This company sent me a reservation of rights letter regarding - notice or right to lien via certified mail. They did not perform their due diligence properly as my home / property is not under contract for any type of labor or materials. Nor have the two construction companies listed within the letter ever performed/ provided work/material at my home/property. I called to have their mistake corrected, only to be met by a glib, condescending man who was not at all helpful. He was dismissive and told me to call the contractor. While I understand the reservation of rights is just that. What this company needs to understand, is that as an agent working on behalf of the hiring party (The Contractor) you are not protecting anyones interests accept for your clients. Your prior excuses relative to complaints such as this are just that, excuses. And you keep doing the same thing to the public. Its irresponsible, and menacing, When you go around without performing your due diligence properly and you dont verify the contract your client(s) enter- in order to cross reference owner of the address you company located vs who entered the contract etc. Youre simply going through the motion to get paid. In turn, youre causing unnecessary and unfair anxiety/time/money/resources to others. This company does appear to act in a fraudulent manner based on their lack of professionalism and willingness to continue to cause harm to people in the community. Fraud works in more ways than just monetary measure. Stop make the same mistakes and then ignoring the stress / harm you cause others. Start doing an accurate professional job and take accountability for your errors. Of course there will be some, but own it and correct it. Send out a corrected letter to the people who your freaked due to your negligence.Business Response

Thank you for giving me an opportunity to respond to this complaint and reopen this. I don't show where the original response was received and you can see that it wasn't opened until January 26th.
This is an issue that is often misunderstood and the system actually worked. We are agents only and receive three answers to questions from our clients, day they started, who hired them and the address of where the work is being performed. Often times our clients are dependent on their client for that information so there is another layer of potential problems. With that our job is to research the property owner and serve them a Right to Lien notice which protects the homeowner from potentially paying twice for work and services performed. If they have no work going on (which the form indicates) they have no responsibility. If they do they have the ability to protect themselves. It appears obvious in this case that our client received bad information, possibly from the builder or subcontractor. We're sorry but we really have no control other than to perform what were asked, which is what we did.
I'm more disappointed in how the follow up call appears to have gone. I have talked to the two (typically) staff members that deal with these, neither appear to have any memory of this event. Are typical response is to listen to them when they say it was sent in error and in most cases to contact our client to determine if they want us to send a "sorry letter", Again being agents they need to authorize it which sometime for a variety of reasons doesn't occur (including not replying). Again, if they have no work being performed they have no responsibility. I remain sorry if that call was mishandled. If they would like to send me the notice I will reach out to our client to work towards getting our standard "sorry letter" Thank you

On 11/16/2023, concrete was provided by *********************** for my home remodel. They never sent a bill to me and I still have not received a bill. They sent ** to a collections/ lien company, RoHill Business Solution, 8 days after providing the concrete for the job. They sent letters to our bank, mortgage company as well informing them that they intend to put a lien on the house. I still have not received a bill for the concrete. I have contacted my attorney. I will also be contacting the governor's help line and the The Oregonian. Please help.Business Response

The Notice that was sent on Behalf of Knife River is a statutory requirement for any supplier to maintain a right to lien the property if not paid. It clearly states that it is not a lien and provides the recipient with information and contact for inquiries. I hope this gentleman does not waste his money on an Attorney.

I got a notice to put a Lein on my property from this company, for ******************* construction. But i haven't' had any work done at my home in over 10 years. This is a fraudulent company, wreaking havoc on innocent people, causing me stress and heart ache. Do I need a laywer? What is going on! There's no contract, how can this get through the courts when I never signed anything. Why are you doing this? Your practices are fraudulent and you need to STOP doing this to people! The letter I received was by certified mail. Very official, and scary. Don't do business with this company, you will be taken for a ride.Business Response

I am always amazed at how some people want to banter around "fraudulent or fraud" when they haven't spent the time to understand what these notices are. Our job is to protect all parties on construction projects and assure our clients are compensated for the work they perform. We are only following the state statutes (all 50) & requirements which requires certified mail to assure that owners receive them. We don't make the statutes we abide by them.
We are "AGENTS ONLY", representing roughly ***** accounts, We only do what is required. Our clients furnish an address, customer and date that they have most likely been furnished by THER client. Our job is to research ownership and furnish what we find with a notification that if they have work being performed to make sure the client listed is paid. If there is no work being performed the form would indicate that if nothing has been provided, then the "notification only" document does not pertain (the form says "FOR LABOR, EQUIPMENT OR MATERIALS THAT HAVE BEEN PROVIDED").
The document also lists our number to call with questions. Our message says if the phone call is not answered on the first call to please call back. Since Covid, several from our office work remotely but the phones are monitored all day.
I would be happy to send you the ***************** email request and notice to substantiate what was done. It appears to most likely be an address error from ***************** on submission. If requested we would pass along the information to ***************** so they can properly determine if this was an address error. Based on their review & request, a retraction letter could be sent.

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. Although the company refuses to apologize for the error, the other party has, and has made it right. Just because they (rohillco) are within the law doesn't mean they didn't cause damage, I wish they would understand that, so I am wish you would leave the complaint up, and I hope they see that innocent people are HARMED by their "rights". just because they were given wrong information doesn't make them innocent. Anxiety is real. What if it was their 80 year old mom that got this notice? would it make a difference? What if the Notice of a lein was enough to cause a heart attack? Anxiety is real. ***************** apologized for their part in this mess up, so I will say we have been completed.

We have received two different notices about a year apart from this company on a notice of a right to Lien . All of these claims were for the neighbors property not ours. As the paperwork shows. It seems like this company is operating as a predatory company sending lien notices out to neighboring properties to see if they can get any hits. Ive tried a dozen times to reach the company by phone and they are never available. If this company is actually legitimate they have a major failure in their research as to the ownership of the property.Business Response

We just now saw this complaint. We are agents only for approximately **** clients and send out a document that is called a Right to lien notification (NORTAL) which is required in many cases in ****** for subcontractors and material suppliers to protect their lien rights. ALL addresses are supplied to us by our clients and that then is who we research to furnish the required paperwork. If the document is read by the party that received them IF they have no work being performed then there is no ability to perfect lien rights on the property. There is no failure in researching the property submitted. Mistakes do happen with our clients sales staff getting the initial wrong address or in this case right next store. I'm not sure why he had trouble reaching someone on our dedicated line for this. I can only assume that because our staff has moved to remote positions it wasn't covered momentarily. We also have several additional numbers listed and contact information listed on our website that could have been reviewed and contacted. Thank you
