Around 2012, I had surgery at Oregon Ear Nose and Throat for a lump in the back of my neck and a deviated septum. I paid over a 1000 up front and insurance was billed. In 2014, I moved back home on the east coast. I had no idea that this money was owed to them. When I was in Oregon, I was in an abusive relationship and relocated. After that, I did not receive mail. I was living in ************** at the time of the judgement and had no idea that it occurred. They are all individually small medical debts owed. This is not a situation of me skipping out on a debt. I thought my insurance covered my surgery. H.R.2537 - Consumer Protection for Medical Debt Collections Act states A consumer reporting agency is prohibited from including on a consumer credit report, and a person is prohibited from reporting to such agency (1) medical debt arising from a medically necessary procedure, or (2) other medical debt less than a year old.A person reporting medical debt to a consumer reporting agency must first provide notice to that consumer regarding the restrictions on including medical debt on credit reports.Furthermore, a debt collector is prohibited from collecting a medical debt less than two years old.I have tried to contact this creditor several times and they have given me 3 different amounts due for the same bill. I have made very reasonable negotiations and they refused. I also asked for something in writing that states the amount negotiated for payment and they refuse. Some people have had the issue where they agree on the settlement and the business goes back on it so I wanted to be safe. They said that they would not even provide me a receipt. This has been a nightmare. I would like a fair negotiated settlement and this removed from my credit report.

We dispute the information provided by the consumer.  There are 13 debts owed from 2014 and prior, all in a judgment.  We have had many communications with the consumer over the years, but have not received a payment since 8/2014.  The consumer has contacted our office this week asking to settle the debt.  We always provide receipts when asked.  The laws the consumer is citing here are not correct at all.  These debts are valid and owed, and in a judgment through Oregon Courts.  We also want a fair settlement and will agree to something that is fair for all sides.

      Complaint: 21431362

I am rejecting this response because I and another individual named *********************** who contacted them on my behalf, called them again on Friday, 3/16/2024 at 12:07 and 12:35.  I called them again to put in an offer to clear the debt.  The creditor said that they would consider it and for me to call back later.  I called again at 5:14 pm and they still did not have an answer.  They told me to call back Monday.  I have been trying over a week pay this debt that I was not aware of.  For a company that claims that they have tried to contact me several times, they sure are making it difficult for me to pay this debt.  I also am having to call them because they said that they cant call to ************** from their phones it contradicts them saying they have made attempts to get ahold of me.  I am even willing to have a Better Business Bureau associate be on the call with me to see if this can be resolved or what I have been experiencing if they again delay me being able to pay.  It only benefits them because they can collect on the interest to not make an effort to contact me.  Again, this is again on a surgery that I put money down on and that I didnt know my insurance didnt cover.  As soon, as I discovered this issue, I have been desparately trying to pay it to the point that Im having to contact the better business bureau to try to get it resolved.  Again, as soon as I was made aware of it, I have made several calls to pay ita total of 9 phone calls, and I still cant get this resolved.  I have even offered more than professionals have told me to negotiate for and I have still not been able to resolve this.

I have tried to attach my phone records as proof of me trying to resolve this, but they are too large.  The ******* Oregon numbers are for the business as well as me contacting the Jackson County Court system.  I am happy to send them via email as proof.

Below are the numbers of witnesses that can attest to the difficulty that I have been having:

***********************: ************ (listened to interactions between me and the associate)

***********************: ************ (All Western MortgageLoan Processor)

Not sure why there is continued issues as the consumer has contacted our office and paid the debt in full as of 3/24/24.

      03/26/2024

I would also like to add that the lied for two weeks stating that they could not call me in **************. That I would have to continually call back.  Yet, an associate was able to call me back twice yesterday.

They dont listen to previous calls, yet assume they are right on their end.  It wasnt until after I paid my bill with my checking account that the mentioned it would take longer to processshe stated it almost as if she forgot.  When I called back to see how I could get this resolved, an associate belittled me like I should have known better. I then had to pay a 150 fee just to get it paid with a debit card so I could have the debt settled fast.

This organization is like the mafia.  Jackson County Clerk of Courts should ban their business from judgments.

A charged-off debt from Reliable Credit Service has been placed for collection with our company.  We have made over a dozen communication attempts for the consumer to communicate with us and he has refused to do so, other than filing this "complaint".  We will treat this communication as a dispute of the debt and validate it according to state and federal law.

All debts do not require a written contract to be valid.  We are in the process of receiving documentation for proof of debt with ********************** and once received will pass along to the consumer as required.  If Lane cannot validate the debt it will be removed.  If they can validate the debt it will remain and collection efforts will continue.

The consumer needs to review the statute of limitations on judgments in Oregon, as this debt is well within the limits.

I received a letter from someone in December they were going to mail me a statement because the reason I went to collections was that they had the wrong name and address. I never heard then I get a letter from an attorney. I call and find out that they filed a small claim against me. I spoke with someone from the credit services explained everything and asked if could i make payments. She said yes but we are still moving forward with your case. I explained that I should not be penalized because of their and the doctor's *** mistake. she was rude and said I had to pay the full price or I could get served. then they charged me ****** in interest the original bill was ****** and ***** for court fees. I checked with the court they said I could make payments. She also told me it's too late to make payments we are still moving forward with small claims. They failed on their part as well as Sothern Oregon imaging which I was just there about 2 months ago and they all whispered behind the desk instead of speaking to me and apparently called ******* Oregon credit. So for there mistake with the wrong name and address and city, I was penalized and they made me pay ********. I think credit services tell you whatever to scare you when they give incorrect information. i would like this looked into. They have corrected my name and address so they will probably try to say they had my correct info. The first question from them do you still live in Talent Oregon. Never have

      Business response

      04/07/2023

We cannot respond to any issues regarding Oregon Advanced Imaging or their staff.  Our records indicate an account was placed for collection 4/29/2019 with the **************, which is likely a transposing of the last two digits by our client.  We placed 10 calls to the consumer between April and October 2019, the only instance of a response came on 5/16/2019 when the person answering the phone, same as the one the consumer uses today, hung up on our staff member.    We received a call from the consumer 12/7/2022 who told us she did not remember the service and requested validation of the debt.  Those documents were mailed to her 12/20/2022.  We cannot speak to a "letter from an attorney", as that would not have anything to do with our company or this account.  We filed small claims action and did not get the consumer served.  She called in and paid in full 3/1/2023.  She called in on 3/2/2023 and asked for a breakdown of the charges.  This information was mailed 3/2/2023.  The small claims case has been dismissed and the account is paid in full.

I am being garnished by the southern Oregon Credit service and I already am having a hard time paying my bills. I am a single mom of 3 and I work part time and my usually almost $400 check have been literally cut in half because of the garnish. Also, I have not once received anything saying why and for what I am being garnished for.

We have had a judgment since 2018 for a medical debt.  The consumer has not made a single payment or any effort to pay.  She has been served with papers for the lawsuit and a subsequent debtors exam which she failed to appear in court for  March 2019.  We have made dozens of calls to the consumer and spoke to her for the first time June 2021 and again October 2021.  She is aware of what the debt is for and she needs to make payments but refuses to do so.  Instead she avoids all communication and disputes these valid debtors repeatedly with the credit reporting agencies.  Cooperation and communication by the consumer may go a long way in helping her but she has not done those things so far.

On 6/29/22 I called about a Medical collection that my wife got when she was taken to the hospital from Covid. She spent 7 days in ICU because she flat lined when she arrived. She was released and was told all would be covered because it was Covid related. But Southern Oregon credit service just filed a small claim on us and they claimed they had attempted too call but they didnt. They are taking advantage because they must believe we a stupid Mexicans that dont speak English. Long story short I had no option but too pay what they claimed was owed. How did a 7 day stay in ICU only come to $3011.46. They did not care and with the worst service ever a girl named ***** keep saying that if I didnt agree I could file with the court. She keep saying it in the most rude manner. It is enough that companies act like this with people with Mexican names. When will the discriminating stop and will the BBB stand with them or will you actually stop the racist actions from companies

      Business response

      07/29/2022

****************** is out of line and completely incorrect in every assertion he makes.  He was rude and would not listen to anyone trying to explain his debts and why he owes them. To call people racist when you don't like them or what they have to say is very difficult to understand or compromise with.  We have tried to explain his bills and why he owes under the doctrine of necessaries, but he will not listen.  He needs to get an attorney if he feels he has been mistreated or we are taking advantage of him in anyway.  His wife's debts are legitimate and owed.  What he chooses to do about his responsibility is up to him.

Southern Oregon credit services have not replied back on anything. I have called them to try and send me information on the collections I owe. I even hired a lawyer and he sent them a letter trying to get information on what I owe and to settle the debt and nothing was heard back.

      Business response

      04/29/2022

The consumer is represented by an attorney.  Under federal law we are prohibited from communicating directly with the consumer and are allowed only to communicate with her lawyer.  We last heard from his office 9/23/2021.  As a policy we do not work with debt settlement companies but will work with Consumer Credit Counseling.

I received a notice of refund offset from the Oregon ***** of ******* on 03/28/2022, stating that my Oregon Income Tax refund was reduced by almost $860 to offset a debt owed. The payee is listed as City of ************************-Southern Oregon Credit Services. First I've heard I allegedly owe a debt to either party. I called City of ************************ who stated they had no record of a judgement under my name, but directed me to ******** ************** ******** W&S said they did have a record of an overdue **** from 2010. I've never heard of an overdue water ****, and I have moved several times over the past 12 years. The ***** of ******* letter states "You have already been given the opportunity to appeal the debt your refund is being used to pay". News to me. Since this debt allegedly occurred in 2010, which is over twice the Oregon statute of limitations, I certainly don't have any records, bank accounts, or documentation from that time. Can anyone just contact the ***** of *******, claim a debt, say the debtor has been given the opportunity to respond, and confiscate someone else's tax refund? I really don't know if I ever owed money to ******** utilities, but it really doesn't matter since the Oregon Statute of Limitations is 6 years and this allegedly occurred in 2010. Southern Oregon Credit Services is certainly aware of this, and I hope they have dotted all the i's and crossed all the t's as the Oregon Attorney General is my next call.

      Business response

      04/27/2022

We have investigated with the City of Sherwood and received proof of the original debt, which has been mailed to the consumer per his request.  There is no doubt many notices were sent over the years, but as the consumer states he moved quite a bit and perhaps failed to forward mail appropriately.  The statute of limitations applies the consumer cites has to do with filing a lawsuit on a civil matter, and does not apply to either municipal-owed debts or to the tax intercept program. The City of Sherwood has confiremd the debt is valid and owed.

I am rejecting this response because: I find no exception to the six year statute of limitations for utility bills or municipalities in the *** or any online forum, only State tax debt. Unless shown otherwise I will assume this collection agency has unlawfully used the taxing authority of the State of Oregon to collect an invalid (alleged) debt.

This is for a collection agency. They send someone to serve me papers for court on debts I don't even understand. I've asked them for proof of those debts, which are over 4 years old for medical facilities I have never visited, and they do not provide them. They say I'm supposed to submit an answer to the court. This company is notorious for doing this to people who are unable to pay their medical bills. Because they know they cannot afford to fight in court.

      Business response

      10/18/2021

We have made numerous attempts to contact the consumer - dozens of calls and letters over the last few years with no reply.  The consumer has received significant notification and has ignored it.  He has not responded until he was served with papers for a small claims action and has asked to give him time to research why insurance hasn't paid these.  Even though his EOB shows this is his balance after each service we have agreed to hold action until after 11/1/2021.
