    Contract signed with Absolute Enterprise on 3/23/22 with non-refundable cash deposit of $11,100. Video evidence of *** receiving and counting the money. Contract states "approximate" start date of 6-9 months from contract signing. ********, at contract signing, *** projected September/October start and that deposit money to be used to purchase materials.9/22 existing deck removed by owner according to projected timeline.9/22/22 voicemail from *** stating that deck is 11th on list.10/8/22 text message from *** - still on same deck.11/23/22 text to *** - "how's progress?" Response: "slow" due to weather 11/30/22 text to *** - express concern that project won't be finished until spring of 2023. Response: apology.12/01/22 text to *** - express frustration and desire to see decking materials supposedly purchased with deposit money. No Response.

    The contract was actually signed on 4/23/2022, see attached. 
    we have been in touch on a monthly basis providing updates and the progress on the projects ahead of theirs. 
    on 3/19/2022 we provided a quote at which time they were informed we were booked through the summer at that point, the sooner they decide the better to get on our schedule to start their deck sooner. A month went by, with multiple other projects coming on board, before they notified us they are ready to move forward. 
    on 4/23/2022 we met and signed the attached contract which states an approximate start date of 6-9 months. Today it has been 7 1/2 months. I hoped to have started by now. Our biggest challenge, since the pandemic started, is the same challenge almost every business is facing, hiring enough help, even ***** doesnt have enough employees to manufacture the new ****** in time for their deadline and it will be delayed when it will become available. As a result it is taking us longer than expected to complete each project. We will be working through the winter, weather permitting, to get their project started as soon as possible.

    While we can understand the economic factors affecting businesses across all industries, *** still has not addressed the initial concerns.

    1.  Our deposit was to purchase materials.  This has still not been confirmed after 2 attempts.  Has the material been purchased?

    2.  We need a completion date.  Yes, weather is a factor.  However, when we offered the services of our friends to assist in our project in the fall, *** demurred in that he did not want too large of a work crew.  Then we find out that he's been working by himself?!  There are two other companies waiting on ***** completion:  landscapers want to finish their job and get paid and an awning company wants to do their job and get paid.

    We are sure *** will install a superior deck and have tried to be accommodating to his situation.  Unfortunately, our trust is a little shaken without timely responses and updates.

    12/12/2022 the BBB contacted me about your complaint about our business. They stated after reviewing your complaint they believe it requires a response from our business.

    I understand your concern you filed with the BBB in complaint#******** on 12/12/2022. I responded on 12/15/2023

    1) your desire to see the decking material for your project

    2) your claim that the work was not completed within 6-9 months as stated in the contract (see attached)

    1) the materials for each project are purchased and delivered, by my suppliers, to the job site the day each project is started. 
    2) you claim the contract was signed on 3/23/2022 and the work was not completed within 6-9 months as stated in the contract. I responded on 12/15/2022 including attachments of the original contract signed by both of us on 4/23/2022, not 3/23/2022 as you stated. On 12/12/2022, when you filed the claim with the BBB that the work was not completed within the 6-9 months stated in the contract it had only been 7 1/2 months at that time. 
    I thought the BBB would review my response, as they reviewed your complaint, and see the original contract date and start date and realize the start date is still 1 1/2 months away and they would close the complaint. 
    on 12/15/2022 the BBB sent a message they forwarded my response for your review. 
    on 12/15/2022 I emailed the BBB at ************** (email attached) stating I thought they would review my response. I attached the original dated contract with the start date 1 1/2 months away, asking them to review the contract and remove the complaint as it is filed prematurely. I have not received a response from the BBB in regards to this email. 
    on 12/26/2022 the BBB responded to your initial complaint stating “ BBB has not heard back from the consumer….. the complaint has been closed.”

    on 1/13/2023 you contacted the BBB again stating I haven’t addressed your initial concerns. 
    1) has material been purchased. 
    2) you stated “we offered the services of our friends to assist in our project….. *** demurred in that he did not want too large of a work crew. Then find out he’s been working by himself?”

    1) the material is purchased and delivered by my suppliers to the job site the day each project is started. 
    2) see attached screen shot of our text conversation. I accepted your offer of your friends help to hire him as his work is slow. The next day you stated you misunderstood his situation and it is not feasible on HIS END. Then you asked if he can help with your project. Again I accepted stating unless I have a full crew at that time but I would be shocked if I had one helper let alone a full crew due to the considerable decline in our countries workforce since the start of the pandemic. 
    I hope the BBB will review my response before forwarding it to you and examine the contract and text conversation attached and realize your complaint was file prematurely and I did not reject your offer of your friends help.

    I am rejecting this response because:

     

    The original questions STILL remain unanswered.

     

    1.  I am now to assume that the materials have been purchased based upon the business' statement.

    2.  More importantly, there is still no start date.  April 23, 2022, ok.  We are now at January 25, 2023, nine months from the signing of the contract and the business owner still has no clue as to when our deck will be started.  The original guess of late August/September has passed, October estimate has passed, no chance for November, and now winter.  As stated before, other businesses are waiting on the completion of this project.  I need to know what month this deck will be started.  That is a basic concern.
