    CareFree Property Management (****) manages a property that borders my property. We share a common fence. The fence has been damaged on the **** property's side because of neglected bushes and debris. On August 23, 2022, I contacted ****. On August 24, *********************** from **** came to inspect the issue. He took pictures and told me that the bushes and debris will be removed and the fence will be fixed in about a week. After a few weeks, I tried to contact **** because nothing was done. He was not responding to my emails, calls and messages. When I called on **** main phone line and asked to talk to ****** manager, I was told that this is a family run business and there is nobody above ****. On Oct 11, 2022, I filed a complain with BBB. **** responded asking to provide an estimate for repairs. I explained that all of the damage is on their property's side. **** requested that I send new pictures. I provided new pictures on December 4, 2022. On December 6, 2022, I received an email that a landscaper will come to clean the bushes and debris. On January 12, 2023, I sent another email to **** since nothing was done. On February 2, 2023, **** sent me an email that landscaper removed the debris along the fence. I do not see any evidence of it (see the attached image). When I asked for a date when the fence will be repaired, **** stopped responding to my emails again. It has been 6 months since I contacted CareFree Property Management and was told that the fence will be repaired within a week.

    Generally,a good neighbor fence between two properties is the responsibility of both owners to split the cost of the repairs.  We have asked you to present an estimate for the cost of the repairs that I can bring to the owner of the home for consideration.  Our owner is not interested in building you a new fence when there is little wrong with the existing fence, and it is not even visible from the house on his property.  I am not authorized to spend his money on a new fence unless he agrees to it.  Sending a complaint to the Better Business Bureau to try to strongarm my owner to pay for all of the fence is not the way to go about it.  If you'd like to present an estimate for the repairs, I will forward it on to the owner of the property for consideration.

    I am rejecting this response because:

    1. All of the damage is on your property's side of the fence caused by neglected bushes and debris.

    2. Why are you asking me to provide an estimate? All of the damage is on your side of the fence. The estimator will have to be on your property to estimate what repairs must be done.  When you came over on August 24, 2022, you said that you would fix it within a week.  6 months later you are asking me for an estimate?  

    3. I am not asking you to build a new fence.  I am asking you to replace a few boards that are rotted on your side of the fence because of the neglected bushes and debris on your property.

    4. I filed the Better Business Bureau complaint not because I am trying to strongarm your owner to pay for all of the fence.  I filed it because you were not responding to my emails.  This is the only way I can get any sort of response from you.  I gave you a warning that I would file a BBB complaint if you keep ignoring my emails and you still kept ignoring them.

    Additionally, you have told me that you would be doing something within different timeframes and each time these timeframes expire, nothing is done and you stop responding when I follow up.  I am happy to provide a log of all of my contact attempts. 

    I would like to reiterate that there is no damage on my side of the fence.  All of the damage is on your side of the fence due to years of mismanaged and neglected bushes and debris that your company is supposed to manage.

    Carefree Property Management Inc manages a property at **************************************************************************************** that shares a fence with my property. The fence needs repairs on the Greenwood property's side and there is a tree on the property that grows over my house. The tree was evaluated by an arborist and it was recommended to trim branches to avoid them falling on my house.On August 23, 2022, I contacted CareFree Property Management by phone and was told that the property is managed by ***********************. I was given his contact information.On August 23, 2022, I sent an email to **** explaining the problem.On August 24, 2022, **** came over. I showed him the problem with the fence and the tree. **** promised that next week CareFree Property Management will send crews to work on both issues.On September 6, 2022, I sent an email follow up to **** because nothing has been done. I received no response.On September 13, 2022, I sent another email follow up to ****. I received no response.On September 19, 2022, I called CareFree Property Management. Receptionist told me that she would ask **** to call me. When I asked if I can talk to management, I was told that the business is managed by ****** family and there is nobody above him. I never received a call back. On September 27, 2022, I called CareFree Property Management again and got transferred to ****. **** told me that he could not reach the owner of the property. He promised that he would get back to me by September 30 with an update even if he cannot reach the owner. As of now, October 11, I still have not heard from *********On October 5, 2022, I sent another email to **** and to CareFree Property Management's company email asking them for contact information of the property's owner so that I could work with him directly since CareFree Property Management was not cooperating. I did not receive a response.Please assist me with compelling CareFree Property Management to address the above issues.

    The fence between the two properties is considered a "good neighbor" fence and therefore any repairs would be split between the two property owners.  The repairs would be minimal at best, and we would be open to splitting the cost of repairs if an estimate were presented to us.  As for the large tree that towers over the neighborhood, it is impossible to trim the branches off at the property line so that it no longer hangs over his property.  This would simply kill the tree and we are not of the mindset that a hundred year old tree should be removed because of a few branches.  Trimming the tree is something we'd consider.  We have not seen any evaluations from this neighbor's arborist as of today.

    Any repairs to the fence or trimming of the tree would need the approval of the owner of the property as well which we have yet to receive.

    I am rejecting this response because:

    The repairs of the fence need to be done only on the side of the property managed by CareFree Property Management.  Nobody talked to me about splitting the cost or requesting an estimate.  I am fine with splitting the cost, but the estimate needs to be done by CareFree Property Management because all of the damage is on their property's side. 

    Regarding the tree, I never asked to remove the tree.  I only asked about trimming the branches.  That is what was discussed with *********************** and he agreed to do it.

     

    CareFree Property Management acknowledged the problems with the fence and the tree and promised to resolve both of them when *********************** visited the property on August 24.  Nobody contacted me afterwards to request any estimates, reports or discussing any costs.  All of my attempts to get any response since August 24th from CareFree Property Management were ignored.  This is the first time they responded.  They are claiming that they could not contact the owner for 2 months now and they ignored my request to provide the owner's contact information.
