We received your complaint notice in regards to Mr. ******* ******, case# BCP-************.

On 2/18/2024, we were called by Pennsylvania State Police Troop A Somerset Barracks (PSP) Trooper ***** to
assist the ********** with removal of a truck and trailer from the tracks in *************. Per the dispatcher at PSP, They
suggested traveling to site prior to taking any equipment as it was noted that a helicopter would be needed to remove
the truck as to where it was located. *** used a rail truck to transport staff to the truck as it was down the railroad
where no vehicle would be as there was no road there. It was explained to staff that a train had come through early that
morning and seen the truck sitting beside the tracks at a crossing beside a stack of railroad ties and the truck took off
alongside the tracks when it seen the train chasing it. Truck was positioned off a bank along the tracks blocking safe
passage of all trains running that line and CSX had to shut the track down for 6hours until the truck and trailer was
removed. Options to remove was debated but due to the warm weather and a recent snow storm, the ground was too
soft to try any equipment as the 4x4 wrecker has sunk in the mud and was unable to get back into the truck and bringing
in big wreckers to lift the truck over guiderails and the ravine meant RT 219 would have to be shut down requiring the
States assistance. The simplest passage to the truck was to request passage through a nearby farmers tractor trail and
crossing the *************** which required a vehicle with tracks. Decision was made to bring an excavator with tracks in
to cross the farmers trail with the least amount of property damage to drag the truck out to solid ground and a second
trip for the tilt-car trailer Mr. ****** was hauling. Mr. ******* bill was under $10,000 when initially towed. He was charged
for the assessment and for the excavator and truck to haul it as well as the rollback for his truck and a wrecker to tow the
trailer. The entire removal process took 6hours including travel time to scene. Mr. ******* girlfriend ****** ***** was in
contact with Friedens Collision Center (FCC) 2/20/2024 and informed the total bill at that moment was $7,225.00 with
daily storage added. Mr. ******* Mother contacted *** 2/20/2024 inquiring as to why the truck was towed. ********************************* called 2/21/2024 inquiring about the bill; it was relayed to both why the equipment was necessary as their
GPS took them a wrong direction. Mr. ****** also informed *** that there was a family emergency they had to go to. In
the complaint summary submitted, he now ran out of fuel. Mr. ****** asked if he could pay the bill for the trailer and get
it out so he may continue working and was told yes. ********************* called on 2/28/2024 about the tow and an
invoice was sent to them as well as an explanation to the tow. No response back from Progressive as to whether they
would cover payment for the invoice. Mr. ****** never came to pay the bill. Abandonment paperwork was filed by PSP on
3/11/2024 (22days after tow) as required for PA Salvor and submitted to the State for both truck and trailer. 30 Day
Notice was received on 3/22/2024. On 3/22/2024 ************** ******** ********, the lienholder of the truck,
contacted *** inquiring as to how we acquired it. Tow was explained to her as she had a repo order out for the truck.
Legacy Recovery picked the truck up and paid the tow bill for truck only on 4/3/2024 for **************. Ms. ********************* be reached at ************. The trailer was not registered in Mr. ******* name as the 30Day Notice came to a
******* ******. Mr. ****** has not contacted *** over the trailer. MV-956 was filed on 4/19/2024 and salvage title was
issued to *** for the trailer on 4/29/2024. Mr. ******* last contact with *** was on 3/28/2024 via email attached. All
further contact from Mr. ****** or Mr. ******* GF ****** ***** has been slanderous comments on social media or
reviews online. At no point in any communication with Mr. ****** has anyone yelled at him.
