Purchased a Bengal kitten on 5/26/24.Was told he had no health issues . No health records / bill of sale or contracts were provided at that time .Two days later on 5/28/24, kitten had runny, swollen, gunky eyes .Contacted seller ******* on 5/29/24 to let her know , she said sounded like a cold and instructed me to purchase eye ointment , which I did . Notified her of kittens worsening condition and vet/emergency appts. and diagnoses of URI . At that time she provided paperwork which showed she had taken said kitten for non-well visit for eating concerns to vet just 3 days prior to offering him for purchase, in which her vet also found his heart rate to be lower than that of kittens typically, suggesting further testing , which she declined . I feel she defrauded me , knowing , had she divulge that info before purchase I would NOT have made the purchase . To this date I have spent over $700 in vet bills for sick kitten and he is still not well . I have asked seller to accept return of kitten for full refund . ****** agreed to that on 6/13/24 , but then reneged on her agreement a couple days later when I asked *** setting a date to return him . She then stated I could return him but she would not offer any kind of refund until she sold him . Which I declined , due to the fact she has already been less than honest and forthcoming abt info and I would have no way of knowing if or when he was resold . She would then have my money and the kitten .

    Business Response

    Date: 07/05/2024

5/20/24 Kitten was taken to the vet on 5/20/24. The kitten was brought to the
vet due to how fast he seemed to eat, (he ate faster than his siblings and Bengals are
pretty fast eaters). My concern was worms due to how fast he ate and how often. Vet
visits are for a general physical or well visit, but I always want to make sure my cats
are healthy. Everything with the kitten was healthy except the vet noticed he had a
slow heart rate at the time of the visit. The vet stated this is something kittens tend to
grow out of this (like grade 1-3 heart murmurs,) and offered additional testing, at which
    time I had declined.
5/26/24 At the time the kitten was purchased ******* had no intention of buying a
kitten that day. She had asked if she could come visit the kittens, (which again is not
something breeders typically due to the possibility of bringing outside illnesses into the
H333736303531**323831H. However, I did allow ******* a visit as she said she was concerned my H333736303531**323831H
could be a scam. ******* decided that day that she wanted to purchase said kitten (at
the time the kittens name was ***.) She went back and forth about waiting for a
kitten at a later date, but chose him. Later that day I received a text from her stating
how he did great on the way home, loved his wet cat food and she loved him.
Due to the fact that no kitten was supposed to be purchased I did not had any of the
    typical items I give to new parents, which include but are not limited to: a bill of sale;
previous vet paperwork; a birth certificate we make up to give to families.  It honestly
was a COMPLETE oversight on my part as it was so rushed.
On the attached paperwork you will notice that at the vet visit, the kitten is completely
healthy and the only thing that was noted was a slower heart rate. The vet informed
me that this is something that kittens can grow out of. Therefore, I did not mention it.
The kitten left our H333736303531**323831H completely healthy with NO signs of illness.

5/29/24 A few days later ******* sent a text message to inform me the kitten had
one eye that seemed to be getting a "little watery." I informed her at that time that it
could possibly be the beginning of a cold and she could purchase Terramycin eye
medication and apply to the kittens eye twice a day for 10 days. She agreed.

6/4/2024 Customer took kitten to the vet where the vet made NO mention of a
slow heart rate. Visit was on 6/4/24. ****** was diagnosed with a URI and given
antibiotics per paperwork that ******* was reluctant to release.

6/10/24 I texted her to ask how the kitten was doing and she stated he was doing
better but then started to get worse and needed different antibiotics. I have not seen
the paperwork for this vet visit.

6/12/24 ******* called me and stated that she was at the ** with the kitten and
informed me the kitten was not doing well. She was concerned that he might not make
it. She had taken him to the Animal ** and needed to know if he was tested for FELV
and FIV, to which I replied he had been and was negative. She asked for a copy of the
vet paperwork and I immediately sent it to her and asked her to keep in contact with
me regarding how he is doing. ******* looked over the paperwork and then started
texting me. She questioned me as to why he was seen at the vet on 5/20/24 and
insisted I took him in knowing he was sick. She accused me of lying, saying her kitten,
and not his littermate, who was there for a skin infection that was not contagious, was
the one who was really ill. *****, the ill kitten was given Clavamox and Duralactin,
which is stated clearly on the vet paperwork.
The texts back and forth continued at least until 11:00pm. Again, at this ** visit, the
kitten was examined and the vet did not mention a slow heart rate.
6/13/24 ******* called me while I was working. After going back and forth and
insisting that I would NEV** give a sick kitten to anyone, she agreed that he was
healthy when he left our H333736303531**323831H. She admitted that he will not eat any hard food and
insisted the lack of eating HARD FOOD was the"eating issue" I took him to the vet for.
However, again, in our H333736303531**323831H we were mixing dry and wet food together and he was
eating that. ******* claims she tried that too, but he refuses. She commented that she
feels that this is unfair and she is a "prisoner to a kitten" because she has to be at the
house to make sure he eats since he does not eat dry food. She stated that she cannot
even go see her sister because she has to be home for the kitten. Due to this and his
slow heart rate, she feels she is entitled to a full refund and for me to take the kitten
back even though he was still recovering from a cold. By taking this sick kitten back, I
immediately put all my kittens in my house, in danger of illness or disease.
6/14/24 The text message received in the morning stating that the kitten&#**;s "URI is
much better today and he should pretty much be over it symptom wise by tomorrow."
Later that evening after 8pm, another text message stating her sister was not doing
well and she will drop the kitten off at my house that night (the call was at 8:50pm,) or
early the next morning. Unfortunately, I had left for vacation that Friday and would be
unavailable until the next Friday. She was not happy about this and said that she would
then drop the kitten off at my front door and however is caring for my cats while on
vacation will just have to care for him, too. That is when I called her and informed her
that she will not be receiving a refund from me and the person who was caring for my
cats, would not be responsibility to care for a kitten that the owner didn&#**;t want. I would
be home the following Friday and we could discuss when the kitten can be returned.
I did message ******* Thursday letting her know I would be home Friday evening and
he can be returned then. As far as receiving a refund, she will receive one when he is
sold. She asked for all of his medical records and bill of sale which was emailed to her
that evening. The next day she informed me that if the "courts decide I am not entitled

to my purchase cost I will then turn him over to the ************** for rehoming since
you do not want him back." I said I would take him back. She refused to give him back
stating "It seems you just want the kitten AND my money both."
She then left a rating on my H32353034343838**35**Hs Web page accusing me all that is the issue of this
    case.
I have had no further exchange with her since 6/21/24.
