    I represent the interests of the Eastern Viking Band Aides and ****** ****** in connection with the above matter. The purpose of this is to direct your attention to significant breaches of the contract entered into for transportation services on November 2, ******* you should be aware, On or about August 29, 2024, my clients ordered three (3) charter buses from Wertz Motor Coaches for transportation from ********, **, to *******, **, to attend the Atlantic Coast Championships at ************. The contracted services, were to transport the members of the award-winning Marching Band students, their Staff and their Parents. The contract was fully prepaid by my clients in the amount of $7,587.60 (3) charter busses were to be equipped with functioning Wi-Fi and Air Conditioning.Unfortunately, Wertz Motor Coaches failed to uphold its contractual and service obligations in the following ways:1.Failure to Provide Third Bus:Only two (2) of the three (3) charter buses arrived as scheduled on the morning of the trip. The third bus failed to arrive at the designated 8:00 AM report time, and no replacement was provided that could meet the required 11:40 AM arrival time in *******, **. As a result, the passengers assigned to the missing bus were forced to arrange last-minute alternative transportation to and from *******, ** at their own expense Defective Amenities on Provided Buses:One bus, the Wertz bus, lacked functional air conditioning, Wi-Fi and working power strips for the entirety of the trip;The other (subcontracted) bus lacked functional Wi-Fi for the entirety of the trip. On 11/15/24 a letter was sent to the company for a refund. None has been provided. My clients simply want a refund as follow. A full refund for the third bus that failed to appear ($2,529.20).Partial refunds for the two buses that failed to meet agreed-upon amenities ($505.84 each).A full refund of the cost of transaction fees related to the third bus ($59.12)
