outer section of the main pool to remove the pods floating in the water.

Shae had requested a refund and the office told her there are no refunds and would have to be taken to a Board meeting.   This was discussed at the board meeting on Monday, **** 10.  ********* discussed the matter and agreed to give her a $220.00  refund despite having a No Refund  stated on the application she signed.  Check #**** was disbursed on **** 11 for $220.00  which cleared our bank on **** 17.

If you need any additional information you can contact *******************, treasurer  of the organization at ************.  Sorry I did not respond sooner but I was on vaction.
