My name is **** ******. On July 1, 2023, I purchased a $150 gift card from Modrn Sanctuary for my mothers 70th birthday. Unfortunately, due to her declining health over the past two years, she was unable to use the gift ******* September 2024, I called Modrn to confirm the validity of the card and was assured that it was still active and could be used in the future.About a month ago, I went online to book an appointment for myself with the intention of using the gift card, as my mother can no longer benefit from it. To my surprise, I discovered that *************** had closed, and a new companyVyve Spahad taken its place.Last week, I contacted Vyve Spa and left a voicemail. On Thursday, August 7, 2025, I received a return call from a gentleman who informed me that Vyve Spa is not affiliated with *************** and that they would not honor the gift card. He provided me with your email address and advised me to reach out directly. After doing some research, I learned that Vyve Spa appears to be a rebranding of ***************, as both share the same address, phone number, and web redirection from Modrn to ****. Given these circumstances, Im writing in hopes that this issue can be resolved.I am requesting a full refund of $150 for the unused gift card. Attached is the original purchase receipt for your reference. On 8/25 Vyve responded: Please note that Vyve Spa is not involved in anything related with gift cards issued by Modrn Sanctuary. Any emails pertaining to them will not be read by Vyve personnel, thank you. As of today 8/26, I still haven't heard back from Modrn/Alaxandra.Vyve Spa: **********************. ****************** ***************, Pa ***** Modrn Sanctuary: ****************************** // same address.

Upon addition research, I located the owner of ****************

    ********* Janelli

********* now owns THETA Spring located at ****************************************************************************************************. ************************   *************

Vyve Spa and Theta Spring share the same phone number and both are located in the same building.

I sent ********* an email 8/26/25. As of today, she hasnt responded. ************************

We at Vyve Spa appreciate the opportunity to clarify the situation.

    Business Structure
Vyve Spa is a separate and independently owned entity from *******************************************. While **** currently operates in the same physical location formerly occupied by *************** ************, it is a distinct business with its own LLC, EIN, ownership, and operational policies. Vyve is not a rebranding of *************** ************. These facts have been mentioned to Ms. ****** in various communication channels.

    Nature of the Complaint
The gift card in question was purchased from *************** Philadelphia in July 2023, more than 2 years prior to the time of this writing. As such, this is a matter between Modrn Sanctuary Philadelphia and the client. **** is not responsible for honoring gift cards sold by a separate business entity prior to its formation. Vyve received no financial benefits from the proceeds of the gift card issuance in question. If Vyve is to honor the gift cards, it would essentially have to provide the service for free. Likewise, Vyve is in no position or has obligation to provide a refund.

    Client Notification

To the best of our knowledge, several emails were sent to Modrn Sanctuary Philadelphias client list, by Modrn Sanctuary,  prior to the business transition, explicitly stating that gift cards issued by Modrn would not be honored by Vyve. We cannot control whether or how those messages were received, filtered, or viewed by the recipient.

    Clarification on Website Reference

The Vyve  and Modrn website may reference the locations previous identity as Modrn Sanctuary solely for the purpose of continuity and clarity for returning clients seeking wellness services at the same address. However, Vyve is not affiliated with or a continuation of Modrn Sanctuary.

We hope this clarifies Vyves role in this matter. Should you require further clarification, we are happy to provide it.
